Lanrygold:Read through your 2022 Electoral Act and learn. 2022 No. 13 Electoral Act, 2022 64.—(1) The presiding officer shall endorse the word “rejected” on the ballot paper rejected under section 52 (1) of this Act and for any other reason, and the ballot papers shall not be counted except otherwise allowed by the returning officer who may overrule the presiding officer. (2) If an objection to the decision of a presiding officer to reject a ballot paper is raised by a candidate or a polling agent at the time the decision is made, the presiding officer shall add to the word “rejected”, the phrase “but objected to”. (3) The presiding officer shall prepare a statement on rejected ballot papers, stating the number rejected, the reason for rejection and their serial number, and he or she shall on request, allow a candidate or a polling agent to copy the statement. (4) A collation officer or returning officerat an election shall collate and announce the result of an election, subject to his or her verification and confirmation that the— (a) number of accredited voters stated on the collated result are correct and consistent with the number of accredited voters recorded and transmitted directly from polling units under section 47 (2) of this Act ; and (b) the votes stated on the collated result are correct and consistent with the votes or results recorded and transmitted directly from polling units under section 60 (4) of this Act. (5) Subject to subsection (1), a collation officer or returning officer shall use the number of accredited voters recorded and transmitted directly from polling units under section 47 (2) of this Act and the votes or results recorded and transmitted directly from polling units under section 60 (4) of this Act to collate and announce the result of an election if a collated result at his or a lower level of collation is not correct. (6) Where during collation of results, there is a dispute regarding a collated result or the result of an election from any polling unit, the collation officer or returning officer shall use the following to determine the correctness (a) the original of the disputed collated result for each polling unit where the election is disputed ; (b) the smart card reader or other technology device used for accreditation of voters in each polling unit where the election is disputed for the purpose of obtaining accreditation data directly from the smart card reader or technology device ; (c) data of accreditation recorded and transmitted directly from each polling unit where the election is disputed as prescribed under section 47 (2) of this Act ; and (d) the votes and result of the election recorded and transmitted directly from each polling unit where the election is disputed, as prescribed under section 60 (4) of this Act. (7) If the disputed result under subsection (6) were otherwise found not to be correct, the collation officer or returning officer shall re-collate and announce a new result using the information in subsection (6) ( a)-(d). ( Where the dispute under subsection (6) arose at the level of collation and the returning officer has satisfied the provision of subsection (6) ( a)-(d), the returning officer shall accordingly declare the winner of the election. (9) A returning officer or collation officer, as the case may be, commits an offence if he or she intentionally collates or announces a false result and is liable on conviction to a fine of N 5,000,000 or imprisonment for a term of at least three years or both. |

nnamdi640: Saying the election was rigged many times doesn't make it rigged, you need to do better by proving it. i have not seen any Nigerian body, especially government keep strictly to its promise so i really can't see the miracle you are looking for here. Government gave deadline for NIN, for BVN, for cash swap. It didn't happen, exactly as we all know. They've declared emergency on power sector, security, education sector, health sector, corruption, all to no avail. No show. But you suddenly think IREV will be uploaded 100% on election day. On what basis do you believe this, who gave you such faith and trust in the Nigerian system? That being said, IREV will be uploaded 100% one day but it doesn't change anything. Like i said already, it is like uploading a scanned copy of your documents online. It is not greater or more powerful than your original documents. The original documents were brought to collation center LIVE. Certificate of return has been issued. What you have to prove is to tell if there are discrepancies between the original and the uploaded. Otherwise, court and tribunal cases will be thrown out. There's an ongoing court case in Osun state. Many APC sitting governors and stalwarts lost election and their states, so i don't get what you mean by back fire. 1 Like |

Lanrygold: You seem to be a novice in Nigeria politics. After the counting and recording of an election result at a polling unit, the agents of the different political parties signs and depart the polling units. They do not follow the INEC officials in their vehicles to the ward. Hence between the polling unit and the ward, the result can be altered by the INEC officials. The results from the wards can again be altered as it is taken to the Local Government. Note that after these results are altered, it will still bear the signatures of the party agents who signed the document before it was doctored. Hence the only way to get an authentic result is to transmit result directly from the polling unit to the INEC server through the BVAS immediately the results are realised at the polling units. Unfortunately, APC in collaboration with INEC officials sabotage the immediate transmission of result . They then hacked the System and also altered the transmited results. |

The law gave room for electronic transmission from polling units, which would be provided for by the INEC. Which INEC had umpteenth times said, the transmission would be done using BVAS. It results are not transmitted at the polling units using BVAS. INEC have breached the law. Section 64 of the electoral Act is very explicit: 64(4) A collation officer or returning officerat an election shall collate and announce the result of an election, subject to his or her verification and confirmation that the— (a) number of accredited voters stated on the collated result are correct and consistent with the number of accredited voters recorded and transmitted directly from polling units under section 47 (2) of this Act ; and (b) the votes stated on the collated result are correct and consistent with the votes or results recorded and transmitted directly from polling units under section 60 (4) of this Act. So funny how some Nigerian can be , the party agent from each polling unit has a returning Oficer for each ward in which the agent delivers it copy of results to and now with our exposure on technology they took pictures of their results and send them to their returning officer for the ward same procedure took place to the federal level so if anyone should be talking of polling irev party are far from it because they know and they also follow this procedure. They know they lost base on their report collated from their situation room. The things is the result from your polling unit may still be canceled due to over voting at the ward collation so y’all need to understand that aggrieved party is seeing this as opportunity to use faulty aspects of the once that does not concern the collation |

IfnobeGod20: No law was breached, it simply gives them power/legality to transmit using IREV. IREV is not the only means of transmission. Asides transmission is collation and announcements. You don't need IREV or BVAs for these. They are just to help the process, not compulsory for you to collate or announce. |

Image123:Not only people that lost the election but all parties involved in election management, how they sabotage the system by not following the rules. I went to copy it just because of you that is arguing blindly on the veracity of the use of technology to transmit results from the polling units. The first step of the results after counting is transmission. The law never contemplate the use of manual report to the ward level, even after the votes have been recorded manually but to be transmitted by technology that will be provided by INEC. And in this form. INEC provided BVAS to be used to transmit it immediately. The question now is, do they do that immediately? Go back and read the law very well and this time around do it slowly and with no bias mind. |

Let me school you further, even though I am not a lawyer but just using my common sense that is not common. Section 60 of the Electoral Act states that “the presiding officer shall, after counting the votes at the polling unit, enter the votes scored by each candidate in a form to be prescribed by the commission as the case may be”. More so, section 60 (5) of the Act states that the presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the commission”. Now, what was prescribed by the commission? The prescribed manner here is the BVAS, which INEC introduced to ensure that the electoral process is credible. The BVAS was introduced by INEC in line with Section 148 of the Electoral Act, which gives INEC power to make guidelines and regulations to ensure the full effect of the law. Can INEC now turnaround and say its never introduced BVAS to transmit results from polling units for the credibility of the polls? |

Cmon why can’t you be stay consistent in thought, you just posited that only a governor without capacity will be unable to perform without alignment with the federal government. My argument is to show you a great example of a governor with capacity in fashola who despite his capacity was unable to build the redline because of non-alignment with the center. As for the links you posted; there’s no correlation. We know for a fact that approval is not exactly equals to execution. A good example is the many MOUs signed in Anambra state. If the projects were executed when signed Buhari wouldn’t have had to commit resources to doing same. |
