You would like to move to Canada from the UK? I lived in the UK and then in France. It was a carefully thought out decision not to move back to the UK but to Canada from France.

Many Brits are moving to Canada. Most of the expats that moved to Canada and went back to the UK regretted it.

Check out the Facebook threads on British Expats living in Canada, you would learn a lot, especially as you are currently in the UK.

Word of advice, thread carefully cause iRCC has sth called information sharing. This is a check done on an applicant by getting information about the applicant from other partners or countries. therefore, it is highly likely that they would be getting the information from USA and that is an automatic misrepresentation.

You could try stating the previous wedding was a traditional marriage and you just did the legal wedding in your LOE. That might work.

You might also want to hold on with the wedding and finish your process then invite him over. That's safer in your case and now, Canada recently made a policy aimed at speeding up the processing time for spouse. Good luck

It might be best to come clean.

One of the reasons - even without adding him to your application as spouse, if Canada and USA share very detailed info like marital status then you may already have a discrepancy between your info on eAPR (single) vs US (married). Haven said that, we can't say for sure what data US has for you (maybe name, date/place of birth, but no biometrics) since it wasn't you who applied for a US visa.

If you add him, obviously he will need to answer YES to the question about being denied a visa, if further details are required, he would mention the year and type of visa.

I was going to ask if he provided a marriage certificate to the US and if it was got from the registry (I'm not sure it matters though). Coming clean also means you may need to provide chats, emails, photos etc. to show the relationship is genuine.

It is likely delaying the inevitable and that is why I would like to explore resolutions at this stage, if possible.

I am liking the idea of explaining that the previous was a Trad wedding and the one in June 2023 will be the official one and that was why I inputted single as my marital status in NOV 2022.

Yeah, i understand. If you had pictures of a traditional wedding, you could use that as proof that you did 2 weddings and since IRCC only recognises the official wedding, you could only start your application as a single applicant and now, you are officially getting married legally.

You'd definitely have to tell IRCC about him being denied - that's very easy for IRCC to check and people get their applications refused all the time for saying NO to that question when they should have said YES.

See this judicial case where the husband was deported from Australia some years before their application, not visa refusal o, deportation! She wanted to confess.....consultant/agent say make she no worry, las las they rejected her for misrepresentation but she went for a judicial review saying her intension was to disclose (showed evidence of that whatsapp messages with consultant), judge ruled in her favour for another VO to take a 2nd look at her application: https://decisions.fct-cf.gc.ca/fc-cf/decisions/en/item/522068/index.do?q=express+entry+deported+consultant. In summary, previous visa refusals or deportations are not an issue, but hiding them is!

Come clean - meaning explain his being married in US application. You could say it was ill advised and you realize the error of such an action and say you thought it best to be 100% truthful in your current application. On the US front - you could decide not to go to US till you get Canadian Citizenship......if you no wan explain yourself twice smiley

I don't think it will have a negative effect so long as you are the one who owns up to it........it's when they find out themselves that yawa usually gasses!

We may imagine that they cannot tie your first name and his last name to you (again I cannot say for sure how detailed their checks are.... the US DS160 gives room to give spouse date of birth and place of birth), but suppose we are wrong and they ask for additional information nko.

this is a bad idea. Do not try this. You want to take a loan and still bring in children. What happened to only one person going With a dependent visa do you think your spouse will get a well paying job that can cater for the family ?? Mostly no. Loan, cost of living, rent for 2 bed room etc. abeg o

Please hire a Canadian immigration lawyer.
It’s always risky providing information that wasn’t asked of you so giving details of why he included you as married in his application may actually cause you more problems. I’m not sure the EE application asks anything about who you applied with. All they ask is that you declare any refusals.

Plus, it’s not your name on that application. He wrote your first name and his surname e.g Ravissante Femme, but your own name is Ravissante Partenaire. They are not the same person.
And he could have been married to another woman at the time he applied to America. will you be worried about not disclosing that?

A lawyer is additional cost, but it’ll save you plenty of worry.

But if na me, I’ll do as you originally thought to do: Apply single, get married after AOR and then add him as a dependant.

