1. Didn't your sister read the terms of service before applying for the loan? I'm very sure it was clearly stated there the penalty for loan defaulting and she must have agreed to it before the loan was given.

Your argument is baseless.

The loan company has its terms and conditions which in most cases, are not favourable with their clients. But the fact that one's goes to borrow money from them, this person is duty bound to abide by their terms and condition even though he/she had repaid previous loans successfully with no issues. That the client defaulted by three weeks is not good for the loan company.

You have no case here. Pay what you owe.

Asking people to repay a debt is not a problem...but defaming the person without revealing all that transpired is unfair..remember not being able to pay a debt is not a criminal offense. You have bank access already they are legal ways to retrieve money from defaulters. But they prefer cyber bullying..and under financial laws 45 percent is not legal

This was the message I got barely 24hrs after my due date. How can one see messages like this and still wanna repay. And dat was how all my contacts also got same threats from them. I've never defaulted not even once and barely 24hrs I'm getting a threat. So I ask are they really legit or got their license illegally.

PREDATORY LENDING IS REAL!!!

This happened to my sister of recent. She applied for a domestic loan on Sokoloan online platform to the tune of 14k. She was billed N6, 433 in interest (i. e an outrageous 45%interest for a 10 day loan. This meant that she was to pay back N20, 433 ten days from the time she secured the loan.

Fast forward to 10 days time. She was unable to meet up with the loan repayment, and thus demanded for more time when contacted. 3 weeks after that, on the 15th of feb, she got a report that the following message was being circulated to all her phone contacts, including key business clients. The report read thus:

"Attention! The Name: Naomi So and So with phone number XXXXXXXXXX is acting fraudulent, Has defaulted in her repayment of loan to a chinese lending company (Sokoloan) by collecting a loan and refusing to pay back. The public is advised to take caution of her, until she pays back the company money.

NOTEWORTHY is the fact that the actual amount owed or even the exorbitant interest added was conveniently ommited from this highly defamatory message, giving the impression that She may have defrauded the company of a huge amount of money.. (if that isn't predatory, what is it then?

To make matters worse, when the customer care was called by the upset young lady to demand why her character should be so defamed after just three weeks of default, she was rewarded with more insults and threats and called unmentionable names.

This from a Chinese firm?

In a related report @nairaland, a similar incident just occured involving this same sokoloan. A woman who had lent 8k to pay back 15k in 14 days time was meted this same horrible treatment few days after she defaulted that ended in the victim taking her own life as a result of the ensuring embarassment. Now if this isnt predatory and evil, what is??

Now my point is this...

A country that cannot protect its citizens from exploitation from foreigners and evil loan extablishments, is this fair?

Where are the regulatory bodies that are supposed to be guiding the exploitative activities of these shylocks whose major aim remains to capitalize on the vulnerability of our poor economy and defraud Nigerians by the millions?

I then sent them This as a reply:

I'll pay the default interest including the full payment because you guys are adding daily interest to it. I'm having delayed payment.

They sent This:

you are acting fraudulent and we are going to treat you as a criminal if we dont get your payment by 4pm today 9jacash. everyone you know including people you work for and your relations will get a criminal alert message about you. you are just few hour away to your doom.



...... This is not the first time I'm taking an emergency soft loan from them. I called them that they will get their money and secondly, there's a daily accrued interest default payment so they shouldn't worry, their loan will be paid in full. Only for me to start receiving messages from close family friends and clients that holds me in high esteem. I discovered some of my big clients blocked me on WhatsApp and even Blocked my call.

I was supposed to be mobilised for a Solar project on Thursday and Sokoloan told the client I'm a criminal waiting to be apprehended but why not just tell them the truth which is I took a soft loan, why did they lied on me.

After all this, they still called me this morning to do more harm. It's Well. God is still on the Throne...

I am game on this. Those guys are bastards and I have said it several times,they should be banned. The interest rate is high (about 40% for just 10 days) and they will start calling you on the day you are to make repayment. The people that will call you act like agbero and they will threaten you join your family. That foolish app has access to your phone contacts and calendar and they will disturb your life online and offline. The worst is the message they will send to all your contact telling them that your are fraudulent and that they will arrest you. The loan may not even be more than 10k as you have said. I swear,if God gives me power, I will burn down the Sokoloan company. That Chinese company is a no no. You can report the app on playstore and start giving them low rating. Stay away from Sokoloan

AFTER TAKEN SEVERAL LOANS WITH TIMELY REPAYMENT ON 14 OCCASIONS, THE LAST ONE I TOOK DURING THE DISTRESS OF MY CHILD BIRTH ALMOST RUINED MY LIFETIME REPUTATION. I WAS SO UNFORTUNATE ON THAT VERY EARLY HOUR OF THE DAY OF MY SECOND BABY'S DELIVERY, WHEREBY MY ACCOUNT WAS DEBITED IN EXCESS OF 92,000 THE SAME EARLY HOUR MY WIFE ENTER INTO LABOUR. THE DEBIT WAS AS A RESULT OF A TOURISM PACKAGE SUBSCRIBED TO WITH AN AGENCY, WHICH I WASN'T EVER EXPECTING AN AUTO DEBIT BELIEVING I DO TOURISM ANYTIME I DEEM IT CONVINIENT.

IMMEDIATELY I SAW THE DEBIT ALERT, I MOVED ALL MY REMAINING BALANCE TO ONE OF MY YOUNGER BROTHER'S ACCOUNT, TO AVOID ANOTHER UNEXPECTED DEBIT, UNFORTUNATELY AS I WAS ABOUT TO START PAYING THE BILLS AFTER GETTING TO THE HOSPITAL, MY BROTHER MADE A MISTAKE OF TRANSFERING THE MONEY BACK TO ME ON NEFT TRANSFER SYSTEM, WHICH WILL AUTOMATICALLY TAKES 24 WORKING HOURS BEFORE I CAN RECEIVE IT.

IMMEDIATELY I HAD RO TURN TO PEOPLE FOR HELP, AND ALSO GET SOME SMALL LOANS TO PAY MY BILLS.

I ACTUALLY DEFAULTED THE REPAYMENT AFTER THE 8 DAYS RUNNING INTO TWO WEEKS BECAUSE EVERY WAS LIKE TIGHT.

TO MY CONCLUSION, THEIR TERMS AND CONDITIONS NEVER STATED THAT YOUR PHONE CONTACTS WILL BE COMPROMISED AND A DEFAMATION MESSAGES WILL BE SENT TO ALL YOUR CONTACT. IT KILLING AFTER RECEIVING THIS MESSAGE AS ATTACHED.

second is which laws/rights have been infringed upon, then we gather.

so if any victim knows any competent lawyer, let him or her consult the lawyer and give feedback or better still post the contact details here albeit with the lawyer's consent.

For you to win such a case you need to prove that the loan company defamed you and that as a result of that defamation you suffered loss either pecuniary or otherwise.

Now let me ask, if you borrow money from a company then when the loan is due you suddenly start avoiding the company and you also stop picking your calls will you then deny that you're on the run?

The law works based on facts which can be proven.

The defence of the loan company is to tender evidence of the call log from the GSM company which shows that they called you at least 3 times and you did not pick the call neither did you bother to return the call, this alone is grounds to assume that you are on the run and hence declare you wanted by sending text messages to your contacts.

Nigerians if you take a loan make sure you pay back on due date as agreed! It is because of people like you who don't like to repay loans that the rest of us get charged high interest rates because the Nigerian market is considered as being high risk due to high rate of default!
