As far as you agreed to adjust the payment to accommodate the issue he had with Lastma, then the contract is still 100% valid.

But you can take your car back if you are willing to refund all the money he has paid you since the contract started.

Your 04 camry shouldn't be shorting oil ..more than likely you bought a lemon. Those cars were in such huge demand that some had high miles on them .... I use the big daddy during my early years of uber..

When you bought yours did you verify the actual MILEAGE ? I can bet money that yours was bought high miles and the mileage was roll back before it was sold to you ... It only cost 5k to roll back mileage my brother......

Also it is 2007 to 2009 camry v4 that had a factory defect of oil shorten ........

Ps ... The more often you stress your car especially when use for e- hailing the more you burn more oil ..keep that in mind .. All these stop and go and traffic hold up, local driving stresses the car alot more than highway driving .......

Now I keep saying this is why I use Honda Civic 03 to 05. Those cars were built specifically for low maintenance. They were design for that and they have the lowest maintenance cost ....

And from experience I never had oil shorten issues unless from worn out oil seals or bad pcv values.. I have mention these couple of times.. Samething with my elantra 07 to 08 never had issues with oil shorten..

If you know you will be using your car for e hailling make sure to use full synthetic oil and follow owners manual ... Using the correct grade oil will also help you to save on petrol consumption.

I have a small fleet of cars on uber for the past years now .. My experience is well documented here ....i know what am talking about

Please you talked about rolling back mileage, please how can someone know if a car mileage have been rolled back

Sir, he didn't give me any reason why he wants to use the car for 2 weeks
He just requested and ordered me to bring the car for him on 23rd Dec. That he wants to use it for personal use, if he had told me his dad needs a car for that period, I could have suggested to drive the car myself that period while they just fuel it and the money I'm supposed to pay for the 2 weeks be deducted from my total balance to serve as payment for the service I'm rendering for the 2 weeks but he didn't give any reason, he just came at me and said he wants to use his car for 2 weeks, below is the chat I got from him from the day he asked me to bring the car till date...

You will see it if he gives me any reason

Well said bro. This is by far the most unemotional response to this issue I've had to read so far.

In my own opinion the partner is not looking at this as a strictly business relationship and hence the reason for all this back and forth.

Using terms like aged father, default payment and granting favours, to me is just emotional blackmail.

@Car Owner this is the way I see it since it's HP. If you need the car for 2weeks then you should be the one negotiating how much you'd pay for the 2weeks. Please note, Omoapena is a business man and probably has his own plans for same period.

Firstly, that agreement you signed with him is flawed and has a lot of strict rules. Two weeks default is too short to allow a partner withdraw a car on a higher purchase deal. So, if you have paid 1.5 million of 2.5 million naira deal, you will lose the car because of two weeks default.?

Secondly, you have no business informing him about the repairs nor bringing the car for inspection since it's a higher purchase deal. Why would he even include that in the agreement? His only business with you and the car is to be receiving his money as at when due. Whatever happens to the car is none of his business. He's been covered by the agreement that states that he has the right to withdraw the car should you fail to make payment within a stipulated period of time.

A friend is facing same problem with his partner. The guy is on rental yet uses his money to fix all problems with the car and the partner does not care. If the guy has an option, he would have long dumped the car. He asked the partner for a hire purchase agreement since he's the one doing all the repairs but the guy refused because he's enjoying his weekly rentals with no obligation.

I wonder why people feel so high when they give out a vehicle to another. The response from your partner here shows the kind of person that he really is. Imagine drawing the battle line here, for what exactly?

You sound like a sincere person to me and you are the kind of person I would love to work with. It's unfortunate that sincere drivers get hooked with irrational partners and same with reasonable partners.

If his dad needs a car for movement, he should release his own car. He knows what he's asking for is wrong but because he's the car owner, you should come crying on your knees to oblige his request.

My bro, keep up the hard work and pay off this guy as soon as possible. You deserve your peace of mind.

And next time, dispute anything you feel isn't right in an agreement that you are signing up for in a business relationship.

You're the one portraying yourself as messiah here, I didn't come to nairaland to give story, I only said my partner demands to use the car for 2 weeks despite what we have is hire purchase and I asked them what should I do, you were the one who saw it and felt you want people to know you gave me the car for 3.3m total, I see no reason why you will even disclosed the total amount we agreed on if not because you want people to see you as a messiah... yes you're a messiah cuz to go by the current price of car, its a huge favor but this favor you're giving comes with heavy pressure and burden which are unnecessary....

A favor with stress is no favor, I've always from my end been making sure your money comes regularly, sometime I pay on Sunday if it happens that work moves well that week and sometimes on Monday that we agreed, I have been spending money on this same car every week but I'm not saying all that cux there's no reason why you should know, cuz I want to make sure the car stays in good condition so it doesn't mess me up and affect the payment I'm to pay to you..

Anyway, I don't need a lawyer, if you file lawsuit and they go through the agreement we had, they will rule out where I have breached the contract and also, stop this muscle you're flexing, I know you will be thinking you are ready to spend money to retrieve the car and you don't care how much you will spend to do so, but on the other hand, have a deep thought about it...

Except u put it there that if he doesn't do your bidding or if he lies against u, u will retrieve the car. Then u r just going to waste your money in court. Infact your lawyer will advise u if u bring this matter to him.
But if u just want to be wicked and use power and injustice to get the car back, at the end, God will be the judge.

Thank you for this, I will always take the car for inspection every month now, I just felt if his money is coming regularly, there will be no need for the inconvenience but since he's making issue out of it, I will always fulfill that, it takes me nothing to take it for inspection every month...




His lawyer won't tell him the truth, he knows he will make money off him and he's just after the money he will make, there was a time the lawyer just said if I'm giving him issue, he should order him to go collect the car, I just laugh the lawyer, on what ground will he be retrieving the car, on stress ground where as he's the one giving himself the stress...

Lolz...it's beyond the funds. Except driver accepts to that. If not, this contract will be seen to it's end.

On d part of Owner; Car has depreciated.
On the part of driver; monies have been spent on repairs that's not documented.

Business is business, there should be no emotional attachment or friendship in business.

Just because you have the means or you pull the major resources in a business doesn't mean you should breach a contractual agreement.

What exactly should the hirer be doing when the car has been taken away for 2 weeks? He has a family to take care of, he has responsibilities to carry out and if he's making payment as at when due, I see no reason why issues like this should come up.

Most Nigerians don't show their true colours until they're in a position of power.

Olorunkemi is in Bariga LCDA. Bariga is in Shomolu local government.

Yaba is an LCDA in Mainland local government area even though it shares boundaries with Shomolu.

So, Bariga, Gbagada, Fola Agoro are all in Shomolu local government.

Also note that some part of Gbagada are situated in Kosofe local government, just the way Onipanu, Palmgrove and co. share local governments between Shomolu and Mushin depending on which side of the road.
