Abia State Governor Okezie Ikpeazu and his party, the Peoples Democratic Party (PDP), have filed a notice of appeal challenging the Appeal Court’s decision sacking him from office. The court’s panel, led by Justice Oyebisi had declared Alex Otti of the All Progressives Grand Alliance (APGA) the winner of the election of April 11, last year. It held that Otti scored the highest valid votes of 164,332 against 114,444, scored by Ikpeazu. The court held that there were cases of over-voting and allocation of votes in favour of the PDP candidate in three Local Government Areas: Isi-Alangwa, Osisioma and Obingwa and voided elections in the three councils. In a notice of appeal filed yesterday at the Supreme Court, Ikpeazu and PDP are praying the court to, among others, set aside the Appeal Court’s judgment on the grounds that neither Otti nor his party had credible and cogent evidence to support their petition challenging Ikpeazu’s victory. They also wrote the Chairman of the Independent National Electoral Commission (INEC), Professor Mahmood Yakubu, asking him to respect the constitution. In the letter written on their behalf by Wole Olanipekun (SAN), they contended that Ikpeazu remained the governor until he had exhausted his right of appeal to the Supreme Court. The governor and his party said they were dissatisfied with the judgment and instructed their lawyer to appeal against it at the Supreme Court. PDP said Ikpeazu had a constitutional right to appeal against the judgment at the Supreme Court, under and by virtue of Section 233(2) (e) (iv) of the constitution (as amended). Ikpeazu and his party added that would file a notice of appeal, because they were yet to access a certified true copy (CTC) of the judgment. They raised three grounds, including: the Appeal Court was wrong to have declared “the 1st respondent (Otti) winner of the April 11 and 25, 2015 Abia State governorship election on the grounds that he scored the majority lawful votes cast at the election”. They contended in the second ground that “the Court of Appeal erred in law when the Justices on the panel neglected to apply the provisions of sections 49, 52(2), 138(2) and 155 of the Electoral Act, 2010 (as amended) but relied solely on Card Reader accreditation as the basis for holding that there was over-voting and therefore cancelled the election in Obingwa, Osisioma Ngwa and Isiala Ngwa LGAs in the April 11 and 25, 2015 Abia State Governorship election”. The appellants noted that ”in instant case, where the 1st and 2nd respondents (Otti and APGA) sought nullification of votes from Obingwa, Osisioma Ngwa and Isiala Ngwa North LGAs of Abia State in relation to matters or events that took place at the polling units, they must produce evidence of eye witnesses who saw it on the days of elections as well as tender primary unit results of documentary evidence in relation to the questioned Local Government Areas. “The Court of Appeal found as a fact (as did the tribunla) that the State Returning Officer had no powers to cancel results in Obingwa, Osisioma Ngwa and Isiala Ngwa North LGAs. “By the findings (in Paragraph iii) above, the allegations of malpractice and non-compliance as basis of results by the Returning Officer needed to be proved. No proof was offered and the Court of Appeal did not refer to any.” Their letter reads in part: ”Bearing in mind the fact that INEC itself is a party to the processing as, and would also be a party to the appeal which would definitely be filed on behalf of our client immediately on receipt of the judgment of the court of appeal, may we urge INEC to resist any invitation by anybody or from any quarter to do anything that would work contrary to the provisions of both the constitution and Electoral Act in respect of the res (subject) of the appeal, particularly the position of the governor of Abia State, which our client occupies. “Also, under Section 143(2) of the Electoral Act, 2010 (as amended), our client has the statutory right to remain in office pending the expiration of the period within which an appeal shall be filed, assuming without conceding that he does not even want to lodge an appeal against the decision of the Court of Appeal. Upon filing his notice of appeal, our client is also constitutionally entitled to remain in office until the Supreme Court decides and pronounces on his appeal. “That what is causing the delay against the filing of the notice and grounds of appeal against judgment is the failure of the court to avail both our client and our humble selves of a copy of its judgment, even as at the time of writing this letter, and despite demands.’’ thenationonlineng.net/ikpeazu-urges-supreme-court-to-void-appeal-courts-judgment/ New year demotion |

