Mr. Man, breached of any enabling laws, guidelines or the manual for the election invalidate the election according to section 65 of the 2022 Electoral Act.

Read below:

Section 65 Nigeria Electoral Act 2022
Decision of returning officer on ballot paper


(1) The decision of the returning officer shall be final on any question arising from or relating to –
(a) unmarked ballot paper;
(b) rejected ballot paper; and
(c) declaration of scores of candidates and the return of a candidate:

Provided that the Commission shall have the power within seven days to review the declaration and return where the Commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations and guidelines, and manual for the election.

The last paragraph is even the cruise of everything. The commission even reserve the right to void an announced results within seven days wherein its detected that the declaration was done against the provisions of the law and guidelines and manual for the election.

Breached of:
1. Provisions of the law (both constitution and Electoral Act)
2. INEC guidelines
3. INEC manual so provided
The breached of any of these three can render the election null and void according to Electoral Act quoted above.

After speaking and reiterating on how the BVAS is integral to the 2023 polls on every major news network in the country, it’s an unverifiable story in the tribune that is their last line of defense. Ndi ala!! grin
Even if Tinubu-backed Tribune ever carried such a story, it's no official INEC statement because whenever INEC Chairman made official statements, he would be flanked left and right by other INEC officials.
So such a story by Tribune - if ever it existed - was a business of Tribune and Mahmood Yakubu.
Nigerians trooped out to register and vote because of the official vow made by Yakubu Mahmood flanked left and right by other INEC officials in November 2022. Yakubu Mahmood's vow was:
[no other method except electronic transmission of vote results from the BVAS to INEC portal should be used for the general elections of 2023 in Nigeria].

Note that any guideline not in tandem with the constitution and Electoral Act is null and void. All guidelines must take there roots from the enabling laws. Just the same way, any law in the Electoral Act that goes against the constitution, is null and void and the constitution takes superiority over it.
That is why it is very clear in the 2022 Electoral Act, how to collate disputed results. It was well spelt out and no way to circumvent the electoral Act. Section 64 (5)(6) is very clear and I will reproduce it here same way I did before.

(5) Subject to subsection (1), a collation officer or returning officer shall use the number of accredited voters recorded and transmitted directly from polling units under section 47 (2) of this Act and the votes or results recorded and transmitted directly from polling units under section 60 (4) of this Act to collate and announce the result of an election if a collated result at his or a lower level of collation is not correct.

It is even mandatory for a collation officer or returning officer to compare the recorded results with transmitted results from the polling units as stated in the above section.

(6) Where during collation of results, there is a dispute regarding a collated result or the result of an election from any polling unit, the collation officer or returning officer shall use the following to determine the correctness of the disputed result –
(a) the original of the disputed collated result for each polling unit where the
election is disputed;
(b) the smart card reader or other technology device used for accreditation of voters in each polling unit where the election is disputed for the purpose of
obtaining accreditation data directly from the smart card reader or technology device;
(c) data of accreditation recorded and transmitted directly from each polling unit where the election is disputed as prescribed under section 47 (2) of this Act; and

In this section, it was made explicit that in case there is a dispute in the collation of results, it is expected for the collation officer or returning officer to rely on data of accreditation recorded and transmitted directly from each polling unit so disputed.

(d) the votes and result of the election recorded and transmitted directly from
each polling unit where the election is disputed, as prescribed under section 60 (4) of this Act.

Anything outside this section is null and void my brother. This section had explained how to collate any disputed results and no shortcuts.

(7) If the disputed result under subsection (6) were otherwise found not to be correct, the collation officer or returning officer shall re-collate and announce a new result
using the information in subsection (6) (a)-(d).

Note these, as stated by the section above "using the information in subsection (6) (a) - (d)".
If anyone use any information outside this section, such has breached electoral Act.
We are talking of disputed results, which has been taken care by the Electoral Act.

Meanwhile, INEC guidelines on clause. 92-94 is talking of missing INEC hard copy results during collation as you can see below:

92. At every level of collation, where the INEC copy of collated results from the
immediate lower level of collation exists, it shall be adopted for collation.
94. Where no hardcopy of collated results is available, the results, where possible, shall be regenerated from the preceding level (Collation or Polling Unit) in accordance with Clause 93 of these Regulations and Guidelines.
93. Where the INEC hardcopy of collated results from the immediate lower level of collation does not exist, the Collation Officer shall use electronically transmitted results or results from the IReV portal to continue collation. Where none of these exist, the Collation Officer shall ask for duplicate hardcopies issued by the Commission to the following bodies in the order below:
(i) The Nigeria Police Force; and
(ii) Agents of Political Parties.

Now, read the clause 93 as I quoted it verbatim which in part is in line with the Electoral Act. Read it slowly this time around and don't rush.

You people are just confusing yourself thinking you're smart. I am here to always puncture your lie.

This is why we have the court system, now go to court and argue that INEC's rules and regulations is not in tandem with the Constitution or the Electoral Act.......Watch as the judge laughs you out of the court grin grin

If Peter Obi's retinue of lawyers had proof that figures were falsified enough for the elections to favour them, do you genuinely think they will be focusing heavily on this electronic transmission of a thing after 2 weeks at the Tribunal?

Why do they need to play the video of the INEC personnel saying something and then call as witnesses, journalists to confirm what was said in the video?

Time wasting tactics, I commend the Judges for their patience in tolerating such. However, only one thing will end up happening when Judges are indulge you in this manner, your case will eventually be struck out and you will be asked to pay damages to the other party.









Tuesday 20th of June would be their last day to proof their case when they would have completed using the 3 weeks allocated to them.

It was written boldly why a return can be invalidated. That is not following constitution, electoral Act, INEC guidelines and Manual for the election. Hope in their response to the petition at the pre-hearing they applied to subpoena Tribune Newspaper?
Come to think of it, the content doesn't negate transmitting of snapped EC8A form and upload to IREVs. The news only say raw results would not be transmitted.
I can bet you no INEC staff can come boldly to tribunal and say we didn't promise to transmit results at the polling units because that would amount to breached of section 64 of the electoral Act of presiding officer transmitting results.
