I stayed March 28 to July 16. Had baby in June 13

I would have left early cos i got my baby documentation at Dallas fast enough but paediatrician advised to stay for one last baby appointment. Cant remember if it was hearing test.

If they ask you, tell them you already scheduled a visit for a family function so u decided to do it at same time.

Your husband can still be your sponsor just take his statement... I was living outside nigeria but I always flew back to nigeria to apply for visas without my husband and he was always my sponsor. Secondly when asked why I came back to apply, I always tell them I am home for vacation and decided to do it.

What exactly did u tell them at point of entry? Giving details will help others help.

Coming back to try from nigeria may or may not work but it might be worth the risk, if u really want to travel.

I quite agree with you. I believe the 30k issue has to do with insurance and she has no idea of self pay discount. It is also true that Tanzanians dont travel much. Not sure they know about US childbirth. So, VO may just have been unnecessarily tough.

Another thing is coming to Nigeria to apply. How do I do about my sponsor because am not working now?

Consider reapplying in Nigeria. The VOs here are more used to the medical/childbirth tourism unlike their Tanzanian counterparts. That 30k new rule thing is absolutely false IMO.

Sorry about your refusal, personally I don't think you should click yes to that particular question when next you are applying,like someone else mentioned,I think you are being too hard on yourself. You can explain to the visa officer that you didn't state your true intentions when you went to birth your 1st child.
I also think you stand a better chance applying from naija. That amount you mentioned that you guys have is more than enough to birth a child if you are applying from naigeria. From which country did you apply from?

Yes. I feel relieved that I did that restitution but also bad that I may have to explain to my baby why I ddidnt get her a blue kpali like her sis

I think that was were the visa officer had a problem with.

Either way, you shouldn't have to beat yourself up for telling the truth to the VO even if you didn't get the visa this time around. It is still better than the visa officer finding out and then result to giving you a permanent ban for lying.

I assume your B1/B2 visa was legally obtained (unless you submitted any false docs)....and you got pregnant 1 year after......what exactly did you tell the CBP that made you click yes to this question? I think you may have been too strict on yourself. See this link...its a very serious question to answer yes to.

VO didn't seem to focus on this though and was looking more at the financial....but I think you should look at this question again when you reapply.

And a family friend who lives in Uk was blaming it on my clicking that I fraudulently entered through false purpose of visit. Thinks I should not have clicked that as it would be pointed in their system. And because the US is strict now on immigration. I wa sonly trying to be honest this time which I told the VO. She said she appreciates but even if she considers me, the cpbs would send me back

If I go back to lagos, how would they see my husband as my spinsor living in another country?

And wont they see my change of interview location as a sign of desperation?

See if your situation is tacky already, I will advise you to fly back home to nigeria if you desperately need it and apply for a medical visa. In nigeria, visa officers know how valuable and important the truth is coming from a nigerian, while the vo outside nigeria observes all the strict protocols and the truth isn't the subject. I am telling you this based on a previous visa experience I had. You have better chances in Lagos Nigeria. My opinion.

@Mamaron, I actually overstayed by 2 weeks when I calculated from my passport. And yes, I mentioned in the ds 160 that i stayed 14 weeks instead of 3 months the cbp stamped me besides not disclosing my intent.

2. She just flipped through hospital bill zero balance and kept saying 150$ here 300$ here and didn give me the chance to say much. I didnt pay by payment plan. I paid 18k immediately i got back to Nigeria. I told her I paid all my last bill

Maybe I was not assertive enough. Probably the consciousness of that cbp issue. But she didnt say anything about overstay. I suspect the cbp noted something because when my husband came back to pick me after delivery, the cbp asked him why back so soon and he said to pick his wife who just delivered. He said tell her to pay all her bills or she wont be allowed to come back. He also said he would note something on his I-90 form on return. We thought he was doing us a favour



Hi ma'am....i just looked through your previous posts from thread 5 in Aug 2017 (investigation) tongue and noticed 2 things you didn't mention here.

1) you overstayed your last trip...CBP stamped 3 months but you stayed for 4 months for medical reasons....i'm not sure if that was a factor in the denial as VO did not talk about it...but did you get an extension while in the U.S.? Did you mention this overstating in your DS160?

2) your hospital bill in 2012 was high....over $20k...you paid $2.5k and the rest was on payment plan (if I understand correctly) .......not sure if this why VO is saying you cannot afford the trip......you seem to have over $40k from your husband and your savings...maybe reapply and stress that even if your bills exceed your budget you are committed to paying like you did for baby # 1.

