Crime / INEC Says Court Lacks Jurisdiction To Hear Okorocha’s Suit, Asks For Dismissal by Nwanyiocha247(f): 5:02am On May 18, 2019
INEC says court lacks jurisdiction to hear Okorocha’s suit, asks for dismissal

The Independent National Electoral Commission (INEC) on Friday urged the Federal High Court, Abuja to dismiss the suit filed by Imo Governor Rochas Okorocha challenging the commission’s refusal to issue him a certificate of return.

Okorocha is seeking an order compelling the commission to issue him a certificate of return as the senator-elect for Imo West Senatorial District.

INEC’s counsel, Wendy Kuku, at the resumed hearing urged the court to dismiss the suit for being incompetent.

She also stated that the court lacked the jurisdiction over the issue. She argued that being a post-election matter, it was only the National Assembly Election Petitions Tribunal that had jurisdiction to hear it.

The counsel therefore prayed the court to dismiss and or strike out the suit for lacking in merit and want of jurisdiction.

On his part, Mr N.A. Nnawuchi (SAN), Counsel to the 2nd defendant, (Jones Onyeriri), challenged the mode of the commencement of the suit.

Nnawuchi claimed that commencing the suit by an originating summons, when the facts were in dispute rendered the suit incompetent.

He asked the court to dismiss the suit or in the alternative, order pleadings where oral evidence could be called.

Meanwhile, Okorocha’s Counsel, Kehinde Ogunwumiju (SAN), had in his submission, urged the court to grant the reliefs sought by his client.

Ogunwumiju argued that the issue of duress was the only defence raised by the defendants before the court and that INEC did not say anything about duress.

According to him, the 2nd to 8th defendants do not have any relationship with INEC or the returning officer to raise the issue of duress.

He submitted that the word duress was a state of mind of a person and that only a person upon whom duress was exerted could feel it.

“In this case, the returning officer alleged to have been put under duress is an agent of INEC and he has given no evidence whatsoever.

“INEC his principal has not raised any issue about duress. There is a conflict of evidence between the plaintiff and 2nd to 8th defendants.

“The law is that the court will rely on documentary evidence to resolve the issue.”

The lawyer said that the only documentary evidence before the court was the certified true copy of the police report on the collation of election result.

Ogunwumiju noted that the court would find that there was no issue of violence, threat or duress, urging the court to grant the reliefs sought by his client.

The trial Judge, Justice Okon Abang, adjourned the matter until May 20 for continuation of hearing.

Imo deputy speaker resigns a day after lawmakers suspended speaker

Chidiebube Okeoma, Owerri

The ongoing political drama and power tussle at the Imo state House of Assembly on Thursday took a new twist , as the deputy speaker , Ugonna Ozurigbo tendered his resignation letter .

The deputy speaker’s resignation came less than 24 hours after 21 out of the 27 state lawmakers served impeachment notices on the speaker, Acho Ihim and the majority leader , Lugard Osuji, after suspending them .

The lawmakers who elected Chinedu Offor ( Onuimo) the acting speaker and Lloyd Chukwuemeka ( Owerri North ) the new majority leader , said that the suspended two principal officers had engaged in unparliamentary conduct by escaping with the mace during the Wednesday ’s plenary .

The resignation letter which was sighted by our correspondent in Owerri on Thursday morning was dated May 15 but was received by the office of the Clark of the state House of Assembly on May 16 .

The letter of resignation which Ozurigbo personally signed was addressed to the speaker and members of the state House of Assembly.

“This new task has come with its own challenges and expectations , especially need to play key roles in the formation of the National Assembly leadership , and time to strategically position , to pursue the greater interests of Imo state , South East and Nigeria , at the federal legislature . Currently , these will make my availability in Imo state irregular .”

