Politics › Why Sunday Igboho Cannot Be Extradited Without Due Process, By Femi Falana by myami(op): 9:50am On Jul 25, 2021

Sometime in 2003, a detachment of the Nigeria Police Force invaded Benin Republic and forcefully arrested Hammoni Tidjani, who was alleged to be behind the several cases of trans border crimes including armed robbery, car snatching and money laundering. He was brought to Nigeria and chargedbefore the Ogun and Lagos States High Court. He was standing trial in the Lagos High Court when he was reported to have died of stroke in a crowded cell at the Kirikiri Maximum Correctional Centre. The brutal treatment meted out to him and the breach of the sovereignty of Benin Republic attracted the condemnation of the human rights community.

In January 2019, 53 refugees and asylum seekers from Cameroon were arrested and detained at the request of President Paul Biya. In spite of the intervention of the United Nations Office of Refugees the Federal Government deported them to Cameroon in utter breach of the law. On the instructions of the refugees and asylum seekers we approached the federal high court for legal redress. As the Federal Government could not justify the brazen violations of the fundamental rights of the plaintiffs the court declared their deportation illegal and ordered the Federal Government to bring them back to Nigeria.

Dissatisfied with the decision the Federal Government has rushed to the Court of Appeal.

A few weeks ago, the leader of the Indigenous People of Biafra (IPOB), Mr. Nnamdi Kanu was allegedly abducted in Nairobi, Kenya and forcefully brought to Nigeria by security forces. Even though Kanu was liable to be arrested and brought back to Nigeria to face trial having jumped bail the refusal of the Federal Government to follow due process in the case has exposed Nigeria to international opprobrium. However, unlike Kenya, the Republic of Benin has rejected the demand to deport Chief Adeyemo (a.k.a. Sunday Igboho) outside the ambit of the law. Hence, the Federal Government has submitted a request for the extradition of Igboho in accordance with the provisions of the Ecowas Convention on Extradition and the Extradition Law of Benin Republic.

On July 1, 2021, the residence of Chief Sunday Adeyemo (a.k.a Igboho) at Ibadan, Oyo State was raided by armed operatives of the State Security Service (SSS). Even though Igboho escaped arrest two of his guards were killed while 13 other people were forcefully arrested in the compound and taken to Abuja where they have since been held incommunicado. Thereafter, Igboho was declared wanted and put on International Criminal Police Organization (INTERPOL) watch-list by the State Security Service (SSS). We have however confirmed that Igboho and his wife were arrested by Interpol in Cotonou, Benin Republic on Monday, July 19, 2021 on their way to Germany.

According to media reports, Igboho and his wife are currently being detained by the police authorities in a criminal police station in Cotonou. If they are indicted for breaching the criminal code of Benin Republic, they are liable to be arraigned before a criminal court in Cotonou. Contrary to speculations in the media, it is submitted that Igboho cannot be expelled from Benin and deported to Nigeria on the basis of his arrest by Interpol without due process as prescribed by Article 12(4) of the African Charter on Human and Peoples Rights which provides that “A non-national legally admitted in a territory of a State Party to the present Charter, may only be expelled from it by virtue of a decision taken in accordance with the law.”

Thus, the Federal Government cannot bring back Igboho to the country without first making a request for his extradition and prosecution in Nigeria pursuant to the provisions of the ECOWAS Convention A/P.1/8/94 on Extradition, which is applicable in the 15 member states of the ECOWAS.

It is pertinent to note that the 1994 ECOWAS Convention has superseded the 1984 Extradition Treaty between Nigeria, Togo, Benin and Ghana pursuant to Article 32 of the ECOWAS Convention on Extradition.

Accordingly, upon the receipt of a request for the extradition of Igboho, the Government of Benin Republic will be under a legal obligation to commence extradition proceedings in one of its domestic courts. It is pertinent to point out that by virtue of Article 28 (2) of the ECOWAS Convention on Extradition, the procedure with regard toextradition and provisional arrest are governed solely by the law of the requested State, i.e. Benin Republic.