There is no $30k rule for medical visa approval as far as I'm aware. Maybe this is specific to your location or VO is just throwing a number out there just based on their own personal experience.....not sure how to surmount that, except to say that $30k may be true for people with insurance for self pay patients paying cash fees are lower and also cost depends on the state one is visiting.

Regarding citizenship, if I were you, I would mention it as one of my reasons for going to the U.S. since that is the truth...you said only medical reasons....so VO referred you to go to South Africa instead which seems to be close to your location.[/quote]

The VO did you a favor by pointing you in the right direction. What does law clerk have to do with business?

From your Statement, you already know what to do...do the PGD where you are and apply for masters. It might be a good idea to address in your SOP why you're going back to school at your age.

Hello everyone, I got my gcms notes yeaterday and it goes like this "40 year old married mother seeking SP attend a Law Clerk Program at Humber College. Financing from family business- funds seen and appear ok. PPT shows good travel history Personal finance appears modest PA is on a resident permit in ........ Application shows gap in work history and in education. Study plan suggests she is pursuing program to help with the business which they want to grow but the program is a Law Clerk one and not a business administration one Not satisfied with purpose and intent. I was denied canadian study visa twice this year and it was really disheartening. I got admission fro. Humber College to do a Diploma in Law Clerk. I actually wanted to do a PGD in Global Business Admin but they said i did not meet the requirements (I have an HND/Lower Credit in Secretarial Studies from the Polytechnic) I worked for a year after my Youth Service in 2002 and resigned in 2004 after marriage. My husband talked me into doint business. Finally, I ended up being a full time housewife in 2014 and since then, I have been feeling less relevant and wished I continued in the secular field. Now, I dont know how to go about fitting into the Nigerian working system, not that my cv is so enticing. I decided to tow the studying abroad lane to brush up myself.

I paid full tuition fees and submitted all documents including my husband's registered company where I am a director, copy of C of O, Sponsor Letter from Company, company statement of Account and joint personal accounts of my husband and I to show proof of funds. I filled that i have about 25k canadian dollars for my travel while the company wrote that they will sponsor me in subsewuent semesters .

First denial was for; insufficient financial resources to support my self and whoever accompanies me while sudying in canada and 2) Personal assets and financial status

I defered my admission and applied again. This time I had my own personal account with more than 23k dollars apart from school fees (company still undertaking to pay pocket money per semester), company account with 80k, I added my vehicle particulars and removed c of o. This time the only thing they ticked is Purpose of Visit

I dont know if it's theStatement of Purpose. I added it in my second application as adviced by a staff in VFS office but am not so sure it looks convincing as that was my first time of hearing about such document. Humber College refused to defer. They say I have to apply afresh through ontario colleges. I still have my eye on that canada thing (I hate the thought of failure). I called one travel consultand afterwards and he said i should give up. He said my age (40), my level of study chosen, my financial status all contributed. He said I should not bother reapplying.

Please dear all, do you think it is true? I should have applied for masters? Should I give up the dream as advised? Is there anything I should do to change my situation? Why did they write that i am free to rrapply if I can respond to these concerns and demonstrate that my situation meets the requirement? Please help a worried sister

In Spirit of giving back, I had my interview today, Although I was denied but I was happy that I said the truth at the interview.
Had my first visa in 2015 Sept for visiting but gave birth in Dec,never knew I could declare child birth,I remember I saw a heavy pregnant woman that and I and hubby was saying she's bold.
Anyway, I paid all my fees and we went on vacation again in 2016 with no issue at POE.
It was here I knew about zero balance, hospital and doctor correspondence etc.... I called Boston Medical centre and my zero balance was sent.
We did Dropbox for renewal, hubby's own was issued and I was called in for interview.
Before the dropbox, I already called hospitals and doctors in Boston since I knew I would be called to explain myself...below is my transcript:

VO: Good morning,can I have your passport
Me: Good morning and hands over the passport
VO: Why are you going to the US
Me: For childbirth
VO: How long did you stay in the US the last time
Me: 20 weeks
VO: What were you doing
Me: I had my first child
VO: When
Me: December
VO: You had your visa in September and gave birth in December, that means you lied during your interview.
Me: Yes and am sorry for the lies
VO: Do u have proof of payment
Me: Yes and I showed it to her, she went through it
VO: what do you do
Me: I told her where I work and I explained my duties extensively
VO: what does your hubby do
Me: I told her what he does
VO: We take the issue of 'credibility' very serious, am sorry ma'am I can't give you the visa.

Lesson learnt:
Before embarking on any project, do your research very well and extensively, if I have the information I have now in 2015,I wouldn't have been denied the visa.

I hope the newbies learn from my experience and always be truthful.

