LagosismyHome: Correct ....The problem with the phd is that she would be able to extend her f1 but not be able to change status to PR or any spouse visa so in some years still at this same point .... because of fullbright thing she expected to spend 2 years in naija thats all.
if its me i will not postpone that issue , i would just get rid of it now then start afresh . Do 1 year that is left in naija then come back for phd. That way her phd can be on her husband dependent visa (although i am not sure what exactly that is, if spouse of a citizen better then her 5 or 3 years starts counting to her own citizenship ) instead of been on F1 visa again . ... because if after phd she then gets a good job that willing to file h1b (let assume she wasn't married and need h1b after opt). The company will still not be able to file h1b until she has fulfilled the 2 years giving back . ..... if she knew she would have just waited one more year in naija before going for d masters in d first place and this issue would never have been there . ...i really don't see d big deal in going back to naija for one more year to resolve this issue once and for all if she cannot get a waiver........ Why postpone it Ehn ehn, DAT reminds me. She was in naija after the FLTA for 6month before she storm back for her masters. I think we can count d six month out too abi? |

Have you ever heard of illegal parents (husband and wife) with 5 citizen children before? Only the children can't be removed but the parents under US law are subjected to deportation if caught. Those kind of children are rwhat Donald J. Trump called "anchor babies" in US. In his wildest dreams, he's trying to stop such "anchor babies" stuffs. Babies can only be used as part of evidence of bona fide marriage, it speeds nothing. They still have to strongly prove that they aren't using the babies for the purpose of circumventing immigration laws.
Having babies actually requires planning. We've been married since 2014 and our plan is 2018 because both of us are still studying. So, don't pressurize your sis to start have babies when her legal status is still staggering. Like I told someone up there, to legally stay in US is frustrating after your purpose of coming is about to finish. Everyone passes/will pass through that stage at some point. I guess den, she knew wat she was doing. She told me yesterday she s applying for her PHd. From wat I gathered on dis forum, a PhD will only postpone ur departure date BT not change d visa status, m I right? |

LagosismyHome: Well everycase is different and what worked for A mightnot for B.... but in my friend case She is doctor who had finished residency in the US so her earning power was good and her husband although a naija but citizen hasnt done much career wise so he was almost earning below poverty line self to file for her ..... that helped with the proof i guess among other things they had to show but really it was their lawyer who provided them guidance ...
Your sister can present that line of reasoning to her lawyer (economic hardship ) and see if he can package her story or advice her K, now I get it. Her lawyer had laid DAT line. Its well. I will feed d house on how it goes . lagosismyhome too |

This is US not Nigeria. Everything follows due process.

LagosismyHome: The lawyer i guess knows its difficult to get a waiver and the rules is that she will be ineligible to apply for change of status to Green card , K status or even H1b ....until after 2 years giving back has been done. ....so i dont think military wife would make a different..... well one year goes quickly sha so she can hang in there marry and just come chill in Naija and then go back..... or she tries another immigration lawyer to get a second opinion I will have to ask her to tell her lawyer abt "proofing that her departure might cause hardship" to d husband and see wat d lawyer's response will be. Or better still let her chk anoda lawyer whom she must have convinced dat her departure might cause hatdship to d husband. Abi wat do u think? Thanks so m enlightened |

Despite she got married to citizen she had to hire an immigration lawyer to prove that her departure from the U.S. would cause her husband exceptional hardship, that was d only way the 2 years was waived

She has to check with an immigration expert Na wa oh, she met an immigration lawyer who advised her to wait for a awhile bfr she file her change in marital status. D husband works as a correction officer in Houston and planning to join d navy soon. Will his service in d military give his wife a better chance. M asking dis qxtn so that one knows wat to pray abt. Talk of popman, he wants her to be home BT I need to support her till she can find her feet |

I recommended dis thread for her before she went for her interview. Straight away, she got her visa and had completed d course. Infact, I helped my mum fill in her visa application in March to visit her and coached her for the interview. All d knowledge I got on this thread, (Thanks to God and big gbosa for dis thread). Now, my sista wanna stay back in d state, well that's no bad idea. She applied for OPT and got a job as an adjunct officer in a community college in Houston. She had married a naija guy who is a resident in d registry in Houston BT she said she is afraid to file it cos the might come up with her exchange agreement which is for her to go back to naija after the program.
