Emailed and sent by post to tribunal to cancel the appeal for the first refused visa 18th September 2018.
Got a reply accepting my email 19th September 2018.
Ported into the UK on 24th September 2018.

All is well now my family and I are happily now in the UK.
Once again I sincerely appreciate. Take care.

Hello.I thought the same as you (justwise), Lexusgs430 and Oxygyne did, but after receiving that which i sent to you guys from International casework and quality assurance team i received a letter from Immigration and tribunal saying thus:

The respondent has copied the tribunal into a letter they have sent to the appellant.
The letter is ambiguous and does not meet requirements of the rule 17(2) of the 2014 Procedure Rules. The letter asks for the appeal to be withdrawn. Rule 17(2) requires the respondent to confirm that the decision subject to appeal has been withdrawn. As the letter does not withdraw the decision subject to the appeal, the hearing will remain as listed.
The appeal will proceed to be determined on the papers on the first available date after 19th September 2018. Should the respondent make a renewed application to withdraw, it should explicitly state that the decision subject to appeal has been withdrawn.
These directions are made by a Tribunal Caseworker Mr X in exercise of specified powers granted by the Senior President of Tribunals under rules 3(1) and (2) of the Tribunal Procedure (First-tier Tribunal) Immigration and Asylum Chamber) Rules 2014. Either party may within 14 days of issue apply in writing to the tribunal for the direction to be considered by a judge under rule 3(4). If you do not seek reconsideration by a judge then the Tribunals Caseworker's direction will stand.

Any clues to what again is being said here? This my case is taking another dimension again. Lexusgs430 500k? Cadilac vehicle price. Funny you! Oxygen i did apply again, priority this time. Awaiting response. In 3rd week of waiting. See as my tribunal case is going, no assurances from tribunal's end.

Unfortunately that is the way its, tribunal hearing dates are always loaded, in 2010 when i had a case there it was the same situation.

In some cases you may not have to wait till the hearing because after reviewing your case and supporting documents they may overturn the decision and ask your wife to submit her passport for visa.

To get your document you just have to keep disturbing them else they will not be in a hurry to return it.

I completely understand your frustration though.
Hi justwise and other people in the house. I recieved this (below). Please i would like explanation on what they are saying to me:

I am writing to inform you that I have reviewed the decision made on 23/04/2018 to refuse your application. Pursuant to Tribunal Procedure Rule 17(2) I respectfully request that this appeal is treated as withdrawn.
This request for withdrawal is in order for a recommendation to be sent to the Decision Making Centre where your original application was decided to overturn the refusal decision and grant Entry Clearance.
Fresh evidence has been submitted.
If the withdrawal of the appeal is granted, we will advise the Decision Making Centre where your original application was decided. They will contact you in due course with further information about any next steps you need to take.
This letter is being copied to the Tribunal.

why the rush rush in securing a visa through priority? however, the so called priority can be purchase at tls website/ tls office!
Refusal the 1st time was because tb and english language docs were not submitted. These two docs were available at the time of biometrics.Not submitted because it was assumed it will be forwarded by the designated centres to home office.Appeal was done through tribunal.

Getting to do priority now is because we have been waiting since March to hear from tribunal and no news. So instead of keep on waiting for tribunal which will take forever, thought it wise to get apply again this time using priority(one month). This i can't find priority on ukvisa site during payment.Its only super priority which is an extra 400 Pound to priority as stated on tls website.

You know ricki one needs to pay for the visa application, health insurance etc on ukvisa website after filling the application and submitting not tls website. That was why i asked the question if any1 knows why priority(except super priority) is not on the list & how i will go about getting the one priority instead of super priority?

Hello Justwise and other people in the house. Homeoffice and tribunal have not replied my appeal so I reapplied for settlement visa but i am having a little problem with the payment option on ukvisa website for priorty.I could not find priority payment for 573 Pounds.Only that for Super priority for 919 Pounds is available (on TLS website both options are there). Can any of you put me through please? I want advise whether to go ahead with the 919 Pound option or what do i do to get the 573 Pound option (this is better for me)?