I would rather not take your chatisement and insinuations serious because I came here to learn but calling me a fraudsterhuh? Oh please! I paid over 25k USD for the services with a zero balance receipt. What did I benefit from them? Why a fraud? I told you it was in absolute ignorance and that was not 3 months after my visa, fyi. I got my visa in 2010 November and visited for childbirth in 2012. That was my second visit and i developed complications which i didnt want to discuss publicly. I know you may be trying to help but please try to tone down on your reaction. Its not the end of the world if I dont get a US visa. And I havent made it harder for others as thousands of others have been visiting after me. I believe VOs are trained to evaluate individuals differently. Besides, I could have had a genuine reason for changing my mind and may not have been guilty of 'wilful misrepresentation', but then again, as evident from your evaluation, judgment and or assessment, it may be pointless trying to use it as an excuse (i actually edited my post).

For those who advised me objectively, thanks and remain blessed. I wish Nigeria will be better and we wouldnt have to be scrutinized for visa like many other countries who travel visa free

Seriously to get into masters with HND with lower credit is not a realistic dream (but l believe nothing is impossible).

Fine you studied Secretarial studies & obtained HND w/lower credit. Why don't you look into below programs that are career progression for a secretary:

* Administrative Assistant
* Executive Assistant
* Office Assistant
* Client customer service
* Business administration w/specialisation in office
managenent.

Although these programs still come in Diploma or PGD/C. Do a thorough google search you will get them in some colleges even universities. The purpose of visit would be conquered here.

Secondly to tackle your financial side follow the below suggestions:
* Open a dorm account in your name & ask your sponsor to transfer 1 year living expenses there.

* Pay part of your tuition - upload d receipt/telex copy in your application.

* Then the big thg is SOP/LOE (Statement of purpose/Letter of explanation. Here l would say going by your study gap you can buy into @Jnyuw02 about you talking of d challenge of home front blah blah blah, then need to brace up & pursue your career with new skills & knowledge required for a modern day secretary or Administrative Assistant. Also we can never over emphasised your future goal of gaining this new knowledge & your end game as per what you're coming to use it for in Nigeria (try & carve a niche for yourself here)

Lastly what is God saying about this decision or plan of yours cos its important. If its God's plan then the ground is soften and it will end in praise for you.

@Nwebele LagosNIV would never comment on chances i am sure of that. They would only always make you undsrstand the consequences and that you can take your chance.

In all honesty overstayong your allowed duration always comes with some not soo nice consequences. Coupled with the fact that you came in for visiting and then ended up having your baby.

However since you paid your bills which is always good. It is now about been able to convince the VO and explaining why you overstayed. Like yoy had complications and the likes. The hopefully he/she might be emphathetic enough.

As to chances only God knows that for sure. But whenever you go for the interview have all your documents and possible letter fdom the doctor that you had complications.

Also i advice you avoid drop box so you have a chance to explain yourself.

I would say it's a good decision and a response from me would be a YES. It certainly would be a good way to show the VO that you want to study. They now have your details and once there is a significant change in situation by you pursuing the PGD in Nigeria first and later going for a master in Canada, it will show that there have been progression in your quest to advance your career since the last refusal.

When the time comes to apply for a study permit to complete the Master degree program in Canada later on, you can then add that a foreign degree in law would give you more career prospects especially with multinational companies in Nigeria as most of them would welcome a foreign trained employee because chances are that they will work well in the diversity of the organisation.(SOP hint for others).

Give up maybe after your fourth of fifth try. For to keep doing the same thing over and over again and expect a different result is the very definition of insanity. Just kidding. Nobody can tell you when to give up, only you can decide for yourself.

That said, your situation is not beyond redemption. Age is never a factor as it is never too late for a person to improve oneself or keep learning. I will advice you apply for a masters degree and after you get in, support your application with a very powerful statement of explanation. Talk about what motherhood has meant to you and what was instrumental in forming your decision to return back to school. Perhaps an adversity or divorce opened your eyes? Don't be afraid to talk about it, VOs are psychologist and want to discover a truthful human. Talk about your dreams and aspirations for Nigeria of bringing what you learn in Canada in global or international business to improve the condition of women and children in Nigeria by giving back. That is how you defeat "Purpose of Visit." We got a winner!

You know, there are some factors that certainly would be considered when an officer reviews each application.

1.Why did this applicant choose this program?

2. What does she stand to gain upon completion?

3. Why is she not considering studying in Nigeria considering the cost ?
4. Will this applicant leave Canada upon completion of program?

Since your last application was refused for purpose of visit, it bothers around your proposed program or the officer suspects that you are using the study route to migrate to Canada rather than educational advancement. I actually can't say if you can get a master admission in Canada with your HND qualification, if you can, then you will add to your chances of your reapplication.

