There are strong indications that the embattled senate president, Dr. Bukola Saraki may be remanded in prison in Tuesday’s hearing at the Code of conduct Tribunal.

The tribunal according to investigation might based its judgement on the trouble it went through to make Saraki appear today, despite several orders.

It should be recalled that, Code of Conduct had filed a 13 count charge against the senate president, but in what looked like scandalizing the code of conduct, Saraki failed to honor the tribunal on Friday.

In an effort to prevent his trial by the tribunal, Saraki sort the assistance of a federal high court to restrain the tribunal from sitting over is matter, but eventually, the tribunal sat and took a decision. It ordered the inspector general of Police, Solomon Arase to arrest the senate president and produce him in court on Monday.

In the ruling, the tribunal headed by Justice Danladi Umar issued a bench warrant against Saraki following his refusal to appear in court to face a 13-count criminal charge that was preferred against him by the Federal Ministry of Justice.

Irked by Saraki’s absence at the tribunal for the commencement of his prosecution over alleged false declaration of assets, the Ministry of Justice had prayed the Justice Umar-led panel to order for his arrest, saying “he cannot sit in the comfort of his chamber and object to his trial in absentia”.

The prosecution further maintained that Justice Mohammed lacked the powers to summon ‎the CCT and CCB chairmen, even as it accused Saraki of engaging in “forum shopping” in a desperate bid to scuttle his trial. This prayer was granted.

However, despite the order of the tribunal to Inspector General to produced Saraki on Monday, the senate president failed to show up again. The police claimed it didn’t receive the arrest warrant.

As a result of his absence for the second time, Justice Danladi Umar issued another warrant arrest and ordered the Inspector General of Police to arrest and dragged him to court on Tuesday.
The Code of Conduct Tribunal again ordered the Inspector General of Police, Solomon Arase to arrest and produce the Senate President, Bukola Saraki , by 10:00am on Tuesday, to answer charges pending against him.
The chairman rejected Saraki’s lawyer’s prayer that it should stay proceeding to await the outcome of an appeal he filed against the bench warrant earlier issued on Friday.
Umar discountenanced the argument by Saraki’s lawyer, Joseph Daudu (SAN), that the newly passed Administration of Criminal Justice Act (ACJA) – which seeks to discourage undue delay – is not applicable to the tribunal.
In fear of public disgrace, Saraki announced his readiness to attend the tribunal hearing on Tuesday.

“The Senate President is a law abiding citizen and his absence from tribunal was based on legal advice he received from his counsel that it is not necessary for him to appear before the tribunal at this stage since the jurisdiction of the tribunal and the process of initiating the matter are being challenged before the federal High Court Abuja,” a statement issued by him read.
“Following the adjournment for the determination of the motion on notice and the substantive suit before the Federal High Court to 30th of September and the appeal pending before the Court of Appeal adjourned to the 29th of September 2015, the Senate President has decided, as a law abiding citizen, to appear before the Tribunal in the interim.”
“Saraki has taken the decision to attend the Tribunal sitting to demonstrate his respect for the rule of law in spite of his personal reservation on the process of his trial and the purpose it may be intended to serve.
“Saraki wishes to assure Nigerians of his absolute belief in the judicial process and is therefore confident that the course of justice would be served at the end of this matter,” the statement said.
However, Investigation by Mr Rights shows that, while the case against Saraki is bailable, the head judge, Justice Danladi Umar might refuse Saraki’s plea for bail. Those aware of the issued noted that, justice Umar may be justified to refuse Saraki’s bail request if they did request for it, hanging the decision on the efforts made to make him appear in court for the first time despite several orders.

It was argued that, since saraki had failed to appear before the tribunal on two occasions, the head judge might deny his bail request because it cannot guarantee that the senate President would return to the court if allowed to leave.

Every Nigerian believes that "If we do not kill corruption, corruption will kill Nigeria". However, to effectively fight corruption in Nigeria, you must avoid witch hunting. To avoid witch hunting, you must start the war against corruption from a Nigerian who has no religion, tribe, wife/husband, sister, brother, inlaws, political follower, children, grand children, political party and non politcal organizations etc.If you start with A Christian, fellow Christians will shout witch hunting. Same with Muslims. Start with a Northerner, fellow Northerner will shout witch hunting. Same with Southerners. Start with PDP, party faithfuls will shoult witch hunting. Same with APC and others.

The war against corruption must start somewhere, let it start with Saraki. Soon, it shall reach every other person.

