fabolouz1:Mr. Man, breached of any enabling laws, guidelines or the manual for the election invalidate the election according to section 65 of the 2022 Electoral Act. Read below: Section 65 Nigeria Electoral Act 2022 Decision of returning officer on ballot paper (1) The decision of the returning officer shall be final on any question arising from or relating to – (a) unmarked ballot paper; (b) rejected ballot paper; and (c) declaration of scores of candidates and the return of a candidate: Provided that the Commission shall have the power within seven days to review the declaration and return where the Commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations and guidelines, and manual for the election. The last paragraph is even the cruise of everything. The commission even reserve the right to void an announced results within seven days wherein its detected that the declaration was done against the provisions of the law and guidelines and manual for the election. 'footnote' Breached of: 1. Provisions of the law (both constitution and Electoral Act) 2. INEC guidelines 3. INEC manual so provided The breached of any of these three can render the election null and void according to Electoral Act quoted above. |

senatordave1:How would they bring what is not front loaded at the pre-hearing? My brother, you're more than this. Even at that, the content of the news therein doesn't exonerated or dispelled transmission of results by the polling officer. If you read it with keen interest and not with bias mind. |
Re: Tinubu’s Victory: AIT Broadcaster Ijeoma Osamor Testifies For Peter Obi by senatordave1(m): 1:08pm On Jun 17, 2023 |
IfnobeGod20: Obi has been bringing things that are not front loaded.why it was rejected was not because it wasn't frontloaded but because it is premature.it will be brought again once the defence session starts son |

olisaEze:Even if Tinubu-backed Tribune ever carried such a story, it's no official INEC statement because whenever INEC Chairman made official statements, he would be flanked left and right by other INEC officials. So such a story by Tribune - if ever it existed - was a business of Tribune and Mahmood Yakubu. Nigerians trooped out to register and vote because of the official vow made by Yakubu Mahmood flanked left and right by other INEC officials in November 2022. Yakubu Mahmood's vow was: [no other method except electronic transmission of vote results from the BVAS to INEC portal should be used for the general elections of 2023 in Nigeria]. 1 Like |

onuman: We dey talk A you dey talk B, who's following you to discuss all that, my guy stick to topic! Does INEC's rules/regulations and the Electoral Act allow for alternate processing when electronic means fail? If you like spend 1 zillion, if the process and procedural documents allow this then there's not a damn thing you or anyone can do! |

bentenny: I suggest you go and read clause 48 and 93 properly, this time very slowly and try to comprehend! |

IfnobeGod20: This is why we have the court system, now go to court and argue that INEC's rules and regulations is not in tandem with the Constitution or the Electoral Act.......Watch as the judge laughs you out of the court |
Re: Tinubu’s Victory: AIT Broadcaster Ijeoma Osamor Testifies For Peter Obi by bentenny(m): 3:41pm On Jun 17, 2023 |
abbey621:Guy i have read the clauses and it has nothing to do with the reason i replied you! You tried to make nonsense of the legitimacy and authority bestowed on rules and regulations of INEC by the amended 2022 electoral act of which i called you out and corrected you! Go back and read my previous reply but just take your own advise and read it slowly! |

bentenny: Then you obviously have trouble comprehending simple English. Here's your initial comment: It was not just said,it was also documented as rules and regulations of INEC which is an extension of the electoral act and holds as much power and binding authority! Your comment would make sense if clause 48 and 93 did not exist which gives INEC the right to use alternative method when electronic coalition and transmission fails. Now what exactly is your argument? Are you saying those clauses are irrelevant? Did you read them? Goodluck convincing a competent court that they don't matter |

senatordave1:I hope you read the objection of the lead examiner to the witness? We shall see if it would be brought again during argument. I always think you're a refined person but your foul language gives me a second thought. How would you go low to call someone you don't really know a son in closed forum like this? Desist! |
Re: Tinubu’s Victory: AIT Broadcaster Ijeoma Osamor Testifies For Peter Obi by IfnobeGod20: 6:09pm On Jun 17, 2023 |
fabolouz1:I am sure you didn't read or somehow lacked comprehension. You said, how would not following INEC guidelines invalidate an election and quoted what the law says. It was written boldly why a return can be invalidated. That is not following constitution, electoral Act, INEC guidelines and Manual for the election. I quoted it verbatim for you and with little explanation underneath as footnote but you still went asking another question, meaning you didn't read it or just lacked comprehension. |
Re: Tinubu’s Victory: AIT Broadcaster Ijeoma Osamor Testifies For Peter Obi by abbey621(m): 6:09pm On Jun 17, 2023 |
bentenny: Again na comprehension be your problem, Mahmoud said this Mahmoud said that but it does not mean his words will supersede what is officially written as rules and regulations. Yo usaid it was written that electronic transmission was mandatory, I provided you with a counter via Clause 48 and 93, yet you still dey argue? Na wa o |
Re: Tinubu’s Victory: AIT Broadcaster Ijeoma Osamor Testifies For Peter Obi by senatordave1(m): 6:35pm On Jun 17, 2023 |
IfnobeGod20: Sorry about that...they will bring it under subpoena as lp are doing |
Re: Tinubu’s Victory: AIT Broadcaster Ijeoma Osamor Testifies For Peter Obi by bentenny(m): 7:02pm On Jun 17, 2023 |
abbey621:On the contrary you are the one that can't comprehend what you wrote but even denying it shamelessly! You told someone INEC boss utterance about the electronic transmission of results lacked the needed powers and doesn't translate into being documented! In my reply,if you read correctly,i said he wasn't speaking without using the rules and regulations of inec which was formulated by the powers given to the commission by the amended electoral act! In a fruitless attempt to save yourself from being a victim of your own insults and getting caught up in a 'cornfused' state with your own very words, you ended up scoring an own goal by fuulishly prevaricating hence making a mockery of yourself! Pathetic! |
Re: Tinubu’s Victory: AIT Broadcaster Ijeoma Osamor Testifies For Peter Obi by IfnobeGod20: 7:50pm On Jun 17, 2023 |
senatordave1:Hope in their response to the petition at the pre-hearing they applied to subpoena Tribune Newspaper? Come to think of it, the content doesn't negate transmitting of snapped EC8A form and upload to IREVs. The news only say raw results would not be transmitted. I can bet you no INEC staff can come boldly to tribunal and say we didn't promise to transmit results at the polling units because that would amount to breached of section 64 of the electoral Act of presiding officer transmitting results. |
