The case of taraba and Kogi are quite different. PDP in Kogi state did not follow due process(as stipulated by the electoral act) in nominating a candidate. Section 78 (b) (1)(2) . Also, the suppose primary election in the state took place after the statutory stipulated time for primaries had elapsed. The court held that since Mr.Ishaku of PDP was not duly sponsored by the PDP, the party had no candidate in the governorship election in the eyes of the law. Section 87(9) is v. clear that where a party fails to nominate a candidate according to the provisions of the electoral act(conducts her primary in violation) that party's candidate would not be included on the ballot. So, in the eyes of the law, pdp never had a candidate for the gubernatorial election.(they were not qualified to present a candidate in the first place). Since they were not qualified to present a candidate as its flagbearer for the election, that candidate was also not qualified to nominate another person as his deputy since the party was not qualified to take part in the election. So, the idea of his deputy replacing him in the taraba election is totally out of it. (Fault of the party not candidate). In the case of Kogi their candidates were nominated according to the provisions of the electoral act.(They are two different scenarios). My insistence on Faleke is not just because he was Audu's running mate but because before INEC declared the election inconclusive, it was crystal clear a winner had emerged regardless of the result of the supplementary election. INEC was wrong to have declared the elections inconclusive. Even some renowned legal practitioners have faulted Inec for declaring the results inconclusive.
I get ur point, but INEC made no mistake, d law is simple, as long as the No of cancelled votes is more dan d margin the election should be declared inconclusive. I knw it's quite different frm taraba, buh I made mention of taraba just to explain the technicality of the issue. Presenting Faleke is a technical blow out to APC, had it bin d election was concluded no doubt it's Faleke's position

The constitution does not state that a candidate MUST go through the process of primary election before the general election. What the constitution says in section 32 of the electoral act is that political parties are to submit the list of candidates it intends to sponsor at the election. What this means is that there's no room for independent candidacy & any candidate that intends to go for an elective post must belong to a political party. How the party picks its candidate is the sole business of the party. It's just that most political parties have adopted primary elections as the norm in order to avoid conflict or prevent the issue of one candidate not stepping down for another. For example, Apc in Lagos usually pick its candidate for governorship election through consensus. The deputy cannot take part in the primary because its the responsibility of the governorship candidate to pick his running mate. Faleke can represent APC because the constitution recognizes the fact that both deputy and governorship candidate are both elected which makes provision for the deputy to take over in case the governor can no longer continue with his responsibility at any point in time. (section 181)
Faleke is nt d deputy Gov elect, it is am inconclusive election, we can't use common sense to change the law, a party must conduct a primaries before dey cn present a candidate, in a case of consensus, certain conditions must be met e.g oda members willing to contest must step down. It is sure APC has won d election buh had it been INEC declared Audu d winner den no problem going with Faleke, if APC presents Faleke now, it is a technical mistake wich dey are going to regret in d long run, dey stand no chance of winning d case in court, look at taraba, dat is a gud example of what am talking abt

U are wrong, if Faleke represents APC den dey are going to lose at the court on technical grounds, exactly like d taraba election... d constitution states that a candidate must go thru d process of primary election before being presented and Faleke never contested in any primaries. D only way Faleke can rep APC is if anoda primaries is conducted but dat is nt possible, d supplementary election is on Saturday and for u to conduct a primary election a political party must gv INEC 21 days notice wich is not possible in dis case, so the best option is to go for the runner up...Pls dnt insult me and argue construvctively, I actually prefer Faleke to Yahaya buh the law is supreme....

As desirable as it might be even for APC to field Faleke over Bello, doing so will amount to knowingly handing over the governorship to Wada through the courts because Wada will then have a very strong case against Faleke, on the ground that he didn't go through the primaries as stipulated by the Electoral Act.

Fielding Yahaya Bello has effectively killed Wada's faint hope of gaining the governorship through the court, at least.

And should Faleke even win in court against APC's fielding of Bello, it is still APC that gets the governorship, not PDP.

So, politically and legally speaking, APC has gone with the safest option in Yahaya Bello.

SaharaReporters has learned that Abubakar Audu, the governorship candidate of the All Progressives Party (APC) in yesterday's election in Kogi State, died as early as 5 a.m. Nigerian time on Sunday.

 According to family sources, Mr. Audu started vomiting blood on Friday night in what family sources described as a bizarre deterioration in his health condition. One of the family sources described the late controversial politician as hypertensive.