Apart from providing for a speedy extradition procedure, the government of Benin Republic shall ensure that Igboho, whose extradition is requested, has the right to be heard by a judicial authority and to be assisted by the lawyer of his own choice.

Nigeria is specifically requested by Article 4 of the ECOWAS Convention on Extradition to convince the Court in Cotonou that the offence in respect of which Igboho is wanted is not political or for the purpose of prosecuting him on account of his ethnic group or political opinion. Various provisions of the African Charter on Human and Peoples’ Rights and the International Covenant on Civil and Political Rights, to which Nigeria is also a party, apply as well. As noted, if the person is lawfully within the territory of the rendering State, extradition requires due process.

Furthermore, an extraordinary (extra-legal)nrendition frustrates the requirements of the African Charter and the Covenant that anyone who is arrested or detained should have a right to challenge the validity of his or her detention. The seizure and rendition of suspects may be characterized as a “forced disappearance” under international human rights law, by which an individual is abducted by persons acting on behalf of or with the acquiescence of the State, followed by a denial (or obfuscation) of information or other forms of accountability by State authorities.

From the information at our disposal, the new Ambassador of Nigeria to Benin Republic, General Yusuf Buratai (retd) has hurriedly submitted an application for the deportation of Igboho to Nigeria.

With respect, the request cannot be granted as it has to comply with Article 18 of the Extradition Convention. It is not sufficient to state that Igboho is wanted for terrorism and murder. The request must be supported by a statement of the offences for which extradition is requested, the time and place of their commission; their legal descriptions; and a reference to the relevant legal provision shall be set out as accurately as possible; and an authenticated copy of the relevant law indicating the sentence which may be or has been imposed for the offence.

To that extent, the Republic of Benin has not received a proper request from the Federal Government for the extradition of Igboho.

Meanwhile, the Government of Benin Republic is detaining Igboho provisionally to await the request of the Federal Government for his extradition. It should be noted that the provisional arrest may be terminated if, within a period of twenty (20) days after the arrest, the requested State has not received a request for extradition from the requesting State in accordance with Article 15 of the ECOWAS Extradition Convention. If there is no strong evidence that Igboho has committed criminal offences the Federal Government should not embarrass the country by requesting for his extradition.

Nollywood starlet, Angela Eguavoen, shot into the limelight after she bagged the role of Ivie in ‘Enakhe’, an Africa Magic original crime drama set in modern-day Benin City. She has also starred in other productions like ‘Inafe’, ‘Still Born’, ‘Dry Tears’, ‘The Clause’, ‘Old New Friend’ among others. In this interview with PREMIUM TIMES, she speaks about her career and industry.

PT:Can you take us through your acting journey?

Angela:I’ve been acting for a while. Altogether, I’ve been acting for about five years. I’ve done a couple of movies. I don’t know if you guys have seen ‘Inafe’. I am one of the lead cast. I’m also part of ‘Blood of Enogie’, which is directed by Charles Uwagbai and I was the main cast there. My character was Osato, ‘the bad Queen’. I had to stop acting at a time because of school and NYSC, so I started fully between 2016 and 2017.

PT:Why acting?

Angela: I’ve always had an interest in acting after watching a couple of people act. I remember when I was watching TV then and my dad would be like, ‘Oh, it’s your mate that is acting there’, ‘You can do it too’. So, that was what ignited my interest in acting and for the fact that I’ve always had the talent in me and I’ll love to develop myself in the craft of acting.

I love acting because it affords me the opportunity to be different people. I get to be a lot of different people at different times. That was what made me love this craft. I really love it.

PT:So what was the experience like when you had to face the camera for the first time?

Angela:It’s nothing new to me because I was already acting in school. I studied English Literature Education, so I already know what it’s about. Going into acting and facing the camera wasn’t really a big deal for me. Fine, I hadn’t honed my acting talent perfectly when I started but I got better with time. I had to improve my craft and this took a lot of personal effort.