Olufemi Atoyebi, Ibadan The Oyo State Government on Monday issued a 48-hour ultimatum to nine elevated chiefs in Ibadan to revert to their former status, describing their promotions by the Olubadan of Ibadan, Oba Samuel Odulana, as illegal. A statement released by the state government said it was disappointed with the promotions after it requested that concerned high chiefs should submit their medical certificates of fitness before the Olubadan of Ibadan could elevate them. The statement partly read, “Government’s suspicion and ardent belief are that the recent purported elevation could not have received the blessing of our highly revered father and traditional ruler, the Olubadan of Ibadan. He is reputed to be a forthright and foremost traditional ruler with an enviable track record of achievements and a firm belief in due process as well as a respecter of the rule of law. “Consequently, government directs that the organisers and the beneficiaries to reverse the purported elevation within 48 hours, failing which appropriate sanctions will be invoked under sections 21 and 26 of the Chiefs Laws, Cap 28, Laws of Oyo State, 2000.” In an attempt to clarify its position on the matter, the state government said since the inception of the present administration, it had resisted, as a matter of policy, any attempt to be lured into religious, chieftaincy and labour union issues. “This is in order to maintain its neutrality, ensure fairness, justice and respect for the rule of law. Government will always uphold the sanctity of the rule of law and would neither encourage nor condone any tradition or peculiar culture of illegality, impunity, disregard and/or disrespect to constituted authority,” the statement said. www.punchng.com/ajimobi-cancels-olubadan-chiefs-elevation/ |

Femi Durojaiye The Lagos State House of Assembly on Thursday invalidated the impeachment of the former deputy governor of the state, Mr. Femi Pedro, following his remorsefulness and party loyalty. This resolution followed the adoption of the recommendation of the eight member Ad Hoc Committee constituted on July 2, to review the circumstances that led to impeachment of Pedro. The assembly, which passed a vote of confidence on Pedro, said the allegations of his impeachment were not connected to criminal charges. The committee, headed by the Majority Leader, Mr. Sanai Agunbiade, in its report said: “In line with Rule 51 (6) of the Business, Rules and Standing Orders of the Lagos State House of Assembly, the committee recommends that this House should by a substantive motion review the impeachment passed on Pedro on Thursday, May 10, 2007 by the fifth assembly. “Pardon him and pass a vote of confidence on him as a fit and proper person that can be entrusted with political and administrative responsibilities,” Agunbiade said. About 36 members of the assembly were in support of the pardon while only one lawmaker voted against and another abstained. Pedro was impeached towards the end the tenure of Bola Tinubu as governor for gross misconducts on May 10, 2007. The ex-deputy governor had urged the assembly to revisit his impeachment in a letter sent to the eighth assembly on a compassionate manner. In his contribution, Rotimi Olowo, the Chairman House Committee on Budget and Economic Planning, urged the assembly to reverse the impeachment of the ex-deputy governor in order for him to live a normal life. Olowo said Pedro has shown a remorse and needed to be forgiven. He said: “To err is human, to forgive is Divine. Pedro has shown much remorse and obedience, let’s pardon him to have his sanity back. “Pedro has passed through much psychological trauma.” He said the purpose of the impeachment then was not based on fraud or criminal tendencies. Hon. Segun Olulade, the Chairman, House Committee on Health, commended the ad hoc committee for the recommendation for reverting the impeachment. Olulade also commended Pedro for withdrawing court cases challenging his removal to allow the assembly wade into the matter. The assembly also yesterday passed into law the N662.588billion 2016 Appropriation Bill presented by the state Governor, Mr. Akinwunmi Ambode on December 17, 2015. The Appropriation Bill, tagged: ‘The Peoples Budget,’ is the highest in the history of the state and it was an improvement on the N489.69bn appropriated for year 2014 and 2015 respectively. The assembly unanimously approved the budget after members deliberated on the report of House Committee on Budget which scrutinised the bill as proposed by the governor. The report was presented by Chairman of the House Committee on Budget, Hon. Rotimi Olowo, on behalf of members of the committee. Speaker of the assembly, Hon. Mudashiru Obasa, in his response, commended members of the committee for expeditiously working on the budget to ensure its passage before the new fiscal year. Obasa recalled that members of the committee worked even on holidays, adding that they had indeed shown their love for the people of the state. Ambode had, while presenting the budget put the recurrent expenditure at N278,909billion while capital expenditure stood at N383,678billion, explaining that the capital to recurrent ratio is 58:42 as against 51:49 in 2014 and 2015. The governor also put the total revenue estimate for 2016 fiscal year at N542.873billion saying the balance of N119.714billion would be funded through deficit financing constituting 0.41 per cent of the state GDP based on 2016 budget alone and a cumulative debt to GDP ratio of about three