Omihanifa:It is not the bank that charge percentage on amount. It is the court that issue the Letters of Administration (LA). In most cases, it is time to make payment of the LA and the beneficiaries cannot raise the amount, the Court will usually direct the Bank to debit the account in that sum in favour of the State Government. So it is only in that instance that the Bank will be entitled to debit the account. The Bank is not a beneficial of the deceased Estate so they have no right to charge the account. |
As brilliant as the Hon. Speaker may have sounded. I doubt, if the Clerk of the House has the power to engage the services of a private legal practitioner to initiate a criminal complaint of perjury against the Minister without the fiat of the Attorney-General and Minister of Justice first sought and obtained. This has brought again to the fore, the long years of call for bifurcation (splitting) of the Office of Attorney General from that of the Minister of Justice. The same National Assembly in all the past amendments of the Constitution have shut their eyes over the from this call. Now the chicken has come home to roost. This in my humble opinion may be another jamboree or as the guys in entertainment will call it, another series in a season film. Let's enjoy it! |

Owing a landlord and running away with his rent, is not been smart, it will come back to you except you don't want to be landlord. NO LAW ALLOWS YOU TO SPEND A DAY IN ANOTHER 'S HOUSE WITHOUT PAYING, GOVERNMENT DID NOT BUILD FOR ANYBODY, SO THEY CAN'T MAKE SUCH LAW. |
I laugh, except Ashimolowo was an eye witness. Calling big names as witness won't establish the case in anyway, however, calling a witness on *sub-peona a testificandum* is even more dangerous in this kind of case. The lawyers should be wise. |

The earlier Nigerian realise that these "celebrities" perpetuate media hypes to continue to be on the lips of the public, the better. Sometimes ago one actually showed up in my office on a claim that he was harassed by the Police, even before he arrived at my office, it was everywhere on the social media that "he is already with his lawyers and they are taking the case up" When he eventually arrived after like 2hours, he couldn't tell me what happened. He was only shouting "it is trending on social media, this is good publicity". |
I will even be surprised if they are able to frame any charge against him. You can only be convicted of a crime where there is evidence and there is no single doubt in your favour. From the story of that lady, the only evidence is her oral testimony. The Evidence of whoever she narrated the event to between then and now can at best be "hearsay" which has no value in law. She won't be able to establish the ingredient of whatever offence the Police might want to frame against the Pastor if there is no confession. Yes it took her time to come out to say it (if it actually happened), she delayed in getting justice, and surely she will be denied. Am more afraid for her. It will be better for the matter to die now, if not, if a charge is frame and the Pastor is prosecuted and discharged, she might need to wake FRA Williams from the grave to get her out of the huge damages that will follow, when the Pastor starts his own suit against her. I expect her lawyers to have told her this. |

A Notice to Quit is not rent Free. It is meant to let you know in advance that the Landlord do not intend to continue the tenancy relationship with at the expiration of the Notice. You are to pay for every time spent in another's property, even to the fraction of days if the landlord wishes to collect it. Just as an employer is bound to pay an employee for every day/hour he/she showed up at work to the date of termination of employment even after giving him/her notice of termination. You are bound to pay your landlord for everyday on his property. |
Unfortunately legal practice particularly in Nigeria of today don't celebrate certificate or institution attended. What determines your pay is what you can offer. Of what benefit is your Masters Degree in Maritime law from UK, if you can't draft a good pleading or conduct a trial in a maritime case. |