PT:Who are some of your role models in the industry?

Angela:The people I watched growing up were Rita Dominic, Omotola Jalade-Ekeinde, Genevieve Nnaji, Mercy Johnson, and some other Nigerian actors.

PT:So, who are the actors you’re dying to work with?

Angela:First on the list is Genevieve. I love Genevieve , I really do love her. Next is Mercy Johnson. I can say Omotola and Rita Dominic will complete my Nigerian list. On the international scene, I have lots of actors that I would love to work and I can’t start mentioning their names.

PT:Is there a role that you probably won’t accept, no matter the amount of money involved?

Angela:There is no role I can’t accept because I just feel that as actors while facing the camera, we can break out and fit into any role given to us. So, I feel that if the role is worth it and the money is worth it too, why not?

PT:Even if it’s a role that involves sex?
Angela: When I get to that bridge, I’ll cross it (laughs)

PT:There’s this notion that Nollywood actresses usually sleep their way to get roles or have a sexual relationship with producers to break even in Nollywood. Is this true?

Angela:As for me, Angela Eguavoen, I’ve never had to sleep with any producer to get my roles. I’ve earned every role that I’ve ever played. There might be some people doing it but I don’t believe it. If you sleep your way through with a director or producer and you’re not a good actor, everyone will know that this one didn’t deserve it or she did ‘runz’ to get to where they are.

So, I have never had to sleep with any producer and I don’t know if that is the common practice. And then, this is what I’ve always held on to, it is not only in this industry that people have to sleep their way through, it is everywhere. Sex-for-role is just loud in our industry because we’re in the entertainment sector and everybody sees you because you’re in the limelight. If others do it, good for them, but I don’t do it.

PT:So, how do you think social media is impacting Nollywood?

Angela:For actors, I feel social media is your active resume. That is why if you check my social media account, you’ll always see me putting up my work in
good pictures. I’m not just all about the glam on my page. I show people that ‘this is what I do’, ‘this is my talent’.

So, show people what you’re capable of doing on your page. Social media has helped me get so many jobs, I cannot deny that. Down to getting roles and getting gigs outside acting, it has been amazing. I am so grateful to the people that created Instagram, Twitter, and every Facebook platform because we’re making money from it.

PT:The government has recently banned Twitter. How is it affecting you as an actress?

Angela:I’m mainly tilted towards Instagram but yeah, Twitter is affecting everyone because there is a show of mine, ‘Inafe’ that is always viewed every day. We have a page, ‘AM Inafe’, where the followers talk about how they feel about the show and the performance. I get the chance to see their thoughts and opinions about my cast and every other character there. Now, I can’t see those. Aside from that, I can’t really say I’m personally affected.

PT:So far, have you experienced any challenging roles so far?

Angela:There have been challenging roles. My role as Queen Osato in Blood of Enogie was very challenging. My role as Ovie in Inafe was challenging too. I got to be different people in different acts, it was 260 episodes, so there is no way I can remain the same person throughout. I went through different experiences in the production, suffering, and all of that. It was really tasking too.

There’s also a film I just finished recently, it’s called ‘Benediction’. It’s not out yet but it will be showing on Rok TV. I had to play the role of a girl suffering from Amnesia.

She doesn’t have the ability to make or form new memories. She had an accident six years ago, so every morning when she wakes up, she thinks she’s the girl she was six years ago and she retains that memory. That was really challenging for me to do.

PT:In five or 10 years to come, where do you see yourself?

sighs) As an actor and producer, I am aiming towards Hollywood and going higher among the A-list actors.

As a producer, I wish to be among one of the biggest producers you can think of and I can also try my hands on directing (chuckles).

Governor of Lagos State, Mr. Babajide Sanwo-Olu, along with his wife, Dr. Ibijoke at about 11.04 cast their votes at Ward E, polling Unit 019, Femi Okunnu/Jakande, Eti-Osa Local Govrnment Area, LCDA, Ikoyi Lagos, amid low turn out of voters.