A diploma is actually lower than a degree which you already have. It will be hard to sell this to a visa officer unless you have extremely compelling reasons to undertake this program.
A lot of college diploma, PGD/C progams in Canada are structured for work placed demands. They are often times considered as programs to brush up your skills and hone a specific knowledge to help you perform at a particular role/profession. The PGD/C pograms also are for applicants changing a career to a different field other than the previous degree with some level of work experience(1-2). Most times, if a study permit applicant does not fall into any of these categories, you will have to convince the officer very well why you need these programs and how progressively it will add to your current situation or circumstance considering that a logical step after an undergraduate study should be a master degree.

So, if you can get a master degree admission, great. You can also get a PGD/C program as well and make a compelling case. Otherwise, it may be a little difficult using the diploma to secure a study permit. With your profile, it may not be logical.

They wrote that statement on the refusal letter to give you another chance to show that you want to study. In so doing, you MUST meet their requirements and also satisfy them that your primary intention is to study and that you will leave Canada upon completion of your program.

Infact, I didnt just know what else to do to prove otherwise. I wish I had found this thread before my first application. The truth is that having left my career for so long has affected my life in so many ways. My HND result was low. I should have done PGD immediately like my contemporaries but I was sure from my husbands promises that business would pay me.

When I didnt get accepted for the pgd, I browsed the school programs and when I saw a Law related course, I opted for it because I had always wanted to do Law. I didnt know it would affect the visa approval. Should I do a PGD program here and then apply for a masters later in Canada? Would that help me?

Hello Tolummy82 -

A valid visa grants you permission to travel to the US and request entry. CBP ultimately makes the decision whether or not to allow you in to the US. Some people who did not declare the intent to have childbirth in the US are allowed in by CBP. Some are not. If you are planning to have a baby in the US and you did not previously disclose that intent to a VO, you have two options. Your first option, and my recommendation, is to apply for a new visa without using dropbox, have an interview, and disclose your current intent to have childbirth in the US during the interview. This is the safest option, as your intent will then be documented in the system, and you are much less likely to be turned away at the Port of Entry while heavily pregnant after the expense and the long flight to the US. Your second option is to continue with the visa that you have, and bring all the necessary documents to the Port of Entry, and hope for the best.

I want to emphasize this point, as I see it being discussed here often. Sending a "change of intent letter" has no effect. It does not go into the file or into the casenotes, it does not get to CBP in any way. The only way to ensure that your changed intent is documented is to apply for a new visa and have a new interview.

Please what are my chances of visa renewal if I overstayed my allowed period of stay by a month in my last travel. I went on my second travel to deliver. My bump was not noticed and I said i was on vacation (this was all ignorantly as I got the impression that the CPB just hate to see Nigerian pregnant women for no reason and I was advised to wear a big boubou that conceals tummy) so I was given 3 months by the CBP. I begged the hospital to deliver me through CS so that I would leave on time but they refused saying baby comes when he is ready. I was delivered at 42 weeks. When my husband joined me, the CBP asked him why he is returning so soon and he said his wife just delivered. He (CBP) said oh, congrats. Just tell her to pay up all her bills otherwise she would not be allowed entry next time.

I really didnt think about the implication of the overstay then. Until now that I came accross NL and learnt many ideas. Am wondering if it will affect me. Also, I just checked my passports and noticed that b2 was circled on our entry stamps and exit. Nothing was circled in our first visit stamp. Am wondering what that implies, too. Please I need some clarity to prepare myself for interview

Documents we went with - account Statement (Naira and USD), correspondence with doctor and all that, budget, letter of introduction from work, Court affidavit (my name is Oluwaxxx, some documents have oluxxx and others have oluwaxxx; the court affidavit shows that they are one and the same person)

VO - Good morning

Us - Good morning

VO - Why do you want to go to the US

DW - To have my baby

VO - types...which state?

me - Texas

VO - What do you do?

me - I work with xxxx, its a blast bla bla bla and i do bla bla bla in addition to bla bla bla, i have a letter of introduction from my office confirming i work there and stating my annual salary

VO - Collects letter, reads throughly...types then asks; do you have any correspondence with the doctor?

me - I hand over correspondence, budget, hospital bill breakdown etc.

VO - collects everything and start reading 1 by 1 like its a novel

me - notices that VO is now looking a budget, I cut in and say 'i have my statements of account here also to fund all the expenses; i have $xxxx and Nxxx.

