Supreme Court Upholds President’s Power To Declare Emergency Rule, Suspend Elected Officials

Justice Mohammed Idris held that the Constitution empowers the President to deploy extraordinary measures to restore normalcy where emergency rule is declared.

By Emmanuella Ekele
Updated December 15, 2025

The Supreme Court has upheld the power of the President to declare a state of emergency in any state to prevent a breakdown of law and order or degeneration into a state of chaos or anarchy.

In a split decision of six-to-one, the apex court held that the President, during a state of emergency, can suspend elected officials, but that such suspension of elected officials must be within a limited period.

In the lead majority judgment, Justice Mohammed Idris held that Section 305 of the Constitution empowers the President to deploy extraordinary measures to restore normalcy where emergency rule is declared.

Justice Mohammed Idris noted Section 305 was not specific on the nature of the extraordinary measures, thereby granting the President the discretion on how to go about it.

The judgment was on the suit filed by Adamawa State and 10 other Peoples Democratic Party-led states challenging the propriety of the state of emergency declared by President Bola Tinubu in Rivers State, during which elected state officials, including Governor Siminalayi Fubara, were suspended for six months.

Justice Idris, in the earlier part of the judgment, upheld the preliminary objections raised by the two defendants against the competence of the suit.

In upholding the objections raised by the Attorney General of the Federation (AGF) and the National Assembly (the defendants), Justice Idris held that the plaintiffs (the 11 PDP states) failed to establish any cause of action capable of activating the original jurisdiction of the apex court.

He struck out the suit for want of jurisdiction, proceeded to also determine the case on the merits, and dismissed it.

However, Justice Obande Ogbuinya dissented and held that the case succeeded in part.

Among others, Justice Ogbuinya held that although the President could declare a state of emergency, the President could not use such power as a tool to suspend elected state officials, including governors, deputy governors, and members of parliament.

I learnt some officials are telling filling stations to maintain the old price angry

Dangote should build his own filling stations nationwide smiley
MRS is owned by Dangote's cousin (I believe that he's also involved in the refinery) and they will sell at the price that Dangote stipulates.

Responses to the commissioner's post.

Foundational Nupe Lawyer @egi_nupe__

Olodo, are you permitted to take loan at all, let alone for hajj in Islam? Are you telling us the loan is interest free too?

Loan una 🤡

Amoda Ogunlere of Ilorin @Dr_Braein

The thing most of them fail to remember or understand is that your Hajj is void if you can’t provide enough for your family to feed on while you are in Hajj. Taking a loan for Hajj is not allowed in Islam, I understand they might say no interest on the loan but Hajj is not compulsory if you are not capable and it might become a sin if not done properly.

Zamfara Commissioner For Budget And Economic Planning, Abdulmalik Gajam, Defends ₦10 Billilon Kebbi State Loan For Pilgrims.

Pilgrims pay the Federal Government, through the National Hajj Commission (NAHCON) for their pilgrimage.

The government's role (through the National Hajj Commission and the National Christian Pilgrimage Commission) is to receive money from pilgrims and help them organise the pilgrimage. The government helps the pilgrims to negotiate with airlines and get a good deal (discounts, etc), but the airfare is paid by the pilgrims. The government provides consular services to ensure that the registered pilgrims can enter the Holy Lands and that they are safe there, etc. but the cost of the pilgrimage is borne by the pilgrims.

The National Hajj Commission has set a deadline of December 5th for pilgrims to pay for the pilgrimage, but the Kebbi State Government says that some of its citizens will not be able to pay by that date and so it is giving them a loan, that is, it will pay on their behalf and then they can repay the state government later.

StatiSense @StatiSense

In 2024, KEBBI STATE generated ₦16.97 billion in Internal Generated Revenue (IGR).

In 2025, KEBBI STATE provides ₦10 billion intervention to support intending pilgrims ahead of the 2026 Hajj.