The term Superior/Inferior court of record… where does it source from? It does not emanate from Nigeria Judicial System rather from English Law. How are we careful in the importation of this terms that originated from a country with unwritten constitution unlike our which is written and this is the fundamental cause of the confusion experiences in the application of the term Superior/Inferior Court of record.

As a popular Common Law term, Court of Superior record is a court of general competence which typically has unlimited jurisdiction with regard to civil and criminal legal cases. A superior court is superior relative to a court with limited jurisdiction. A superior court may hear appeal from lower court.
The direct importation of Superior/Inferior Court of record without cushion is good enough to mislead insensitive lawyers and judges. The reason being that such term of Common Law origin which has no statutory identification in the Nigeria context can only be interpreted from English Law rather than conclude ignorantly that Superior courts are the court stated in the Nigeria Constitution. Meanwhile, the decision of Inferior courts in the England could be reviewed by the royal court, as part of Crown role of ultimate fountain of justice. The royal court became known as superior court while lower courts whose decisions could be reviewed by the royal court became known as inferior court. The decision of the superior courts was not reviewable or appealable unless an appeal was created by statute.

The above position in Common Law parlance is not directly applicable in Nigeria in the light of the clarity of the Constitution, particularly on the bodies that are constitutionally constituted such as Election Tribunal and the Code of Conduct Tribunal. The Code of Conduct Bureau and the Code of Conduct Tribunals are provided for and established by the Constitution of Nigeria in third schedule and fifth schedule respectively. Also, it’s specialize function and jurisdiction was clearly spelt out, the appeal from the decision of CCT according to an incontrovertible law, the Constitution lies as of right to the court of appeal just like that of the High Court lies to the same court of appeal. One cannot do but to agree with the position of the chairman of CCT that CCT and High Court are court of equal jurisdiction. Contrary to the opinion of Olisha Agbakoba SAN, I consider CCT as Specialized Superior Court with exclusive jurisdiction over certain matters. What better clarification do we need?

The common law terms are more useful in England while the Nigeria Constitution is the Superior Law in the land. I don’t see the relevancy of causing “bamboozlement” with an imported term where our law is clear on what is what.

I strongly consider the opinion accredited to Olisa Agbakoba SAN and one other Adegbowura as misleading and barrage of fallacies. According to them: “The Federal High Court had power to review the judicial work of the Code of Conduct Tribunal because is an inferior court…”Olisa Agbakoba SAN “The court is under the supervisory jurisdiction of high court…” Adegbowura. As you can see, the functions and modus of appeal of the court are clearly stated in the Constitution of Nigeria. I don’t know while they reason in variation to the constitution of Nigeria and the relevant laws. The learned silk and the lawyer in question prefer to jump the boundary of Nigeria Judicial system where it is unwarranted. The reasoning may be acceptable in English court in a country where there is not written constitution.

Let us take note of the fact that the opinions are not law… The courts have the final say while the law are made in our Legislative Houses while courts have the final say not Olisa Agbakoba.

8 reasons have been given on why President Muhammadu Buhari and the All Progressive Congress APC cannot forgive senate President, Dr. Bukola Saraki.

Following reports of Former Vice President, Atiku Abubakar, Sultan of Sokoto, Alhaji Abubakar Saad and Emir of Ilorin, Alhaji Ibrahim Zulu Gambari all begging President Muhammadu Buhari to interven on Dr Bukola Saraki’s travail, a member of nairaland, an online forum have outlined 8 good reasons why President Muhammadu Buhari and the All Progressive Congress APC cannot forgive saraki.

The nairaland member who operates under username OPCNAIRALAND, states as follows:
1. Saraki was invited by the Party before he became Senate President and in a move to resolve disputes, he bluffed them.
2. He was invited by the VP, he insulted and called the VP of Nigeria a mere commissioner and did not attend the intervention meeting.
3. He was invited by the President for dispute resolution, he stayed away and engaged in a scheme with PDP against his party to emerge President and PDP as the Deputy President of Senate.

4. He was invited a second time by the Party, he again refused to attend.

5. The party made an overture of reconciliation and ask that they will forgive and move on but they need Senate Leadership to be party selections. Saraki killed that peace initiative and put in positions of Leadership people that are not in line with the party’s directive.

6. A similar appeal to Dogara in the HOR was accepted and the Speaker of House reconciled himself with the party. Saraki continued to be obstinate.
7. When he was asked to go and make peace with Presidency….his supporters said they do not need the Presidency, the Presidency needs them.
8. He was invited by Code of Conduct Tribunal, he bluffed the Court and went to a different Court for protection.
Having the the 8 reasons above, the user asked, ‘’Why should the President listen to him now that he is locked into a corner? Why should VP listen to him, why should the party listen to him? He asked?
He also asked that, ‘’where was Sultan, Emir of Ilorin and Atiku Abubakar to caution him when Saraki was insulting, disrespecting and bluffing everybody?’’