Politics / Okorocha Asks Court To Abort Plot To Arrest Him, Fingers APC Leaders by Nwanyiocha247(f): 7:36am On May 16, 2019
ABUJA – Governor Rochas Okorocha of Imo State has approached the Federal High Court in Abuja, seeking an order to restrain security agencies in the country from arresting him.

Okorocha told the court that some chieftains of the All Progressives Congress, APC, led by its Chairman, Adams Oshiomhole, are instigating the Economic and Financial Crimes Commission, EFCC, to move against him.

Consequently, he prayed the court to enforce his fundamental human rights which he said was under threat.

Cited as respondents in the suit are the Attorney General of the Federation, the Inspector General of Police, the Department of State Service, the EFCC, the Independent Corrupt Practices and other related offences Commission, and the Code of Conduct Tribunal.

Okorocha told the court that his travail started after he opposed the emergence of some persons as leaders of the ruling APC.

He said his adversaries in the party had since instigated the EFCC to hound him and his family members, saying they were equally behind the reason the Independent National Electoral Commission, INEC, refused to issue him with a certificate of return after being declared the winner of the last election in lmo West Senatorial District.

The two fundamental right suits he filed before the court were marked as FHC/ABJ/CS/474/19 and FHC/ABJ/CS/475/19.

Okorocha told the court that he has, “found himself in a politically adversarial position to some powerful members of the APC over the choice of the national officers of the party before and since the convention of the party was conducted to elect new national officers of the APC”.

He said: “The applicant had supported a candidate for the position of National Chairman of the APC other than the current incumbent, Mr. Adams Oshiomhole and by reason of various events that occurred at the time including the detention of Mr. Adams Oshiomhole by the EFCC on allegations of corruption it was assumed that the applicant was a party to that incident.

“Some of the supporters of Adams Oshiomhole at the time are currently very influential in the Federal Government of Nigeria, which is controlled by the APC.

“These individuals including the said current National Chairman have decided to carry out a vendetta and revenge against the applicant including instigating the Respondents against the applicant upon their spurious conclusion without evidence that the applicant is guilty of corrupt practices as Governor of Imo State.

“The respondents, proceeding from this position that the applicant is guilty unless proved innocent, between 2017 and now, have extended not less than 25 invitations to the applicant In purported investigation of projects executed by the into state government In a bid to find some material to justify their conclusion that he is guilty of corrupt practices.

“This witch hunt, is clearly politically motivated, baseless, and has been designed only to discredit and humiliate the applicant in a bid to decimate him politically.

“Sometime in May 2017 the 4th respondent, acting in furtherance of the plan of the applicant’s political enemies, invaded the applicant’s house in Jos, Plateau State and while holding his staff and family members hostage ransacked the entire house in the hope to find something incriminating against the applicant.

“The matter became a subject of litigation in the Jos division of this honourable court over the validity of the search warrant the 4th respondent relied on for that invasion and although the court found that the search warrant was valid, it also confirmed at page 22 of the judgment, based on the admission of the 4th respondent, that nothing incriminating was found against the applicant.

“Rather than give up their pursuit of the applicant, the respondents acting on the instigation of the applicant’s enemies, have continued the vendetta against the applicant.

“Upon the conclusion of the senatorial election held on the February 23rd 2019 into the national assembly, the applicant was duly elected as senator to represent Imo West Senatorial District by the majority of lawful votes cast in the election.

“The applicant’s political adversaries within the APC were embittered by the applicant’s victory at the polls and have sworn to ensure that the applicant is either not sworn in as a senator of the Federal Republic of Nigeria or is removed for not fulfilling the constitutional minimum attendance requirements.

“In this regard, they instigated the Independent National Electoral Commission (INEC) to withhold the applicant’s certificate of return on the unfounded allegation that the Returning Officer was coerced to declare the applicant the winner of the election.

“Not satisfied with the withholding of the applicant’s certificate of return, those powerful forces with the APC have commenced fresh spate of attacks against the applicant on the baseless allegation that he embezzled the funds belonging to Imo state government in order to ensure that the applicant is politically decimated.