Thank you Justwise and Oxygyne. I will pursue as you guys have said and hope an outcome will happen. She has her passport with her so that is not a problem. She went to the centre where she did her TB test to get a new certificate and was told she needs to bring back the old expired one before a new one can be issued. We will try again and see. Thanks once again for all your help and advise. One love!

Honestly i feel your pain, this is the frustrating thing about tribunal cases because there is no timeline and the waiting is endless sometimes.

How about reapplying and deal with the reason(s) of previous refusal?

Regarding those documents you just have to keep emailing and calling them, have you paid for their email services before?

I had wanted and still want to reapply (priority this time around) but i need to retrieve the Tb and english proficiency certificates back because without them i can not reapply. My wife was told that she needs to present the TB certificate (which was valid at the time of submission and now has expired because of the long wait of the appeal) to get a new one at the clinic specified by the Homeoffice.
No i have not used their email services but that is not a problem to get to use it.
My wife is writing them a letter today, asking what is delaying the appeal. We feel also we should write them to suspend the appeal and for them to return the documents. Hope these are in order? Awaiting your response. Thank you.

Hello Justwise. Please I need your advise. My wife and I have waited the 3months duration given to us by tribunal.Till date no information from Homeoffice, none too from Tribunal. When I called Tribunal was told since there has been no response from Homeoffice and the time given for response has passed it means the case will automatically move to listing where a paper hearing will be done. I asked when this will take place i was told they can't say but will be notified the date of the hearing. This date could be whenever.
What will my wife and I do now because the date of hearing could be whenever? Secondly we need to retrieve the TB and English proficiency back because this matter is taking too long. Awaiting your reply, thanks

Let me understand you correctly........

(1) You do not want to stop the appeal process for a spousal visa application?
(2) You want to reapply for the same spousal visa, using priority application?
(3) You want both applications to run concurrently?


I hope the aforementioned is not what you are saying?

Yeah Lexusgs430 to your 3 questions.I read in another forum that some people do it. Using priority (one month) it would be approved before the appeal (3 months) goes through and one can suspend/withdraw the appeal after that. This is part of my asking to know what to do. I haven't done the priority yet. Its ok your too many questions,atleast clarification is necessary....

Hi all,
Please i need your advise.
In November 2017 my wife and i submitted settlement visa application-spouse. Am British and my wife is Nigerian.My wife had her biometrics taken and her passport collected in TLS. She asked the person who collected her passport "what of the TB test and english language proficiency certificates"? Which she had with her on the day she went to give her biometrics, she was told its ok and she didn't submit it. We thought all was ok since it was stated in UK.gov website that the 2 documents be gotten from accredited offices (British Council and TB Clinic) and we thought that the offices will correspond them to Homeoffice. I submitted all required documents required payslips (earning more than 18,600 Pounds),evidence of where i live and work, etc.
On 14th February 2018, my wife was asked to come to TLS to pick up her passport and documents only to get there and find out she was refused the visa. The letter stated that she was refused on the basis that she did not submit the two documents-TB and english certificate, but all others required are ok ie from my own side. Receiving this she made an appeal for the refusal to be looked into by First tier tribunal UK. She was told that she has to wait till 26th June 2018 for it to be looked into. No hearing date has been fixed yet.
I tried to get the 2 documents back so I can reapply using priority, Tribunal said they forwarded the hard copies to Homeoffice, its only photocopy with them. Homeoffice said is should contact Tribunal that since i submitted the documents to Tribunal they will have my documents. Now this is very confusing.
I wanted to know why the long wait till 26th June 2018?
How else do i do to collect me documents so i can reapply using priority since both tribunal and Homeoffice are not responding?
Are we going to wait till the appeal is ready to give a verdict?
What other advises can i get?
I was asked to ask for Justwise or any other capable, able person here in this forum by people who had used this forum and some who are in this forum.
Please awaiting responses.Thank you