per cent. In a related development, the assembly also passed the N25billion employment trust fund bill forwarded to the House by the governor into law. While considering the report of a joint committee set up by the House, the members scrutinised the findings and recommendations of the committee with minor amendment. The speaker, in his remarks, praised the governor for the initiative to engage unemployed teeming youths roaming the street in a veritable venture that would bring out their potentials, empower and even foster the economy of the state. He said the economy of the state would further thrive through improved entrepreneurship, trading commerce and improved economic activities which the trust fund aimed to achieve. Earlier, the Chairman, House Committee on Finance, Hon Oluyinka Ogundimu, representing Agege II in his Submission while presenting the report to members, said the essence of the bill when fully operational would serve as a panacea to tackling the unemployment scourge confronting the nation. The lawmaker representing Lagos Island II Hon. Sola Giwa, said the bill also seeks to raise money from the private and public contribution for the financial support to residents in the State, including jobs and wealth creation thereby solving all problem of unemployment in the State and giving equal opportunities to all citizens. www.thisdaylive.com/articles/lagos-assembly-invalidates-pedros-impeachment/229242/ |

He said, “We want to ensure that we join hands with our leaders in the local government and in Nigeria at large. The National Vice Chairman of APC is our brother in Idanre, so we have to join hands with him. “And we also want to join hands to ensure that we join the President to move this country forward, as a federal commissioner, even though I was not appointed by this present administration. “I have seen what the President has been doing since he came into power, especially his plan for 2016 to curb corruption and ensure that our youths are gainfully employed.” Welcoming the defectors, the National Vice Chairman of the party, Chief Pius Akinyelure, urged them to be loyal to the party and to continue preaching the gospel of the APC and the change agenda to the people of the state. Earlier in his address, the chairman of the party in the state, Mr. Isaac Kekemeke, said the APC had become a big party in the state. He expressed confidence that the party would win the next governorship election in the state, while giving assurance that the party would conduct a transparent primary. “Under my leadership, there will be transparent primaries for people who vie to be governor of the state,” he said. www.punchng.com/ex-president-jonathans-appointee-pdp-members-defect-to-apc/[b]Ade Akanbi, Akure An appointee of former President Goodluck Jonathan from Ondo State, Mr. Oluremi Akinbobola, and some other members of the Peoples Democratic Party in Idanre Local Government Area of the state, have defected to the All Progressives Congress. Olaleye Aluko A serving Lance Corporal in the Nigerian Army, Emmanuel Ebo, and seven others have been arrested for allegedly selling ammunition to a notorious gang of armed robbers which attacked banks in Lagos and Ogun states. PUNCH Metro learnt that the corporal and the others – Ahmed Monsuru, Bayo Olaoye, Olamilekan Omopeji, Ayodeji Famileye, Opeyemi Balogun, Michael Adebayo, and Edward Paul – were arrested by the Inspector General of Police Special Intelligence Monitoring Team. Our correspondent gathered that the team arrested the soldier, an Ijaw, at his base in Maiduguri, Borno State, while the other suspects were picked up in various hideouts in Lagos, Ogun, and Oyo states. It was gathered that the corporal, who had reportedly confessed to the crime, was arrested by the team, led by CSP Abba Kyari, after the Department of Military Intelligence had been alerted to the matter by the police. It was learnt that the police recovered six automatic pump-action rifles, a pistol and some cartridges from the suspects. It will be recalled that robbers had attacked some commercial banks in Lekki, Ipakodo, Ijede and the FESTAC Town area of Lagos State and Agbara area of Ogun State at different times in the year. Our correspondent gathered that the DMI received an intelligence report on the corporal’s activities from the police, and handed him over for interrogation. A police source told PUNCH Metro that the soldier allegedly concealed the weapons in food items heading for Lagos State from Borno State, while the robbers would credit his bank account upon receiving the weapons. According to the police, the suspects allegedly sold no fewer than 15 automatic pump-action rifles to the gang. Speaking with PUNCH Metro , one of the suspects, 40-year-old Famileye from Ekiti State, said he sold an automatic rifle to the gang for N230,000, adding that he made over N60,000 on each rifle. The father of one said, “I have a friend in Oyo State, known as Mr. Mike, who sells arms. I do not know whether he is a licensed dealer or not. It was in 2012 during the fuel subsidy protest in Lagos that I went to Ikorodu to buy fuel and I met a