Will it benefit me cos we were married for two years before the separation
Pardon my curiosity.

But please, why are y'all getting divorced after two years of marriage?

Sounds like a sad situation. What happened?

This is why i hate court marriage. If they had had normal marriage like traditional marriage or white wedding, both of them would have parted ways without all these headache.
But people get married with forever in mind, isn't it?

So the stress of a possible divorce isn't something people should think about.

Ok engage the service of a lawyer to file a cross petition immediately

Ask for custody of the child
Depending on his financial strength ask for 200k monthly child support (that is assuming his nature of work can afford it)

Also 15m general damage etc
A smart lawyer is all u need
200k monthly child support?

Will he also be paying the child's fees and other specific expenses separately?

That amount seems too small to raise a child.

Your "marriage" is not considered legal unless it is registered at the local government registrar of marriages where all marriages, traditional included, that take place within that local area, are registered. undecided

I'm still saying the same thing. There are people who did traditional marriage that didn't do those registration stuff. It may not be legal to them but it's legal according to their tradition.

They are not legally married....they did traditional but are not considered married by law in Nigeria since their marriage is not registered. They might as well be boyfriend and galfriend still but not married since marriage is only granted those who are legally registered as such. This isn't rocket science! undecided

Oga, it may not be recognise by the law of Nigeria but it's recognise by tradition and both families.

Baby, have you not contacted the Litigator yet?
Good evening, Klassic.

Thank you for the kind words. I had butterflies in my tummy. Never knew people noticed.

I believe she called and we had a beautiful conversation.

Believe me, some people are wicked and all they need is someone to show them pepper. So that next time, they will learn to do better.

If someone had told me that our marriage will pack up after two years, I wouldn't have believed it.
Let just say life happened and we fell out of love

If you had to do it all over again, will you marry or stay single?

Good to know you and the Litigator are in touch.
Thanks very much

It depends on the financial muscle of the husband bc the court will use dt to judge the case n amt he is to provide. If he earns salary the court will even ask for his pay slip to decide the amt he will contribute as child support.

If he earns 150k monthly may be as civil servant then 200k is excessive n court may not grant more than 70k monthly.

But if he is a Davido with 30billion in his account then court can grant 7million monthly

Seriously? And you expect a fair answer? Statistically speaking, you should get a biased response which isn't worth much.

3- years of separation? Make sure to get your fair share from the marriage before you leave it at least. I recently read of the Married Women's Property Act of 1882 and I believe you too can benefit from it too. undecided

The law you quote has clauses. the clauses are applicable to A wife with Children for the man.
only an irresponsible Man will chase His kids from his house.

There's difference between sharing the Man's property and giving shelter to your Children after divorce.

summary of your link

The court also restrained James from harassing Toyin any further or disturbing the quiet possession of the property by her and the children, holding that, “the rationale is that a husband who marries a wife and builds a house during the pendency of the marriage stands the risk of losing that house if he later divorces the woman who had children for him unless such woman, of her own volition, leaves the matrimonial home. Also, a divorced woman is not entitled to any maintenance allowance but maintenance of the children by way of settlement.”