The duo, who arrived the Ward 09, Polling Unit after at about 11 M due to late arrival of ad-hoc staff of Lagos State Independent Electoral Commission, LASIEC, voted at 11:05am having been accredited by the presiding officer of LASIEC, for the Unit, Mr. Bamigbade Rasak Temitope.

Sanwo-Olu, however, appealed to residents and all registered eligible voters to come out and exercise their voting rights and vote for their choice of candidates.

He also commended LASIEC officials on the peaceful conduct of the exercise so far.

Minister of Interior, Ogbeni Rauf Aregbesola has disclosed that custodial centres across the country were majorly congested by inmates awaiting trial, constituting numerous challenges for correctional services.

This is as he charged state governors to do the needful for inmates on death row to reduce pressure on custodial facilities, making case for those with a terminal illness or old age to be set free on compassionate ground and commute others to either life imprisonment or specific terms.

Aregbesola who spoke at the official commissioning of Osun State Command Headquarters of Correctional Office Complex in Osogbo, said 50,992 inmates are awaiting trials while 17, 755 are actual convicts.

He added that the maximum capacity of the nation’s custodial capacity is 57,278 inmates but presently housed 68,747 inmates, adding that in a bid to decongest the facilities, Federal Government last year introduced a presidential pardon and amnesty programme for inmates, through which 5,000 inmates have so far been released.

The Minister adds, “One main challenge of the correctional service, therefore, is congestion of the custodial facilities. The entire national custodial facilities have a maximum capacity of 57,278 inmates.

But by the last count earlier in the week, there is a total population of 68,747 inmates, made up of 67,422 males and 1,325 females. We have therefore shot above the capacity by 18 per cent.

“But I must add that the congestion is an urban phenomenon limited to big cities like Lagos, Kano, Port Harcourt and others. There are facilities in non-urban areas that are underpopulated. It is in the urban areas that most of the crimes are committed and relevant courts are located, leading to the overstretching of the custodial facilities located in such cities.

“It should also be noted that 50,992 inmates, representing 74 per cent of the total population of inmates in our custodial centres are awaiting trial inmates while only 17,755 inmates which is a mere 26 per cent are actual convicts”.

He added that the President Muhammadu Buhari-led administration is taking serious effort at addressing the infrastructure deficit through the provision of facilities and policy.

“The challenges of safe and effective custody at the custodial centres come therefore from the awaiting trial inmates, given their numerical strength. This fact greatly limits our capacity for corrections, since awaiting trial inmates being suspects, can only be accommodated and not reformed.

Reformation comes after conviction and not before. This is the reality of the management of inmates that must be squarely registered in the minds of the Nigerian public for a better appreciation of the service and its limitations at the rehabilitation, reformation and reintegration of convicts and a reduction in recidivism.

“But the government has been addressing this challenge of congestion. Last year, at the onset of the Covid-19 pandemic, the Federal Government, through the Ministries of Interior and Justice, initiated a presidential pardon and amnesty programme for inmates. Some federal offenders benefited from the programme and got reprieves, while the state governments got recommendations and guidelines for the release of their own convicts. More than 5,000 inmates have so far being released under the programme, which is ongoing.

“The government is building a 3,000 high-capacity custodial centre in each of Karchi, Abuja FCT, Kano, Kano State, and Bori in Rivers State. Each of these high capacity facilities will have courts for the trial of the inmates. The plan is to extend it to the six geo-political zones in the country. The Kano project is nearing completion. When these projects are completed, they will ease congestion considerably and enhance the capacity to manage our facilities for corrections”, he said.

Aregbesola also charged the state government to collaborate with the federal government by taking the bold step to sign off on inmates on death roll, as there were 3008 such inmates across custodial centres in the country, seek quick dispensation of Justice and partner with FG to build holding centres.

