Getting money to rent a house is not easy abi? So getting money to buy a land and build a house is easy. Common, staying in a house without paying rent is like barbing without paying, how do you want the landlord to survive if that's his only source of money?

I am talking from experience...what you read in your book is different from court practice. The moral aspect of this case most come to play . I have accompanied some tenants to ogba magistrate Court...I am impressed how cases of this nature are judged . Infact in one of a tenants last appearance he was ask to take 3 more months despite spending 6minths ...Thevreadon for evicting this tenant us laughable cos nobody digs money from ground ...getting a house involved alot ...you need to raise money raise agency fee raise agreement fee and damages...is nit easy ...I am not encouraging him.to make trouble but if he can't raise money b4 the expiration of the notice ...then the landlord had to approach the court to evict him after due process ...he cannot be evicted by force ..I don't need to tell you who I am but I have helped some people on issues if this nature ......

The OP didn't say he won't be paying. It is after one fails to pay a house rent that you give quit notice .

All these landlords be playing God. For God's sake have compassion as a landlord!! The economic situation is hard!

Due process will takes it's course as it has been followed so far. He can be evicted and probably will be evicted by force on the order of the court.
- Sufficient notice has been given
- he has previously defaulted on payment agreement
- someone has advised him not to grant access for inspection which is likely in his agreement
- he likely is not flush with funds to find another place
-he's already running out of time to find said new place

The best he'll get from the courts is a few months of extension will he'll still pay the rent for and have to move out. Failing which he can be evicted legally by the court itself. They'll send court officers with armed escorts to do that in case there is trouble. And this will be legal.

The landlord and his wife has refused to mind their business. Your wife owes them no greetings. You have the right to greet and don't greet anybody. Na business partners una be. So he has no justification of evicting you. Man live in that house till your rent expires . Then live there for another 3 months for free, don't allow them scare you. You have your right too as a tenant.

His tenancy agreement if he chooses to read it, will state somewhere that he's to pay a certain sum at a certain date. He signed that agreement, he broke that agreement, technically at that point he's lost ground already. Again, no reason whatsoever is needed to issue a quit notice other than "we'd like to terminate this agreement legally".

I just got an apartment where am living for now with my wife and daughter which is going to be 2yrs of me staying by January 14 2024. but the issue i have right now is that i was suppose to renew my house rent January 14 2023 the sum of 550k year due to how difficult everything was so

i make half payment on December 2022 to the lawyer and make the lawyer understand the situation of thing at the moment and he accept with me sum of 275k that's 6 month payment so hoping before June/July i will be paid the remaining half. fast forward to August 16 i message the lawyer

again on whatsapp again concerns the second half payment which i did another 275k but to my surpise after paying the said amount i got quit notice letter just 1 weeks after making payment that i shoudn't renew my rent again and i should leave the house before january 14 or by january 14. so i went to the lawyer office and let him know how i feel about this that what my offend and when you know you're given me QUIT NOTICE why collecting money from me again and he doesnt respond to my question saying the landlady complain my wife doesnt use to greet her whereas we are living in the same compound but we tenant have our own gate while the landlord have their own personal gate and compound we doesn't share the same compound because there's demarcation between the tenant and landlord.

my problem and concerns at the moment is i dont have money yet on me to rent another apartment i will really need enough time. I want people here to enlighten me on this under the law, is it how it works in Lagos state and secondly i was told they are coming for inspection of my apartment by November if i made any damage in the apartment when am still living in the apartment likewise am new to this i pay for damage the sum of 60k i never damage anything in the apartment still this moment everything is in order. i really better knowledge on this about the quite notice and inspection of house around November because i dont trust the landlord for who they claim to be PASTOR

Pls take this time frame, get some money and go for a lower apartment that you can afford, don't over stress yourself, BP is real. That same money you will pay when your rent expired, you can transfer it to a new landlord and have your peace .

Don't look at that painted picture of your wife and the landlady as that's not the reason behind the quit notice as You can only know the reason when you go to court which is not necessary.

In summary:
The lawyer is on the right track .

Don't give any lawyer shishi.

Pack your load .

Take your properties to an affordable apartment you can pay for , if madam opposes then let her go and pay for a duplex after all what a man can do a woman can do it better.

