The offence contravenes Section 286 and punishable under Section 287 of the Penal Code. This could lead to the owner of the account paying a fine equivalent of 10% of the total money and also spend at least 2 years in jail and during this period return the total money to the owner.

What you need to do is that 1 you should not have spent from the money but reported it to the bank 2. Since you have spent from it do all you can to complete the money go to the bank you opened the account or head office of the bank in your State of residence and lay the complaints the complaints will be 3. You were erroneously transferred 3 million Maura into your account on so do date and you later observed your account was frozen and it has stopped you from your financial obligations and you are dissapointed in the bank for not informing your before freezing your account but you will give them a second chance that you have given them the mandate to reverse reverse the transfer to its original sender or it's original intended recipients and you want evidence of such and the account should be unfrozen. If any caller disturbs you tell the person the bank is already working on it. But you must complete the money before you can do all these.

Next time don't spend such money just be patient and lay complaints in the bank's branch you opened account or head office of the bank in your state of residence for them to put you through how to return the money to owner. If owner is a generous person you might even be given a token for your honesty and you have a clean sheet with no stain to your name.

Sarah told my mom to go to any nearest ........bank and write a mandate letter authorizing the bank to unfreeze the remaining #2mil in her acct and the bank will give us the beneficiary account which she will send the money back to. And we should return the money we spent out of it immediately.

When we got to my mom's bank, we went to customer agent area, instead of writing the mandate letter, we told the agent everything that happened leaving nothing untouched. the agent said we should give him the number of the staff that called us, when he called the Sarah with his phone, Sarah gave him another name, instead of introducing herself as Sarah, she said her name is Evelyn. She now told the agent to hold my mom down till she (Evelyn) gets to that bank to arrest my mom or whatever.

The agent said on what basis would he hold my mom down. The agent checked the description when the money was sent and he couldn't understand the description. He was saying how could this be government money. He told my mom to try and return the money spent and he told us to go.

Someone was owning different LOAN application certain amount, he has defaulted in repayment and they have been disturbing him and his close relatives and friends.
One day, a huge amount of money was mistakenly paid into his account. These funds were automatically removed by some LOAN APPS he's owing.
The sender contacted the bank to freeze the account but no funds in the account to freeze.
My question is , if such case is taken to the court of law can the owner of the account (the receiver) be enforced to repay the sender.
Remember he did not touch the money

1. It's a crime to use the money.

2. You people may get roped into a dangerous scheme — kidnapping or fraud.

Solution:

Make sure you replace what you have spent.

Ask your bank to reverse the money to the very account it came from!

No matter the threat from Sarah/Evelyn, NEVER you transfer that money to a different account apart from the one it came from!

Since she changed names between when she called the account holder and the account officer or customer care, she could be a yahoo agent trying to use your mom's account to pick maga's money in a clean way. Just keep an open mind.

1) Its Government money for procurement but sent to a wrong account.

2) Its Government/company stolen money, but deliberately sent to a wrong account so that it cannot be traced.

I will go with possibility 2.


Why 2?? If it was government account, she wouldnt need to change her name from Sarah to Evelyn.

Also, if it was government money, she wouldn't tell you guys to pay the rest little by little.

Also, if it was governments money, they would have invited you guys to the affected ministry for better discussion.

Money sent from the government account starts with FGN for federal or LASG, RSG, ONSG etc. for state governments.


Do this. Collect the account number they want you to send the money to. If it is an individual account, just know that they are going to put your mom in trouble. They are trying to use her account to steal money. Report to the necessary authorities.

NEVER SPEND MONEY SENT TO YOU IF YOU DO NOT KNOW THE SENDER. YOU SPENDING IT SHOWS YOU'RE PART OF THE SYNDICATE THAT STOLE THE MONEY.

If it was govt money or an honest mistake, the bank would have received a complaint officially, in which case the bloke they met would have seen the comment on the account.
So they either submitted court papers to freeze the account or it was frozen illegally ( man know man).
Best to report to EFCC. Na them go collect the money last last. Or they can bargain with the lady for 50:50 sharing lol. I can bet she would prefer not to raise dust.

There is something fraudulent with this money. Just be sure your mum's account was not used to collect Kidnappers ransom.