 "He started vomiting blood after he returned from Lokoja," said the family source who witnessed Mr. Audu’s deterioration.

He added that Mr. Audu woke up very tired on Saturday, the day of the governorship election. He said doctors had given the former governor blood transfusion which gave him enough energy to go to the polling booth to vote in his hometown, Ogbonicha.

According to the source, Mr. Audu returned to his home on Saturday and began vomiting again. "After a while he became unconscious and died around 5 a.m. on Sunday morning," said the source, who requested anonymity.

The family's timeline of Mr. Audu's death indicated that he passed on before officials of the Independent National Electoral Commission (INEC) started collation and announcement of results.

A source at INEC told SaharaReporters that electoral officials knew of Mr. Audu’s death before they announced the results of his election inconclusive on Sunday.

Mr. Audu was a former governor of Kogi who was accused of stealing billions of naira from the state's treasury. SaharaReporters had exposed a multi-million dollar home bought by the ex-governor in Potomac, Maryland near Washington, DC.

The APC chose Mr. Audu as its governorship candidate despite the fact that he was being tried for  money laundering and embezzlement of state funds by the Economic and Financial Crimes Commission  (EFCC).

Mr. Audu will be buried tomorrow according to islamic rites in his hometown

The source of death of Abubakar Audu, candidate of the All Progressives Congress (APC) in the November 21 governorship election of Kogi state, has been revealed.

According to TheCable, a source confirmed that Audu died after suffering stroke on two different occasions on Sunday.

Reports said he complained of stomach cramp before going to bed Saturday night, suffered a stroke around 9am on Sunday.

The source added that he suffered the second stroke after INEC declared the election inconclusive.

INEC has declared Kogi governorship election inconclusive because the total number of cancelled votes were more than the margin between the two leading candidates Prince Abubakar Audu, candidate of the APC and incumbent Governor, Idris Wada (PDP).

Results from the 21 local governments in the state show that Mr. Audu garnered 240, 867 votes as against the 199, 514 votes scored by Wada.

49953 elections cancelled in about 19 local governments

Margin of win not in excess of the cancelled results... the margin between APC and PDP is about 41000 which is not up to the cancelled elections..

As INEC prepares to begin collation of results from all the Local Government Areas in Kogi State for Saturday’s governorship elections, figures gathered from the various polling units put APC candidate Prince Abubakar Audu in early lead while the PDP candidate and incumbent Governor Idris Wada is closely trailing behind.

There are a total of 21 candidates contesting in the election.


Governor Idris gained massive votes in the Central Senatorial District but, Prince Audu, based on early results, was leading in the Eastern and Western Senatorial Districts.

Prince Abubakar Audu expressed satisfaction with the conduct of the polls, describing it as most organized and peaceful but Governor Idris Wada, whose fingerprints were rejected by the card reader during accreditation at his ward in Dekina local government area, expressed dissatisfaction with the conduct of the polls.

Governor Wada was particularly disappointment over the failure of the card readers as well as non-availability of incident forms for other voters whose fingerprints were also rejected by the card reader at the polling unit.

“It seems it was a deliberate attempt to sabotage the process; there are few incident forms here and there are no photocopiers to produce more. As you can see there are so many people here that are going to be disenfranchised which is not fair,” Wada lamented.

According to him he had received reports of thuggery and ballot box snatching in Ayingba despite the massive deployment of security personnel for the election.

This reasoning is so absurd. You seem to operate from the premise that Iwealla messed up the economy, therefore we should try less qualified people. But if the economy is in dire straits, why entrust it to the unqualified? If you take your reasoning to its logical qualification, we might as well appoint a secondary school leaver because the university educated have not performed to expectation.

What makes me laugh about this is that Kemi Adeosun was finance commissioner for Ogun state and at the end of her tenure, Ogun state required a bailout with the assistance of the Federal Government as it was effectively insolvent. So these people have faith in her ability to do at the Federal level what she could not do at the state level. It's a classic case of the triumph of hope over experience.
U started the arguement well but I got it rong at d end.. kemi is qualified if u look at her qualifications den ogun needing a bailout is nt a point, the economy was affected from the Center (FG) wen d price of oil fell
Kemi should be given a chance, it's too early to conclude dat shez a failure, she may end up doing better than NOI or not
