I'm telling you what the law that I've read and actually practice is and you're quoting what you got from Twitter for me.

The INEC chairman has the power to overrule or change the guidelines . It's his inherent power.

Let me give you a practical example. Paragraph 2 of the INEC guidelines states that Governorship elections must be conducted two weeks after Presidential Elections, when INEC couldn't reconfigure the BVAS before time, they gave a directive that it should be postponed.

They have the right to shut down the Portal because of millions of cyber attacks they claimed happened during presidential election and proceed with the best mode of collation as long as the electoral act does not specify.

An opposing directive that comes from INEC invalidates the content of the guideline as long as the Electoral Act is silent.

See screenshot from INEC guidelines about the date of conducting Governorship Elections.
but they issued the new directive publicly before the governorship elections it wasn’t a case of not conducting the governorship election and not issuing a memo

Didn't INEC put up notice to the print, electronic and new media to inform Nigerians on the reason for the Postponement and the new date for the election?

You guys will keep on bringing up useless argument, when everything explain are as clear as black and white

Okay back to the guidelines. Please share an amendment to the guidelines that made INEC postpone the Governorship Election?

The law does not tell INEC to set out guidelines. It states in section 60(5), that the results will be transmitted in a manner prescribed by INEC. That is an administrative power. As long as the law is silent about transmission, manual transmission is not a substantial irregularity.

The guideline is an administrative guide by the INEC chairman to guide his staff and political parties. Just like he promised on TV or wherever, he can change it. It his discretion. According to section 135 of the ACT, it isn't enough to cancel the results of the election.
Are you making reference through amended electoral act or from old one? I knew the electoral act was amended on this second term of Buhari's administration.

Why do you have ELECTORAL laws if YOUR INEC CHAIRMAN IS ABOVE THEM?

We should follow the “INEC guidelines” when they deviate from the “electoral act”?
IS INEC CREDIBLE GIVEN SUCH POWERS?
Especially when THE CRIMINAL CHAIRMAN IS AN APPOINTEE FROM THE DRUG BARON’S TEAM(Thanks to Amaechi for letting us know). grin

Electoral laws are there to PREVENT CRIMINALS LIKE YAKUBU MADMOOD from wriggling around them like a salted, slimy worm AND TO PROTECT THE MANDATE OF THE PEOPLE FROM POLITICAL LOW-LIVES LIKE ALIBABA TIEFNUBU AND HIS FORTY FEMI THIEVES!

What da phock do you mean? undecided

So ANY unscrupulous INEC CHAIRCRIMINAL should overturn the signed electoral act in favor of the highest bidder or deepest pocket?

And the next INEC CHAIRGOAT will do the same UNCHECKED? undecided

You are thinking like a CONVICT yourself.✅

The electoral guideline stipulated by INEC becomes law once the elections has taken place. If it will not be adhered to, then there should be a reelection.

Expecting the US government to confirm the authenticity of a case without providing material evidence is a waste of time.
You want to tactically sway them to your side on matter of National Security of Nigeria sovereignty, and put the US government bilateral trade in jeopardy since the person concerned would have been sworn in as the Commander in Chief.

Nothing would likely change on that.

I humbly disagree with this submission.

The 2023 election guideline is 100% backed by law. Bc that's what the law mandates INEC to prescribe.

So they can't go against their own guide.

Stop talking nonsense.the supreme court has said timelessly that inec guidelines cannot be used to nullify elections.see atiku vs buhari supra

What is your problem, don't bring tribalism to this again. Let the court do the needful, don't come here and start your propaganda again. This is a case between two opponents and not between tribes. Mr man don't let Ogun strike you for this act you want to commit, the man is not satisfied with the way election was handled and he went to court, so why bringing tribalism to this. This is same propaganda you guys used in Lagos just because you guys wanted to win by all course, remember that things like this can backfire, I just pray you will live to witness the dangerous act you guys want to commit. Assuming the man was causing violence with his people then you can be saying this but as a wise man he went to court to settle the matter and you are here dragging tribalism to this, now I know that civilization left some of you guys long time ago.

That's how they said Labour party has no structure that it's just 4 people in a room, Peter obi shocked all of them, they said again that Labour party won't have 25% in any northern states, Peter obi shocked all of them again, the said again that Peter obi won't win any northern state, Peter obi shocked all of them.

That's how Peter obi would shock them in this court case when he brings evidence that will shake Apc to it's foundation.

It's just like Pablo Escobar, when he won his election in the 80's he was shocked that a harmless mugshots police officers he refused to bribe and had taken of him years ago was what brought him down.

US releasing statements condemning the Lagos violence and promising sanctions too says alot.

When they were insulting Peter obi on live TV despite him ignoring them, they were jumping up and down.