In his remark, Osun state Governor, Mr Adegboyega Oyetola called for proper rehabilitation and reintegration of inmates into society to enhance the collective and sustainable development of the country.

Also the Controller General of Corrections, Haliru Nababa disclosed that since the inception of the present administration, the service had been relieved of having to resort to makeshift arrangements for office and holding facilities.

The Minister of Justice and Attorney General of the Federation (AGF), Abubakar Malami SAN, has denied a report linking him with a presidential ticket with the former president Goodluck Ebele Jonathan come 2023.

His media aide, Dr Bashir Gwandu, described the rumour as a pigment of some people imagination who are bent on distracting the minister from his official duties.

Gwandu added that, Malami never discuss such with anybody and he has not shown interest in any political post, he is so preoccupied with his ministerial duties of serving his country the best way he could.

“2023 is still very far to even talk about it, the attorney general has never indicated interest to stand for election with anybody.

“He advised members of the public to be wary of what they say or post on social media or anywhere.

“What the minister needs now is to focus more on how to deliver much-needed services to the country
and that is what he has been doing and will continue”.

He explained that people should not force words into the mouth of the AGF and to henceforth stop peddling such unfounded rumour that has no basis
whatsoever.

Gwandu warned detractors of the minister to stay off.

The Taraba State government has drawn the anger of indigenes of the state over the ongoing sale of forms to applicants who seek to work in the state’s civil service.

The state government a few weeks ago lifted an embargo on employment into the state civil service through an announcement by the Office of the Head
of Service of the state.

Subsequently, the state’s Civil Service Commission (CSC) directed interested indigenes to apply by obtaining an online application form at the cost of N3,500.

The commission also directed workers who want to transfer their services from local government to the state service or across ministries, departments and
agencies to also obtain a transfer of service form by paying N3,000 to the state government’s account with Zenith Bank.

The government had conduced a similar employment exercise in 2017 but less than 10 per cent of the over 30,000 applicants were employed.

Premium Times gathered that mostly applicants with government connection got employed in the 2017 exercise from which the government raked in over
N100 million from the sale of forms.

That experience has fueled a suspicion that the current exercise is another ploy by the government to generate revenue from people desperate for employment.

The suspicion is butressed by the fact that the state government has not been paying gratuities and pensions to retired workers while payment of salaries of civil servants is not regular.

A former chairman of the Nigeria Labour Congress (NLC) in the state, Jonah Kataps, described the sale of application for employment forms as unfair.

Mr Kataps said if the government was sincere about offering employment, it should first consider those who applied but were not picked in 2017.

“What happened to the 2017 data? Was it just a kangaroo exercise?”

Mr Kataps who was also the chairman of the Nigerian Union of Teachers (NUT) and the immediate past chairman of the Local Government Service Commission in the state, said: “If government wants to genuinely give employment to the unemployed, why charge N3,500? Do it for free.

“But that is even not my biggest worry.

Why not regularly pay those on ground and clear the arrears of salaries and pay retired civil servants their benefits first?”

A former chairman of the Nigerian Union of Local Government Employee (NULGE) in the state, Obidah Bitrus, said it is unfair to charge applicants fees for forms in the face of the current economic challenges
in the country.

“I don’t see the rationale and justification behind such an act. Government is supposed to take care of its citizens, not add more to their pains in this period of economic and security challenges whereby people are finding it difficult to survive,” Mr Bitrus said.

Also, the state chairman of the Coalition of Civil Society of Nigeria, Gimba Joseph, expressed suspicion that the government wants to use the exercise to generate revenue.

He said instead of the government levying job seekers, “it should seek legitimate means to generate revenue, like the ongoing property registration exercise it is undertaking”, which he said is capable of generating billions of naira to the state.

“Some years back such an exercise was conducted and only a few persons were employed,” he said.

Mr Joseph said he could not see the justification for a fresh exercise when there are hundreds of graduates serving in various agencies as casual workers.