He concluded by saying, ‘’Who is Saraki….is he god? Make him face his own music and learn to give honour unto those he wishes to receive honour from. Boot him out!!

Saraki left the PDP for personal reasons……not because he wanted CHANGE.

This is evident in his behaviour since APC became victorious. APC trusted Saraki, jilted Belgore just to please Saraki. APC asked both Belgore and Lai Mohammed to relinquish the state leadership to Saraki. While Lai choicelessly agreed, Belgore left APC because ‘I can never be in the same party with Saraki talkless of him leading me’…..Raji Fashola spoke and appealed to his bosom friend Belgore not to leave APC but the latter sought Fashola’s understanding on the fact that Saraki is not a human being and that APC will regret having Saraki in its fold. APC openly celebrated Saraki. Saraki nominated every single political appointments in Kwara……he took over the structure of the APC in Kwara. APC narrowly won Kwara with just over 100k votes above the PDP.

This slot would have naturally gone to the SE had Ngige or other experienced APC senatorial candidate won but APC NASS conflict’s foundation was laid by the rejection of the party in the SE! Therefore, 3 major lucky contenders were jostling for the Senate President position……Lawan from NE, Saraki and Akume from NS all wanted to fill the vacuum created by the SE. Buhari and APC preferred Lawan from the NE instead of Tinubu’s friend Akume and Atiku’s choice Saraki. Tinubu being a smart man quickly asked his friend Akume to step down for the Party’s and President’s choice Lawan. Akume, another reasonable politician agreed! Tinubu is not just a driver, he also know when to accelerate and when to march the brake!!!!!!! Atiku and Saraki kept on accelerating even when it was obvious that the duo have approached the zebra crossing!!!! A warrior that knows how to fight that does not know how to run when necessary will eventually perish in the battlefield! Saraki and his pushers became arrogant and resolute to disgrace the APC and the President

A presidential source has disclosed that, Senate President, Bukola Saraki’s trial have nothing to do with politics.

The source who don’t want his name be mentioned said, It is strictly a matter of law and order.

According to the source, ‘’If the code of conduct, a constitutional body believes he has committed an offense, he should go and face trial and prove his innocence.’’

The source, who frowned at the manner at which some politicians are attributing Saraki’s ordeal to politics said, ‘’it is wrong to attribute every just cause geared towards sanitizing the country to politics. This is what crippled many government agencies in the past. He maintained that, there is no politics in saraki’s travail, it’s a matter of law.

Former Vice president, Alhaji Atiku Abubakar, Sultan of Sokoto, Alhaji Muhammadu Sa’ad Abubakar, and the Emir of Ilorin, Alhaji Ibrahim Sulu-Gambari may have begged President Muhammadu Buhari to save the Senate President, Dr. Bukola Saraki in the on-going travail.
On Friday, the Code of Conduct Tribunal (CCT) has issued a bench warrant against the Senate President, Senator Bukola Saraki over his refusal to appear before the tribunal for criminal trial.

The presiding Chairman of the tribunal, Justice Danladi Umar, ordered the Inspector-General of Police, Mr Solomon Arase, to arrest Saraki and present him before the tribunal on Monday. However, police said they are still waiting for the warrant to effect the arrest of the senate president.

After the order to arrest Saraki, Freedom Online learned that, a presidential source declared that while the monarchs spoke with the President, it is not clear if the former vice president had spoken with the president “because when he called, the President was busy”.

The source revealed that, ‘’All the calls were in connection with what the source described as “an embarrassment to the country, the government and the All Progressives Congress (APC)”.

The source according to Herald newspaper couldn’t confirm whether they are not calling the president too late “as he has made up his mind not to intervene in any corruption trial”.

The monarch who called according to sources said, “They called the president to see Saraki immediately. I don’t know whether he will see him Saturday. You know the president is going to the U.S. next week. So, if they must see him, it must be this weekend.

“What they are after is a peaceful resolution of the crisis. Obviously, some forces are after Dr. Saraki because of the Senate Presidency. The moment that is resolved, every other thing may be resolved. But, the resolution of the crisis depends on the president’s mood, whether he wants to discuss the Saraki matter with anybody or not”.

The Tribunal order was issued on Friday at the opening of Saraki’s trial over allegation of corruption and false declaration of assets.
The Tribunal had summoned Saraki to appear before it, but he obtained a federal high court injunction stopping the summon and his trial.
