Rivers Crisis: Tinubu’s Intervention Must Not Violate Constitution — Secondus by Morbeta11(m): 3:40pm On Dec 25, 2023

A former National Chairman of the Peoples Democratic Party, Uchechi Secondus has urged President Bola Tinubu to act as true statesman in his intervention in the political crisis in Rivers State.

The PUNCH reports that Governor Similayi and his predecessor, Nyesom Wike, after a truce meeting with President Tinubu on December 18, agreed to an 8-point resolution.

The resolution amongst others mandated Fubara to re-present the 2024 appropriation bill he had earlier presented to the four-member state House of Assembly to the full House.

Secondus, however in a Christmas message on Sunday signed by his media aide, Ike Adonyi, noted that Tinubu’s intervention must not violate the tenets of the constitution.

The statement read in part, “With particular reference to the crisis in Rivers State, the former PDP boss contended that the Intervention of President Bola Tinubu must be by the spirit and letter of our constitution for it to be implementable.

“There are creative ways a political conflict can be resolved if and when the President acts like a statesman and the President of all Nigerians.

“He insisted that Mr President would have violated this sacred role if he acted in such a way and manner that gave an unconstitutional advantage to his political party, the APC, and an individual political godfather. This is the scenario the unenforceable agreement reached at the instance of Mr President purports to foster!”

Secondus, however, enjoined other Nigerians to clarion call on the President and relevant stakeholders to act in the interest of peace in Rivers State and “ensure genuine, unbiased, generally acceptable, and enforceable reconciliation of the crisis”

Tinubu is a military present in civilian clothing.Nigerians should expect more political imposition in the coming future, APC ain't loosing any state and would hijack any opposition governed state he is interested in.

Tinubu called a meeting where the governor and Wike team met and they reached some conclusions which are contained in the resolution.

Tinubu did not put knife on Fubara neck to agree nor does he command him with the power of presidency.

PDP should be ashamed of themselves. Atiku their leader is in Dubai chilling while Rivers was burning. Now Tinubu took the leadership mantle for PDP to set their house in order, they are still wailing.

If Atiku is a good politician, he would have taken this opportunity to make alliance with SIM, at least solidify a block vote for next election, but he is in Dubai.

But five members purportedly impeaching the speaker in a 32 member house is not a violation of the Constitution, right?

Ordering for the defected 25 lawmakers to be granted full assembly membership and ordering for the former speaker Amaewhule to be reinstated as speaker.

In as much as the president is trying to resolve a conflict like they claimed, he lacks the power (according to law) to make those proclamations. The former lawmakers he ordered to be brought back, are they returning as PDP assembly members or brand new APC assembly members?
Whichever way, they contravened Section 109 paragraph (g) when they defected so the president cannot use his office as he is not a law court to right what they did.

Secondly, ordering for Amaewhule to be reinstated as speaker when there is a subsisting court order authenticating Edison Ehie as the speaker is like the president assuming the responsibilities of the Judiciary. Whether the court order is suspicious like it is widely believed by the Wike camp, that court judgment can only be undone by an appellate court and not the president.

Finally, the totality of the president's order is like the FG running the affairs of an independent sub level of government.

Whether there was a round table discussion before they reached those resolutions, we can't tell but those resolutions don't look like something that was discussed. They look more like a military general giving order to his troops than a civilian trying to reconcile warring parties.

For anything, this Rivers crisis has shown that the PDP is a useless party just a little less than the APC

Political problems are solved with political solutions.

Na when Una wan complicate things you starts talking about constitutions.

Every party go dey claim they are acting under the premise of constitutionality and will need to approach the court for a constitutional solutions..these takes time.

So, for me, political solution sometimes is better.