“The plan has now reached a crescendo and desperation in view of the failure of the respondents to find anything incriminating against the applicant and the decision now taken is to arrest and detain the applicant as soon as he hands over power to the newly elected governor of Imo state on the 29tln of May 2019 and using the provisions of the Administration of Criminal Justice Act, detain him indefinitely in order that cause may be found to have him removed from his seat as a Senator of the Federal Republic of Nigeria to which he was recently elected.

“The plan has also been expanded to include a reign of terror against the applicant’s political, business associates and family members including his wife and chitdren Uioma Rochas, Uju Rochas, Uchechi Rochas, Ahamefula Rochas, Amen Rochas, Amamchi Rochas, Uzoma Anwukah and Uche Nwosu.

“The applicant has not committed any offence to warrant the incessant threats of arrest, detention, the harassment and terror being unleashed upon him and his family.

“It is therefore important that this honourable court as the “Fundamental Rights Court” intervene to ensure that this abuse of power and misfeasance in public office by the respondents against the applicant is abated and the fundamental rights of the applicant to be presumed innocent until proved guilty, to liberty and freedom of movement are enforced.

“Unless this honourable court intervenes to enforce and/or secure the enforcement of the applicant’s fundamental rights to be presumed innocent until proven guilty and to freedom of movement and liberty by making the orders sought in this application, the 1st to 6th respondents will be used by the applicant’s political adversaries for the purpose of their infringement as stated above.

“The applicant apprehends from the above that his fundamental rights and those of his staff, associates and family members are about to be infringed by the respondents in Abuja as soon as he commences his next assignment as Senator of the Federal Republic of Nigeria.

“This honorable court has the power to grant the reliefs sought in this application to enforce the applicant’s fundamental rights.”

Crime / EFCC Nabs 37 Suspected Yahoo Boys In IMO State by Nwanyiocha247(f): 11:09am On May 03, 2019
EFCC Nabs 37 Suspected Yahoo Boys in IMO state..

The South-east Zonal Office of the Economic and Financial Crimes Commission, EFCC, on Wednesday, May 1, 2019 arrested 37 suspected internet fraudsters in Owerri, the Imo State capital.

The arrest followed a raid on some targetedresidences in Okwu Urata, Aladinma and Egbu areas. The Commission’s actionfollowed intelligence report which pointed that the suspects were living lavish lifestyles without any known means of livelihood, alleging further that they specialize in defrauding unsuspecting victims, through the internet.

In the course of executing the search warrants, items which included laptop computers, 25 five exotic cars, which includeseveral brands of Mercedez-Benz, Lexus,Toyota and expensive mobile phones, were recovered.

Speaking on the development, the ZonalHead, Usman Imam, who said the exercise was in line with the Commission’s mandate decried the high rate of cybercrime in the zone which he blamed on the erosion and breakdown of country’s values.

“It is true that no society has been able to totally eradicate crime, but we are ready at least to reduce it to the barest minimum and it appears that this cybercrime is one of the challenges of our time, which the EFCC is willing to face drastically,” Imam said.

Questioning the lifestyle of the suspects, Iman said; “What is the business of a university student, a new graduate or youth corper looking for money to buy a car of N10 million? Obviously, this is rushing life and a collapse of our positive value system where people rarely want to start from a humble beginning,” Imamadded.

Usman lamented that if nothing was done, the country’s leadership could be jeopardized as many youths involved in cybercrimes are expected to take up leadership positions in the future.

The suspects who volunteered their statements under caution will be charged to court as soon investigations into the matter are concluded.

Politics / Okorocha’s Bid To Secure Order Against Inec Suffers Setback by Nwanyiocha247(f): 8:13am On Apr 07, 2019
OKOROCHA’S BID TO SECURE ORDER AGAINST INEC SUFFERS SETBACK

….as six parties ask court to dismiss suit

Moves by Governor Rochas Okorocha to secure an interim injunction to compel the Independent National Electoral Commission, INEC, to issue him a Certificate of Return as the Senator- elect for Imo West Senatorial District, suffered setback on Friday.

