The 1999 CFRN guarantees the rights to fair hearing and to own movable and immovable property however when you read the proviso to section 42 you’ll see that these rights are not absolute. Thus, authorities can lawfully seize a property or obtain an interim order of seizure or forfeiture from a court of competent jurisdiction pending the completion of investigation. However, the victim must be given an opportunity to show cause why the property should not be permanently seized and that’s fair hearing. See DAME JONATHAN v. FRN. Whether or not fair hearing is given to the victims is a question of fact. The victims should go to court to void the sale if they feel their fundamental rights have been breached.

Either wrong or right, whoever felt offended can go to court to seek clarification on position of the law on such cases. The only exception I saw in the matter,is the case of one guy that was convicted, and served prison term of 3years, yet his vehicle still got auctioned.

A daft response by a govt apologist.

The lawyer is asking if due process was followed before this action and you are blaming those who cars were auctioned.

There are many places in Lagos where the one way signs are hidden or completely removed so that innocent motorists who are ignorant of the lay of the area are led into a trap.

Shame on you for pretending not to know this.

Everything about Lagos govt under Tinubu is a revenue drive that extorts and impoverishes the residents.

Every single one of those cars were sold to people connected to VIO, Lastma or Alausa.

That is immoral.