VO - nods, collects statements and start going through...says 'i see you do lots of own account transfers'

me - Yes, i don't run my salary account actively, so i have to first move from that account to this

VO - Why is the name here different

me - my name is commonly misspelt, i have an affidavit here that confirms that they are the same person

VO - collects affidavit, reads through, goes back to statements and asks; who is this person that deposited $xxxx into your account on bla bla bla

me - i buy the dollars and then the person deposits it into my account while i transfer the Naira, if you check my naira statement, you will see a corresponding outflow on the same day equivalent in Naira

VO - picks a particular inflow and asks me to show the corresponding outflow in my naira, coincidentally, i made the cash deposit myself from some USD i had at home so i didn't have an outflow in the Naira account. I explain this to him and he nods and continues to type. while he was typing, i picked out other transactions that had corresponding inflows and outflows and show it to him, he looks at them and nods..continues to type then says 'Your visa has been approved bla bla bla...'

the interview probably lasted 10mins, which was long by the usual standard...so there it is
Bottomline, its good to be prepared. Some people just want someone to do everything for them. How will they face the interview. Some say they cant burn data to go through old posts here, yet they want to go and spend dollars in America.

Congrats, I was there this morning as well for the rescheduled interview with DW and we were given too, VO scrutinized all the documents thoroughly though, to the extent that he was matching the outflow out of my Naira account to the inflow into my USD account and asking who is this person depositing cash into your account, had to explain to him that i buy dollars in the black market and the mallam deposits the cash in my account. Guess the lesson is to have all relevant documents complete and be honest, never can say how the interview will go

After a rescheduled Tuesday interview, DW and I went for our Visa interview on today Saturday

Early morning favour. Atleast our VO was smiling and apologizing for the rescheduling.

VO: good morning

DW & I: Good morning

VO: And how are you today

DW & I: fine and you

VO: What brings you to the consulate/ why do you want to do in the US

ME: for child birth & vacation

VO: What is your budget for the travel

ME: bleep dollars

VO: That is an expensive child birth

DW & I : Smiles, yes it is

Vo: How do you intend to pay for this

ME: i have been working for bleep years with bleep company as bleep. i have been able to save up over the years

VO: So based on the job i do, he asked what is the recent incident you have had to resolve

DH&I: i sha gave one answer like that of the what came to mind

VO: Asked DW, what do you do

DW: i work with so so and so

VO: what is the recent project you have had to handle

DW: so so so project

VO: Have you traveled before

DW & I: Together to the UAE, and listed others i have been to

VO: We are good, when your child becomes a citizen, collect the birth certificate and visit a site (don't remember cos i was looking at the white paper in his hand) to renew passport. Take care of your wife and baby.

VO: pick up ur visa in 3 business days at the address on the paper

DW & I: Thank youu (smiling and laughing inside)

All these questions, the VO typed all the answers while looking straight into our eyes.

No document was looked at.

Congrats o. May the remaining of us that are yet to get visa find such favours and more in Jesus' name. Amen

The point is that they knw, so u shuldnt hide it. It puts them off when do or lie. If nt for the passport u wouldn't hv gone in the first place
I would say better healthcare and if they insist, I tell them well, its not a bad idea to afford my kid opportunity of dual citizen. It may do them a lot of good in future, in case our country continues in this economic and political instability.

I would think that from wat I have been reading here that Houston and Chicago was the worse.i guess my tuts were just speculations! As mine was tough.
I entered LAX thru Lufthansa n it was so long n tiring with the food they shared on the plane that I culdnt eat.so was super hungry n fainting.
There was no preferencial treatment got on the long queue n finally my turn-

Me: to hv my baby
Cbp: why
Me: citizenship
Cbp: why
Me: becos I believe my child will hv a better life with dual citizenship , study n all
Cbp: so I want to come n stay here

There I stay for almost 3hrs before I was called. The officer that called me to interview was a furious one becos he just finished racking someone.

He asked me to open my fone, he went to where I saved the screenshot from this forum n read everything he went tru all my pictures n text. At this point my heart was beating. I just kept praying( I hv been praying all along)it took him 1hr ,inbtwn he asked abt my doc letter, and whether I informed the embassy.i showed him too. Then he now sed I see u did an extensive research on childbirth( I sed yes sir). He now became calm with me, told the other officer abt me. He ask me wat if I ran into emergency that require moni how will I pay. I told him I won't take Medicaid. He sed I shuldnt bother coming back if i do. Told me to pay all my bills and come with my receipts.
I was truthful all thru! And God touched his heart n saw me thru!
The way you bluntly said citizenship! Hmmm. Am scared o. Might port to El paso route. I thought Lax was always breeze as people reported in the past. Thank God for grace at last, sha