Okorocha had in a suit marked FHC/ABJ/CS/296/2019, which he filed before the Federal High Court in Abuja, maintained that INEC lacked the statutory powers to withhold his Certificate of Return, saying he was validly elected to occupy the senatorial seat.

He urged the court to declare that the electoral body acted in error when it refused to recognise him, even after the returning officer had declared him winner.

At the resumed proceeding on the matter on Friday, Okorocha, through his team of lawyers led by Mr. Kehinde Ogunwumiju, SAN, prayed the court to order INEC to in the interim, issue him Certificate of Return pending the determination of the suit.

However, though INEC was cited as the sole defendant in the suit, however, four candidates that participated in the senatorial poll, approached the court to be joined as interested parties.

The applicants, through their respective lawyers, said they were vehemently opposed to the issuance of Certificate of Return to Okorocha.

Those that secured leave of the court to file processes to counter Okorocha’s suit were Mr. Nwachukwu Clement of KOWA party, Precious Nwadike of United Progressive Party, UPP, Dr. Uche Ibeh of Labour Party, and the All Progressives Grand Alliance, APGA.

The court had earlier joined Hon. Jones Onyeriri of the Peoples Democratic Party, PDP, and Senator Osita Izunaso of APGA as interested parties in the case.

All the parties that were added as 2nd to 7th Defendants in the matter, notified the court that they would filed preliminary objections to challenge the competence of Okorocha’s suit.

Likewise, INEC, through its lawyer, Mrs. Wendy Kuku, also queried the jurisdiction of the court to entertain the suit which it argued raised post-election issues.

Meanwhile, Justice Taiwo .O. Taiwo has adjourned the case till next Tuesday, even as he directed all the parties to file and exchange their processes before the date.

The court held that it would no longer admit any interested party that failed to approach the court before the adjourned date.

It will be recalled that INEC had declined to issue Certificate of Return to Okorocha who was the senatorial candidate of the All Progressives Congress, APC, after the returning returning officer alleged that he was forced to declare him winner under duress.

The Returning Officer for the election, Prof Francis Ibeawuchi, declared Okorocha as the winner of the poll, having polled 97,762 votes ahead of his closest rival, Mr Jones Onyereri of the Peoples Democratic Party, who had 68,117 votes.

Ibeawuchi claimed that he announced Okorocha as the winner to save his life and that of his household, insisting however that the election ought to have been declared inconclusive.

See What The First Made-In-Africa Smartphone Looks Like (Photo)

African high-tech player, Mara, has announced the production of their newest product the Maraphone – the first made-in-Africa.

The full-scale smartphone will soon be manufactured in plants across Africa.

“China has Huawei, Xiaomi; the U.S has iPhone and finally Africa has Maraphone,” Ashish Thakkar, founder of Mara Group told a press conference on the final day of the Africa Investment Forum on Friday.

“This project will show the potential and ability that Africa can produce high quality and affordable smartphones in Africa, by Africans, for Africans and for the rest of the world.

“We are extremely grateful for the African Development Banks push in this sector which greatly encouraged our progress,” Thakkar said.

The Maraphone phone, a first-of-its-kind in the history of Africa, will produce high quality and affordable smartphones to primarily serve the population of Africa and also with the aim to export to other continents such as Europe.

“This is going to be totally transformative and create thousands of direct jobs,” Thakkar said.

While global manufacture of phones is on the rise and expected to hit a billion in the next few years, none of them are produced on the continent, Thakkar said.

The initial target market for the phones would be first-time African smart phone users, while the first manufacturing plants are to be located in Rwanda and South Africa.

Thakkar commended the African Development Bank for its push to support industrialization of Africa through its High 5’s strategy under which the Maraphone had received support.