“We know that some people have been working in different extablishments for five to 10 years as casual workers. If there is an opportunity they should first be considered.

Dr Peter Ayodele Fayose, popularly known as Oshoko, is a Nigerian politician born on November 15, 1960.

Though he grew up in Oyo State and had his education in Oyo State but he is a native of Afao town in Irepodun Local Government Area of Ekiti State and
a two-term Governor of Ekiti State.

His grassroots experience is second to none. On two different occasions, Ayodele Fayose, defeated two incumbent Governors to emerge the Governor of Ekiti
State. In 2003, he unseated Otunba Niyi Adebayo but he didn’t enjoy the Peoples’ mandate because his government was truncated by an illegal impeachment
by the Ekiti State House of Assembly on October 16, 2006.

But after getting justice from the court over his illegal impeachment, he returned to power on June 22, 2014, when he defeated Dr Kayode Fayemi with a wide margin during the State Governorship election.

Ahead of the 2023 Presidential election, the Southern Governors Forum has now declared support for rotation and zoning of the Presidency to the South.

Meanwhile, before this decision, the Presidency of Nigeria has always be rotated between Southern and Northern Nigeria which has been a traditional principle since 1999 to date.

Even where the stakeholders in Nigeria have failed to observe the principle of zoning, the electorates have always zoned it during the election with their votes.

This was evident during the 2015 Presidential election when ex-president Goodluck Jonathan of the PDP lost the election to his main challenger, Muhammadu Buhari, with just over 2.5 million votes.

The existence of traditional zoning principles in Nigeria was further attested to by Dr Jonathan, in his book titled: “My Transition Hours”, when he specifically accused some Peoples Democratic Party (PDP) Governors from the North of sabotaging his reelection bid.

In the book, Dr Jonathan lamented the desperation of some northern Governors in his party to return power to their region, he said that was part of the major reasons he lost the election to Buhari in 2015.

Now that the 2023 election draws near, the decision of the Southern Governors is an indication that the Stakeholders in Southern Nigeria and the electorates in the country, will not tolerate imbalances for the sake of justice, fairness, equity and unity of the country.

Looking towards the South in the PDP, ahead of 2023, I believe that Ayodele Fayose is the best for the party.

Apart from being a southerner, the masses who are his fans and admirers cut across the 36 states of the country. This means he has the spread and chances of winning.

With the problem facing Nigeria today, the country needs to be restructured to transform the roles of the federal, state and local governments to solve the numerous socio-political, economic and security challenges besetting the nation.

Among the PDP voices from the south, Fayose is a known, strong, an unrepentant advocate of restructuring that Nigeria needs today.

Apart from being a voice, he is a fearless man who could be trusted to take the bull by its horn in restructuring Nigeria.

To this fact, we need a grassroots politician loved by the masses who also understands the masses like Fayose to take over from Buhari. We need a President like Fayose who understands the system of government that we inherited in Nigeria.

We need someone who could tackle many of the major problems Buhari cannot tackle.

We need a President who will speak the truth to us in Nigeria and solve our problems. Fayose is resolute.

Nigeria needs a resolute President in 2023. We don’t need a man that will continue with the blame game.

We need a man that already knows we have numerous problems and will be coming on board to solve them.

We need a president who understands that he is coming on board to become the president of all Nigerians and the president of all the political parties we have in the country. Not a president of a particular tribe. We need a president who would respect the rule of law and the independence of other arms of government.

We need a president that will respect the right of Nigerians and not a president that will be using security agencies to abuse our fundamental human rights. We need a President that will solve the economic challenges and address the forex problem in Nigeria.

Ayodele Fayose is the best for the PDP if the party would consider a southerner as her presidential flag bearer in 2023.

Beckham for one should not have started in 06 especially not in a midfield that already had Stevie G and Lamps. If you insist on starting Beckham, then one of Gerrard or Lamps should have come off the bench a la what Scolari did to Rui Costa and Deco in 04 despite the both of them coming off Great club seasons.
