If the first son got married and never had a son before he died and later the wife got her self pregnant and bear a son that son takes every thing, he is the first son. unfortunately that is the truth

In law, does being a first child give you access to the properties in the absence of a will?

But I believe what's going to happen is for your day to get back all the spent on renovation after these properties are valued before any splitting/sharing.

This is someone who after he travelled only came back once and never bothered about the affair's of the family.

Their father my grandfather died 2005 he was no where to be found. my grand mother died 2018 still nothing from him.

He cut all sort of communications with them and now he's back to lay claim on the properties.

The family is angry but some of the elders in the extended family are getting on is side claiming he's still the senior he was never disowned but they can't say it out though.

It's obvious he came back with almost nothing and felt laying claims on their parent property is the back up plan

No will was written and some of the old buildings has been reconstructed from the scratch by my father and yet someone is laying claim on it.

I will like to know how this will go because my father is ready to fight this with his last strength and we the children are firmly behind him

Truth of the matter, the property is not your dad's solely. It would be made more sense if your dad had spent money building his own house and not that owned by his father. There are other siblings that have claim to your grandfather's property.
Even you can only inherit the share of your fathers part of you grandfather's property
Way forward. Likely those properties will be sold and everyone get an equal share. The cost of expenses ie renovations you dad spent on the place will be in covered with the fact he lived there, after all if the place was rented out, the building would have made money to renovate.
Never spend personal money on family house unless it is a dash or agreed to by all parties.

So because he never showed up when his parents died means he has no right over his parents property….


Do not rob him off his right, his absence has nothing to do with the property, just has your parents have rights over the property, he has full right over it as well, he won’t have the right if the owner has will but since there’s no will, he has rights over the property…

The property should be sold and all liabilities due from your uncle(especially as it concerns their parents burial) should be deducted before giving him his share

Since you didn't mention your tribe, it becomes a bit difficult to attempt a proper analysis.
However an elder brother is an elder brother.
Your dad should calm down and engage his brother in dialogue.
Being ready to fight isn't the way to go.

There is no will stating that the property belongs to your father, so there is no fight to begin with. He is the first son, so traditionally the property belongs to him.

We have some very messed up traditions that cause more harm than good, which need to be thrown away. Is it not men who created these traditions? Can the same men not undo them, if they really wish to?

Unlike you I mean every offence when I say (not to you specifically) that the useless first son should have stayed gone and never returned or reappeared to claim property.

What is wrong with some children sef? Are your hands broken or is your brain malfunctioning to a point where you cannot build or acquire properties of your own, without looking to grab what your parents had?
One man is useless while the other man sits unlawfully on the 'useless' man's property. Are they not on the same boat?

As long as there was no will, the man has a right to his father's properties. The family should come together and give him his share.

If I were your father I will simply undo every renovation work done on properties he is laying claim to and let him have them, after I have returned said properties to their former state and status. I hate nonsense and stupidity sha.
The argument may be that he lived there or benefited from commercial use of the place which should cover for the cost of renovations.