Attending the ceremony, Bank President Akinwunmi Adesina said: “By 2020, the value of Africa’s mobile money industry is projected to top $14 billion. We need African-developed mobile phones to leverage this potential.”

“Africa is bold, strong and innovative. Africa’s time is now,” Adesina said.

Mara Corporation is an African Group headquartered in Kigali, Rwanda, started from a small IT business in East Africa to the globally recognized multi-sector investment group that exists today.

Through its investments, Mara Corporation now employs over 14,000 people across 26 African countries in sectors spanning technology, financial services and energy. Mara’s key focus is to do good & do well at the same time.

4. Choose joy

“Rejoice always, pray without ceasing, give thanks in all circumstances; for this is the will of God in Christ Jesus for you.” - 1 Thessalonians 5:16–18

7. Choose happiness no matter what

“In the day of prosperity be joyful, and in the day of adversity consider: God has made the one as well as the other, so that mortals may not find out anything that will come after them.” - Ecclesiastes 7:14.

Sports / How Ahmed Musa Proved Buhari To Be A Liar - By Reno Omokri by Nwanyiocha247(f): 4:06pm On Jun 24, 2018
Read the write up from Reno Omokri below...
On April 18, 2018 at the Commonwealth Heads of Government Meeting in London, Nigeria’s President listened as other commonwealth leaders chose to promote their countries and people and when it got to his turn, President Muhammadu Buhari chose to describe Nigeria’s youth as a lazy and uneducated.

President Buhari said:

“We have a very young population, our population is estimated to be 196 million in 2018. This is a very conservative one. More than 60 percent of the population is below 30, a lot of them haven’t been to school and they are claiming that Nigeria is an oil producing country, therefore, they should sit and do nothing, and get housing, healthcare, education free”.

This would not be the first, second or even third time Muhammadu Buhari has disparaged Nigerians to the international community. On February 5, 2016, he told the Telegraph of the UK that the reputation Nigerians have for crime has made them unwelcome in the West.

In the case of the Lazy Nigerian youth statement, what was worse is that when given the opportunity to dial back from that statement, the Presidency released a statement the next day (April 19, 2018) explaining that what the President meant is that most, but not all, Nigerian youths were lazy.

Even if I tried to make it up, my fiction could not match the unprecedented cluelessness of President Buhari and his media team.

How can a President who cannot name one project that he initiated, started and completed in the last three call Nigeria’s youth who have accomplished many great things in the same period, lazy?

Since the President’s favourite pastime is to blame his ineptitude on his predecessors rather than take responsibility and lead from the front as he promised, I would like to single out one of such youths as a role model to President Buhari.

During the Nigeria versus Iceland World Cup game that took place on Friday April 22, 2018, Ahmed Musa brought more joy to Nigerians in 90 minutes than Buhari has brought to Nigeria in three years. He did not engage in Buhari’s pastime of blame game. Neither did he make excuses to justify failure. This young Nigerian youth just scored. And to prove it was not a fluke, he scored again.

I personally believe that Ahmed Musa would do a better job of governing Nigeria than the inept tyrant who called Nigerian youths like Ahmed Musa ‘lazy and uneducated’! (Almost anyone would do a better job of ruling than a man who still thinks that there is a country called West Germany).

And if all Ahmed Musa did was to prove to Buhari that Nigeria’s youth are not lazy, he would have done enough. But that was not all he proved. Not by a long shot!

President Buhari is notorious for being against any attempt to restructure Nigeria and prefers the status quo which has set Nigeria backwards and to borrow the words of Chukwuma Kaduna Nzeogwu, made “the country look big for nothing before international circles”.

Ahmed Musa has proven President Buhari’s fears to be unfounded by establishing once and for all that talents abound in all parts of Nigeria and that no part of Nigeria will lose out if we restructure and replace ethnicity with merit. If not for this Northerner names Ahmed Musa, Nigeria would have had little hope in this #RussiaWorldCup2018. All Nigerians matter.