Going to court is a waste of time and money which can not make you the landlord.

My brother, this advice is entirely for you and ensure you take it to bank.

Firstly, from all indications, you struggle to pay your rent meaning you are living above your means. I do not blame you because things are hard or maybe you're doing it to please your wife which my candid advice is to quit and go for a cheaper rent.

Note: If your two and half months salary can't pay your rent, then you're in trouble because there are many unforseen bills waiting to swallow your income.

Secondly, the Barrister only effected that just to either scare you and work on your psychology.

My Advice: Consult a Barrister who has an indebt knowledge of Tenancy Law and make sure you don't sign any Quit Notice issued to you. In November, never you grant your landlord's lawyer access to your apartment.

Finally, make plans to relocate to a cheaper apartment to avoid insult. And while doing so, save money to build even if it's a half plot of land and start building gradually.

Do this and thank me later.
He should not grant the landlord or agent access to inspect his property despite sufficient notice?? Under which law is that one?
The way una dey give advice wey fit bury a sinking man dey always dey scary.
A landlord or his agent has right to inspect his property at any point in time, as long as sufficient notice is given and it's done within a reasonable time.
When I was leaving an apartment I rented, I invited the landlord to come inspect if there is anything he might want me to fix up before leaving.

Thank you all for your advice i really appreciate this. God continue to bless you all with wisdom and understanding. you're the realest ones.

FIRSTLY my prayer to GOD i don't plan to start my new year in this house. I'm working hard toward getting out of this house even before my due date. i posted this stuff to seek advice because i don't how thing works here moreso i don't want to unnecessary pressure or embarrassment on my family.

It just a pity that some people are not who they claim to be in this life. I really wish i can say a lot of thing here and it seem not necessary because i don't have to play victims card here. The funny part of all this situation is am also a landlord of 6 tenants in Ogun state two 2 bedroom at front wit 4 room and parlor behind at least am getting close to 900k annually from it that's prove wit receipt. I don't pressurise any of them if you have 6 month go ahead the fact remaining since you're not owing me. you greet me or not i don't have issue with you and we all are living cordially and happily. moving to lagos due to new work make me under another life seems there's no love. The notice period can either be during the pendency of the existing rent or after the expiration of the rent, the only condition is that the notice should not expire before the rent.

I empathize with you about your present state. But at the same time, the landlord owns the house and determines who leaves or stay, so far it's not in disagreement with the contract signed by parties. They can also inspect your house to access damages, all these will have been stated in your contract. The law says a tenant should be served two notices before eviction, one has been served, the other one is a seven days notice, I know for sure you are not ready for legal battles, my advice is you can either make an arrangement to leave the house on or before the expiration of the notice or go plead with the landlord and lawyer that you understand their position but they should give you till a close definite period to vacate the apartment. I must say that in Lagos most people build houses as a form of investment and won't want anything tampering with such, if they try physical efforts to remove the barrier and its not working sometimes they go spiritual. A word is enough for the wise.

Focus on the reality
Your wife is not wise
A wise woman won't keep malice with her landlord/lady

You don't have any right to stay in anyone's house for free

You must pay for every extra month you spend in that house

My problem is that you're not seeing the problem

Your wife with her current attitude and mindset will continue to put you into more problems

Pride and arrogance will make you waste your time and money fighting in the court

They didn't do anything wrong for giving you quit notice on time

Use this period and look for another house if you can't swallow your pride and humble your words

Let me give you this free advice which you can take to the bank. When you rented the apartment you were a yearly tenant and under the Lagos Tenancy Law, a 6-month quit notice is required to evict you.

However, the moment you started making 6 months rent payment, you automatically made yourself a monthly rent tenant. Under the law, the landlord is required to issue you a month quit notice.

From all indications, your landlord has acted in accordance to the new Lagos Tenancy Law and is within his right to evict you after the expiration of your rent in January.

The major reason for the quit notice issued to you is the suspicion by your landlord that you are becoming increasingly incapable of paying the rent and it is reasonable to act in time.

Payment of rent is like payment of salaries. No worker wants to be owed salaries just like no landlord wants to be owed rent as both depend on the payments for their own bills payments as well.

So I advice you start looking for a new apartment within your means right away! It is even possible that the rent would be increased next year going by the current inflation in the country.