member of the gang. That was how the business started. “Last year, one of them, Opeyemi, called me that he wanted to buy two pump-action guns which he needed for pipeline security. I called my friend, Mr. Mike, and told him about it. He sold the rifle to me for N170,000, but I sold it forN260,00. “I, Opeyemi and Olamilekan have gone to the creek to meet one of the gang leaders, known only as Ossy. They bought two rifles on that first deal and they also demanded two more rifles. Sincerely, I did not know they were using the guns for robbery. They said they were into pipeline security.” PUNCH Metro learnt that the corporal and two other suspects could not be paraded yet as intelligence information was being gathered from them. The Force Public Relations Officer, ACP Olabisi Kolawole, confirmed the arrest of the suspects, adding that investigation was ongoing into the matter. www.punchng.com/soldier-others-arrested-for-selling-weapons-to-robbers/ |

Okechukwu Nnodim The official pricing template for Premium Motor Spirit, otherwise called petrol, by the Petroleum Products Pricing Regulatory Agency on Monday showed that the Federal Government was still subsidising the product by N6.45 per litre. This is despite claims by the Minister of State for Petroleum Resources, Dr.IbeKachikwu, who on Sunday stated that petrol was currently not being subsidised by the government. Although the latest update on the PPPRA template was done on Friday, December 25, it showed that the Expected Open Market Price for petrol was N93.45 per litre as against an official retail pump price of N87 per litre. This indicates that the Federal Government is still subsidising the commodity by N6.45 for every litre consumed across the country. According to the template, the EOMP comprises of the landing cost of N77.96 per litre of the product and the subtotal margins of N15.49 per litre. The landing cost is made up of trader’s margin, N1.47; lightering expenses, N4.07; Nigerian Ports Authority cost, N0.77; financing, N0.51; jetty through put charge, N0.8; storage charge, N3; and commodity plus freight charge, N67.34. For the cost elements that make up the subtotal margins for each litre of petrol, the template showed that retailers cost was N4.6; transporters’, N2.99; dealers’, N1.75; bridging fund, N5.85; marine transport average, N0.15; and administrative charge, N0.15. A combination of all the above figures showed that the EOMP of petrol is N93.45, against a retail pump price of N87 per litre, leaving a subsidy of N6.45 for every litre of PMS. Kachikwu, who doubles as the Group Managing Director of the Nigerian National Petroleum Corporation, had told journalists in Kaduna on Sunday that the government was currently not paying subsidy on petrol. “Today, there is no subsidy; we are selling the product at N87; in January, we will look at what the trend is, we will announce (a new) price if that is less than N87; we will announce it and if it is more than that, we will have to announce it,”the minister had said. Some senior officials of the Petroleum ministry, who spoke on the development, stated that the minister might have made the assertion based on the move to review the PPPRA pricing template. The officials, who did not want to contradict their boss, argued that the new template would show that subsidy had been gradually stopped, stressing that this was as a result of the fall in crude oil prices. “I believe that the GMD has seen the new template and that was why he made that statement, but that does not mean that the current template of the PPPRA should be disregarded because it is the basis for any other pricing mechanism,” one of the officials, who pleaded not to have his name in print, said. www.punchng.com/pppra-template-shows-n6-45-petrol-subsidy-despite-kachikwus-claim/ |

Sunday Aborisade Worried by the excessive waste of gas through flaring, the Senate Committee on Gas has threatened to go tough on errant oil firms by ensuring the enforcement of necessary legislation against it from next year. The Chairman of the committee, Senator BasseyAkpan, who stated this in an interview with our correspondent, said the decision was part of the strategies being employed by the upper legislative chamber to ensure alternative sources of revenue for the country. Akpan noted that the country could no longer afford to watch and see one of its major revenue generating natural resources being wasted simply because there was weak enforcement of necessary legislation that could guard against it. He noted that the major concern of his committee was to ensure that the Act of the National Assembly enacted in 2008, which defined the domestic gas supply obligation of every international oil company operating in Nigeria, was adhered to. Akpan said, “The law also stipulates the penalty on issue of gas flaring; we will soon engage the stakeholders, starting with the regulators like the Ministry of Petroleum Resources, the Nigerian National Petroleum Corporation, Department of Petroleum Resources and the gas aggregators.” www.punchng.com/pppra-template-shows-n6-45-petrol-subsidy-despite-kachikwus-claim/ |
