An Ado Ekiti Magistrate’s Court has vacated an order discharging and acquitting the state chairman of the All Progressives Congress, Chief Jide Awe, and four others of alleged murder. Others are Faboro John, Aniramu Basiru, Falayi Busuyi and Owonifari Sefiu. According to a statement by Governor Ayo Fayose’s Special Assistant on Public Communications and New Media, Lere Olayinka, on Wednesday, Chief Magistrate Adesoji Adegboye vacated the order after considering the extant laws, relevant authorities and facts of the case. The ruling followed a motion ex parte by the counsel for Ekiti Government, Mr. Bunmi Olugbade, seeking an order of the court reversing its earlier decision which discharged and acquitted the accused persons. Olugbade argued that it was an established principle in law that magistrate courts lacked the jurisdiction to try criminal cases let alone discharge accused persons. The counsel also contended that by the provision of Section 71 (1) and (3) of the Administration of Criminal Justice Law, Ekiti State, the state Attorney General is empowered to reopen such a criminal case suspended through a notice of discontinuance. The court had on February 12 discharged and acquitted the APC state chairman and the four others consequent upon a motion of discontinuance filed by the then Attorney General, Wole Fapohunda. Awe and others were dragged to court for the alleged murder of Mr. Ayo Jeje and Mrs. Juliana Adewumi in Erijiyan Ekiti on March 31, 2013. http://www.punchng.com/politics/murder-court-vacates-order-discharging-apc-chairman-others/ |

That the pioneer chairman KWOROPT-LESS party, APC, Bisi Akande is an ex-convict, also jailed by Buhari for stealing. APC can't be trusted. ................................................................................................................................................ “While we do not want to bother ourselves with the propriety or otherwise of Chief Bode George’s conviction not for stealing a dime of public fund but for flouting procedure for award of contracts, we make bold to say that the ACN as a party does not have the required moral standing to chastise Bode George or any other person for that matter because its own National Chairman was equally jailed for stealing funds belonging to the old Oyo State,” a part of the statement read. “Interestingly, Bisi Akande was only released from jail and not pardoned by the Ibrahim Babangida government, and Buhari, whose government jailed him (Akande) is now his political mentor and rallying figure for their much-touted merger party.” PDP added that it was late Chief Sunday Afolabi who prevailed on the Osun State PDP not to seek legal redress on Akande’s conviction in relation to his qualification to contest election as a governor in 1999. “Apart from Akande, was the ACN Leader in the House of Representatives, Femi Gbajabiamila not also convicted in faraway United States of America for stealing his client’s money? “If these characters in the ACN have any sense of shame, they ought to know that despite his conviction, Bode George had the right to belong to, and participate in the activities of a political party the same way Bisi Akande is the National Chairman of the ACN despite being an ex-convict. Can conviction stop anyone from belonging to a group or a trade union? And if he belongs to a group, can’t he take part in the activities of the group?” The ruling party further advised the “ACN hypocrites to clean their stinking house and leave Chief Bode George alone to live his life and exercise his constitutional rights,” http://www.thepremiernewsonline.com/articlereader.aspx?newsid=gdejgdbiibcichcfaa |