But if you so much desire to remain in the apartment, the best approach to solving the quit notice issue is to go and meet your landlord directly and assure him that you are capable of renewing your yearly rent and immediately offering to pay the next rent before due time.

Please ignore any advice to the contrary as it would lead you to bigger problems. The law does not allow you stay a day free rent on another person's property. If you decide to drag the matter unnecessarily, you will just be feeding your legal counsel (which he is entitled to anyway).

This is wrong! Your tenancy agreement stating when your rent expires serves as your quit notice. One day after that date you are an illegal occupant and can been thrown away but with permission from the court. The landlord doesn't even need to let you know he's getting a notice from court.

Pay your rent on time or you live where you can afford because housing is someones business no need for sympathy .

This is not totally correct. The 6 months notice period is not rent free. Dude needs to look at getting a house he can easily pay the rent. Ordinarily, any house where your rent is more than 3-4 months income is too expensive.

They gave you a notice already. 5 months enough for you to find an apartment you can afford. Live below your means.

I was paying less than 20k for house rent in the town I was until last month when I moved to another town where my family members own houses. I work from home and I'm no longer paying any rent.
Different strokes for different folks as a result of different realities.

But the best and smartest way to leave in Lagos is get a cheaper area and to stay safe up and buy a land n build your house
If not you go work for Lagos landlords tire

Lagos a very deadly state. Full with greedy landlords, lawyers, agents and what have you. What I will advice you do, get a lawyer, if they want you to leave the house, a notice windows of 6months is ok to enable you prepare and source for another accommodation. Talk to the landlord. Get a lawyer who knows much about the tenancy law in lagos. Nor let them use you. If people open their mouth to tell you what they are going through in lagos you will. Be amaze. It's a f***King state.

I promise to make this simple and short. Please kindly bear with me. however i write this am mind is filled up.
I just got an apartment where am living for now with my wife and daughter which is going to be 2yrs of me staying by January 14 2024. but the issue i have right now is that i was suppose to renew my house rent January 14 2023 the sum of 550k year due to how difficult everything was so

i make half payment on December 2022 to the lawyer and make the lawyer understand the situation of thing at the moment and he accept with me sum of 275k that's 6 month payment so hoping before June/July i will be paid the remaining half. fast forward to August 16 i message the lawyer

again on whatsapp again concerns the second half payment which i did another 275k but to my surpise after paying the said amount i got quit notice letter just 1 weeks after making payment that i shoudn't renew my rent again and i should leave the house before january 14 or by january 14. so i went to the lawyer office and let him know how i feel about this that what my offend and when you know you're given me QUIT NOTICE why collecting money from me again and he doesnt respond to my question saying the landlady complain my wife doesnt use to greet her whereas we are living in the same compound but we tenant have our own gate while the landlord have their own personal gate and compound we doesn't share the same compound because there's demarcation between the tenant and landlord.

my problem and concerns at the moment is i dont have money yet on me to rent another apartment i will really need enough time. I want people here to enlighten me on this under the law, is it how it works in Lagos state and secondly i was told they are coming for inspection of my apartment by November if i made any damage in the apartment when am still living in the apartment likewise am new to this i pay for damage the sum of 60k i never damage anything in the apartment still this moment everything is in order. i really better knowledge on this about the quite notice and inspection of house around November because i dont trust the landlord for who they claim to be PASTOR

The fear of all landlord is for tenants not to tell them stories.

I like give you receipt every year with alert greetings from your wife is just an excuse.

However it reveal something about you and your wife.

You are living beyond your means... Cut all the extra fats now limit spending to bare necessities.

Also advice your wife to pipe low egberaga no dey carry anyone reach anywhere.

Tell her she's the reason landlord find you wanting but truth is it's because of money.

Would have recommend you go to the office of the public defendant in ojuelegba but it's a lost course.

Read the agreement you sign the first time you paid for the rent it's stated there in fine print legalese.

Anyone you call will end up asking you for money and walk away.


Landlords wey sabi dey use this things pursue tenant them no like.

Any lawyer wey see am go know once they read the agreement

However it's not right sha but na the man business so no reason am.

Your own na find another house in your pay grade and live way below your means.
