As if that's how they terminate contract, " bring my vehicle this weekend". The moment you signed that contract, the vehicle no longer fully belongs to you UNLESS he defaults by not paying you. Just know this before wasting your money. As far as you agreed to adjust the payment to accommodate the issue he had with Lastma, then the contract is still 100% valid. Barbiturate: Sir, he didn't give me any reason why he wants to use the car for 2 weeks He just requested and ordered me to bring the car for him on 23rd Dec. That he wants to use it for personal use, if he had told me his dad needs a car for that period, I could have suggested to drive the car myself that period while they just fuel it and the money I'm supposed to pay for the 2 weeks be deducted from my total balance to serve as payment for the service I'm rendering for the 2 weeks but he didn't give any reason, he just came at me and said he wants to use his car for 2 weeks, below is the chat I got from him from the day he asked me to bring the car till date... You think what you said can't be defended, despite everything I have done for you as well, I can't believe you can be having this issue with me and that's because you want someone to dance to to your tune, always know people have opinions as well, you can't always expect people to do things the way you want it... If you say I breach contract of not bringing the car for inspection monthly, when was the last time I took it for inspection, last month right?, why didn't you file a report to retrieve it before I took it for inspection last month? You're only saying this cux I refused to not give you the car, you can only terminate the contract if eventually I didn't bring it for inspection this month and you use it against me next month, you can't use it against me cuz I took it for inspection last month and that had balanced that... Well said bro. This is by far the most unemotional response to this issue I've had to read so far. In my own opinion the partner is not looking at this as a strictly business relationship and hence the reason for all this back and forth. Using terms like aged father, default payment and granting favours, to me is just emotional blackmail. @Car Owner this is the way I see it since it's HP. If you need the car for 2weeks then you should be the one negotiating how much you'd pay for the 2weeks. Please note, Omoapena is a business man and probably has his own plans for same period. Djdamian: Smiles, You're the one portraying yourself as messiah here, I didn't come to nairaland to give story, I only said my partner demands to use the car for 2 weeks despite what we have is hire purchase and I asked them what should I do, you were the one who saw it and felt you want people to know you gave me the car for 3.3m total, I see no reason why you will even disclosed the total amount we agreed on if not because you want people to see you as a messiah... yes you're a messiah cuz to go by the current price of car, its a huge favor but this favor you're giving comes with heavy pressure and burden which are unnecessary.... A favor with stress is no favor, I've always from my end been making sure your money comes regularly, sometime I pay on Sunday if it happens that work moves well that week and sometimes on Monday that we agreed, I have been spending money on this same car every week but I'm not saying all that cux there's no reason why you should know, cuz I want to make sure the car stays in good condition so it doesn't mess me up and affect the payment I'm to pay to you.. 1 Like

I only asked them for advise on how I should go about it and they said its not done in HP but when you want to interfere, you brought the whole agreement we had and you even copied some parts out and even let them know the amount you gave it to me, why didn't you just counter the advise I came to ask by saying you needed the car and you asked me... Anyway, I don't need a lawyer, if you file lawsuit and they go through the agreement we had, they will rule out where I have breached the contract and also, stop this muscle you're flexing, I know you will be thinking you are ready to spend money to retrieve the car and you don't care how much you will spend to do so, but on the other hand, have a deep thought about it... I have to go and work so as to pay your money, when I receive the lawsuit, I will show up with my lawyer in court but pending when you will win over the case in court, we are still binded by the contract and I have my part to fulfill.. 17 Likes |

Djdamian This is what I posted on NL that triggered you, I brought it here to ask for few advise so that when you talk about it again, I will know how to go about it with the advise I get here but you felt you're entitled to it without any dispute from me n for that reason of your entitlement, you brought the whole deal here and now you're saying I'm the one who brought it, how did I? You just want people to say you're entitled to collect it anytime you like cuz you're doing me a big favor, I don't even know why you will have that thought, we are doing business brother... if you had told me your dad needs a car for short period, I would have suggested I drive the car myself so I can still know the condition the car is but just because you have it in your head the car was bought by you and still belongs to you, you felt you can command and ordered me anyhow.... Djdamian... calm down, I know u are upset but u can't retrieve car because u feel insulted or betrayed. The terms of retrieving the car is clearly spelt out in the contract. Except u put it there that if he doesn't do your bidding or if he lies against u, u will retrieve the car. Then u r just going to waste your money in court. Infact your lawyer will advise u if u bring this matter to him. But if u just want to be wicked and use power and injustice to get the car back, at the end, God will be the judge. Omoapena... I think u should stop responding to him here. If ur contract says u should bring car for inspection everyday and u signed to it, pls honour that contract. Just follow your contract to the letter and u will have God and man fighting for u. Keep me posted, but make sure u r fulfilling your own part of the deal. 6 Likes |

Pearl1910: Thank you for this, I will always take the car for inspection every month now, I just felt if his money is coming regularly, there will be no need for the inconvenience but since he's making issue out of it, I will always fulfill that, it takes me nothing to take it for inspection every month... His lawyer won't tell him the truth, he knows he will make money off him and he's just after the money he will make, there was a time the lawyer just said if I'm giving him issue, he should order him to go collect the car, I just laugh the lawyer, on what ground will he be retrieving the car, on stress ground where as he's the one giving himself the stress... |

Business is business, there should be no emotional attachment or friendship in business. Just because you have the means or you pull the major resources in a business doesn't mean you should breach a contractual agreement. What exactly should the hirer be doing when the car has been taken away for 2 weeks? He has a family to take care of, he has responsibilities to carry out and if he's making payment as at when due, I see no reason why issues like this should come up.