If Kebbi State were to fund the 2026 Hajj with its 2024 IGR, that would mean spending approximately 60% of its IGR on Hajj [intervention].

Abdulmalik Gajam @Officialgajam

The level of ignorance and unprofessionalism being displayed by this account is disgraceful. What Kebbi state did was to loan this amount of money to Hajj commission and before April of next year that amount of money will be paid in full. It’s a business venture they invested into which will yield 1- profit 2- community appreciation and ease access to subscribe through installments.

Comrade Deji Adeyanju @adeyanjudeji

My prediction about 2027 is that Peter Obi will work for Bola Tinubu again. He will never agree to work with the coalition against Tinubu. Only people benefitting from the obidient fraud, and fundraising scam are still with him. Even the most stu pid student of politics & history can decipher what Obi is doing. I will rather vote a dog than vote Obi and his political extremist supporters can go to he ll for all I care.

Isn't it somehow “oddly satisfying” that the entire country, including the government, the ruling party, the opposition parties, the media, and the people, is waiting on Peter Obi’s next move?✍️

PETER OBI WILL MAKE CRUCIAL DECISION BY JANUARY.

All things being equal, the candidate of the Labour Party(LP) in the 2023 presidential election, Mr. Peter Obi, will declare his ambition for the 2027 election early next year.

Although he had assured his supporters in June that he will be on the ballot in the 2027 presidential election, a source told this newspaper that Obi will make a formal declaration on the platform to execute the election, in the second week of January.

“We appeal to our people to be patient. There are pressures from the presidency. They don’t want Peter Obi to be on the ballot, but by second week of January, he will make known his ambition,” the source who doesn’t want to be quoted, disclosed.

Obi contested the 2023 presidential election on the then relatively unknown Labour Party, and came third with over six million votes, securing the same number of states with Bola Tinubu, candidate of the All Progressives Congress (APC), who was eventually declared winner of the election, and Alhaji Atiku Abubakar of the Peoples Democratic Party (PDP), who came second.

The Labour Party candidate also won Lagos State and Abuja, the Federal Capital Territory (FCT), regarded as some ‘swing states.’ Before the June conversation with his supporters on social media, there had been concern about Obi’s political future, since the Labour Party has been factionalised after the 2023 general elections.

Obi was also linked with some political leaders, who adopted the African Democratic Congress (ADC) as coalition platform to unseat President Tinubu and the APC in 2027. But since the platform was unveiled in June this year, Obi is yet to formalise his membership of the party.

National Publicity Secretary of the ADC, Mallam Bolaji Abdullahi, had explained that Obi and former Kaduna State Governor, Mallam Nasir el-Rufai, were allowed time to complete electoral engagements in their former parties. The Anambra governorship election, which was believed had delayed Obi’s registration with the ADC, was held on November 8, and almost a month after the election, he is yet to officially join the party.

The source disclosed that this is some of the conversations they would hold when they meet preparatory to the January declaration. “We believe that for ADC to make impact, certain things must be put in place, and we believe that Peter Obi has a role to play in the coalition,” he said.

Obi was quoted two days ago to have demanded, “know the fundamentals that we all agree to respect,” before he could join the party. He was quoted to have said in the report which was denied by his media office: “Yes, I respect all those who are leaders there.

Of course, our Chairman, David Mark, is one of those people I respect, and I believe he has the political sagacity to lead the party. And so are so many others we have there, people like my own leader, Atiku, somebody for whom I have all my respect and believe in the good of Nigeria.

“But in all this, there are still some fine lines that we need to respect, where things must be done properly, where we must sit down and talk about where we’re driving the country to.” His media office said Obi did not grant any interview, and blamed it on “political hirelings intent on distorting facts and distracting opposition.”

Abdullahi told Sunday Telegraph that he has no explanation why Obi has not joined the ADC as he promised, adding, “He told us he was waiting for the Anambra election.