If there is anything President Buhari can learn from Ahmed Musa’s feat, it is that Nigerians want a leader that can deliver results, like Ahmed Musa, not one that delivers activity, like Muhammadu Buhari.

Nigerians need a leader with vision, one who gives hardworking youths opportunities instead of rewarding degenerate terrorists openings that should go to youths who can really contribute to Nigeria’s growth.

?Let me at this point go on record as saying that I am shocked at the alleged plans by the Buhari administration to recruit ‘repentant’ Boko Haram members into the police. Thank God the Christian Association of Nigeria has rejected the evil plan. How can terrorists police us?

Next, Buhari will recruit herdsmen in the army if he has not already done so! Must this government show its open bias in favour of one religion over the other? What is this madness? Will Donald Trump or Theresa May ask their respective police forces to recruit former jihadists or alqaeda members? All Nigerians must reject this devilish plan! ?

And while our youths like Ahmed Musa continue to advance the frontiers of Nigeria’s greatness, Buhari and his team persist in diminishing Nigeria by their unprecedented hypocrisy.

For instance, on Thursday June 21, 2018, Buhari while delivering the keynote address at the opening of the International Press Institute (IPI) World Congress at the Conference Centre of the Presidential Villa, asked journalists to halt fake news.

Really? Is this not the same Buhari who lied that there was no fuel subsidy and that Jonathan was deceiving Nigerians only for him to get into power and start paying double the subsidy Jonathan paid even after increasing fuel price?

At the same event, Buhari also appealed to journalists not to carry hate speech, yet his own spokeswoman calls the Christian Association of Nigeria a ‘CAN of worms’. How hypocritical can the President be? Aso Rock under Buhari has become the headquarters of hate speech and fake news in Nigeria.

The truth is that Buhari has proved to Nigeria’s youth that he should be in Daura spending his pension rather than being at Aso Rock directing their futures.

Before I end this piece though, permit me to say something about a Nigerian youth that is my inspiration and hero.

?Four months ago, Leah Sheribu was abducted by Boko Haram, who continue to hold her captive because she refused to abandon her faith in Jesus. I wish feminists, like Chimamanda Ngozi Adichie, could use their celebrity to focus the world’s attention on Leah. Leah may not be Hillary or chivalry, but she is worthy of heraldry.

President Muhammadu Buhari appears to have forgotten all about Leah. He did not mention her in his Democracy Day speech that was riddled with lies. And when the Christian Association of Nigeria reminds the President of his duty to rescue Leah and prevent the killings of Nigerians by his herdsmen kinsmen, his spokeswoman Insulted them by calling CAN a CAN of worms. If you have read this, please can you stop what you are doing and just say a prayer for the safe return of Leah? ?

Technicians who arrived to fix a malfunctioning cash machine in the Indian state of Assam got a shock when they opened it up and found out that the cash in the ATM had been eaten up by rats.

Notes worth more than 1.2m rupees (about N63.6 million) had been shredded. Police said the rats probably entered the machine through a hole for wiring, the Hindustan Times reported.

Pictures of the chewed cash at the State Bank of India branch in Tinsukia district were widely shared on Twitter. One shows a dead rodent lying in the debris.

This has however sparked series of  reactions on the social media platform as a lot of people are of the belief that there is more to the story and how possible will a bank leave an dysfunctional ATM for more than a week without checking on it.

Police official Prakash Sonowal said that the machine had been out of action for about 12 days, the Hindustan Times added.

According to the report we got from the officials of the bank, the ATM had been faulty for close to two weeks before they sent technicians to work on it only to find rats in the machine eating up all the money in the ATM he said.

Technicians who took the unit apart found banknotes of 2,000 and 500 rupee denominations destroyed. They managed to salvage another 1.7m rupees, officials said.