Let him answer questions truthfully
Q- were you ever refused a visa
A- YES
Q- provide details
A- I was refused a US study visa in 2021 and 2022. No detail or explanation was given for the refusal
(America no dey give reasons on why they refuse you)

May be you should contact an immigration lawyer. Always better to be truthful and consistent in applications and all we do. In addition adding a spouse post ITA may led to the recalculation of your points. I'm not entirely sure what the policy on that is

I will also advise waiting to complete the PR process and sponsoring a spouse. However, it all depends on the parties involved. Couples don't always agree on this because of how difficult long distance relationships can be coupled with how the canadian spousal visa sponsorship rules has over time led to the separation of families and in some cases fueled the dissolution of marriages.

I've carefully read your messages and responses but unfortunately no one made mention of something very important;
I believe you know that the moment you include your spouse post ITA, your CRS scores will.be recalculated with your spouse information and if the score doesn't give you the minimum score they used to give you ITA, you won't pass the eligibility.

Then about the wedding issue, LOE should do by explaining the first wedding your partner meant was traditional as long as he didn't provide information on court wedding. Canada will know every minute information he shared in his US VISA APPLICATION REJECTION, this I assure you.
Weigh your options, whether to go alone and invite him..it's all about sacrifice or go with him knowing fully well that your application will be scrutinize base on the US rejections and the misrepresentation as result of getting married twice. If found guilty, it's 5 to 10 years ban and even after the likelihood of your dream to canada might be up in the air. It's all about sacrifice and making a decision to live with.

You really are in a predicament. Marriage by proxy is accepted provided it took place outside of canada and registered in a country that recognizes proxy marriages as legal, but also common law partner is accepted and I am worried that if you mention that you had a traditional wedding it may be regarded as such and hence call for misrep. I do however agree with everyone as they say tread carefully because US and Canada do share every minute detail of immigration applicants.
Here is my opinion, do not include spouse at this point, make sure you are in the clear before entangling yourself. Its a sad reality and may be detrimental to your marriage but I am of the opinion that Canada PR is difficult enough as it is without adding other reasons to have your application scrutinized. hold off on the wedding until you have COPR then continue and sponsor him to come even if it means on TRV at first.
In short I am saying; get your foot through the door first. Do not give them unnecessary "ammunition" to use against you.
Worst case scenario they request for ADR or Procedural fairness. At which point you will need a lawyer and then present every piece of information pertaining to the 2022 US visa denial.

What do you mean by working VISA? You are setting yourself up for scam already. The possibility of getting a job offer in canada from outside Canada is almost impossible. Yes people say this and that but don't fall for it. If you know the process that's involved for a company or an establishment in canada will go through, documents to sign and panel to face for giving a job to someone outside the country.

If any such agent exists, they charge in the ranges of 25k-50k depending on the teer level. In which case you would have paid yourself your annual salary as whatever money they pay you will only go to refund the money you forked out for the job. Not to mention that its illegal for the employee to pay for LMIA or to secure a job.
And to add insult to injury, there are plenty of people already in Canada on visit visa applying for jobs and not getting due to their immigration status, leave alone you who is all the way in Africa.
But in the event that you do find one, I am also interested. grin

What do you mean by working VISA? You are setting yourself up for scam already. The possibility of getting a job offer in canada from outside Canada is almost impossible. Yes people say this and that but don't fall for it. If you know the process that's involved for a company or an establishment in canada will go through, documents to sign and panel to face for giving a job to someone outside the country.

If any such agent exists, they charge in the ranges of 25k-50k depending on the teer level. In which case you would have paid yourself your annual salary as whatever money they pay you will only go to refund the money you forked out for the job. Not to mention that its illegal for the employee to pay for LMIA or to secure a job.
And to add insult to injury, there are plenty of people already in Canada on visit visa applying for jobs and not getting due to their immigration status, leave alone you who is all the way in Africa.
But in the event that you do find one, I am also interested. grin

I believe you know that the moment you include your spouse post ITA, your CRS scores will.be recalculated with your spouse information and if the score doesn't give you the minimum score they used to give you ITA, you won't pass the eligibility.
