oladele239: He is suppose to refund 6month money for you out of your house rent. Or You will stay in the house for another 6month after November for free. Goto rent tribunal for clarification |

AlphaNugget: My thoughts What if he does not leave after the 6mths when his rent just expired What will the landlord claim as his evidence for giving quit notice when ur rent is still valid. I doubt he can take any legal actions on him, cos I wonder which Ballif will follow home to execute it |

Tenants always assume they have 6 months to live rent free after their rents have expired once they've been served with eviction notice. Your six month notice starts from the time you've been served the notice, that's more than enough time to make alternative accommodation arrangements 5 Likes |

Double0h7:Right now in Nigeria, it is easy to renew rent than to get new apartment because of greedy agents everywhere. Adding those ridiculous charges while getting new apartment is crazy. So, he might be thinking of such too. |

I agree with you, some tenant do have this wrong perception that they are entitled to 6 months notice after the expiration of their tenancy which is wrong. Even 7 days owner's intention is even allowed when the tenant is holding.pver the premises ibechris: 3 Likes |

By virtue of Section 13 of the Lagos State Tenancy Law 2011, The Landlord is within his rights. All you can do is to plead for extension of time, which he is not obligated by Law to grant. If you are in doubt, please read the law. You can download it on the net. But i have included the relevant portion below [b]13.-(1) where there is no stipulation as to the notice to be given by either party to determine the tenancy, the following shall apply- (a) a weekās notice for a tenant at will; (b) one (1) monthās notice for a monthly tenant; (c) three (3) months notice for a quarterly tenant; (d) three (3) months notice for a half-yearly tenant; and (e) six months notice for a yearly tenant (2) In the case of a monthly tenancy, where the tenant is in arrears of rent for six (6) months, the tenancy shall lapse and the Court shall make an order for possession and arrears of rent upon proof of the arrears by the landlord. (3) In the case of a quarterly or half-yearly tenancy, where the tenant is in arrears of one (1) year rent, the tenancy shall lapse and the Court shall make an order for possession and arrears of rent upon proof of the arrears by the landlord. (4) Notice for tenants under subsection (1) (c), (d) and (e) of this Section need not terminate on the anniversary of the tenancy but may terminate on or after the date of expiration of the tenancy. (5) In the case of a tenancy for a fixed term, no notice to quit shall be required once the tenancy has been determined by efflux ion of time and where the landlord intends to proceed to Court to recover possession, he shall serve a seven (7) days written notice of his intention to apply to recover possession as in Form TL5 in the Schedule to this Law. (6) The nature of a tenancy shall, in the absence of any evidence to the contrary, be determined by reference to the time when the rent is paid or demanded[/b] 3 Likes |

AlphaNugget: You don't know what you are saying. It's Normal to take your landlord to court over quit notice and the case might drag for years but believe me, after the expiration of the case , the court will still mandate him to pay all is debts. |

AfroKnight: This is exactly why my landlord has been begging me now...because of wickedness... He gave me a six months notice and during d expiration, i begged him and heeded his friend's advice to send him money so he can beg for me....my buziness is a night one nd closest to my house, instead, he told his friend its his final decision....den the friend ask that he refunds me, but he refused...and den sent me to court,claiming demand to deduct the two months i HV stayed extra and cost of his lawyer since according to him, i made him get the lawyer. Note: i sent him the money even before his next notice expired and i hv ever been sking him for refund so i could park out, but he refused to send it back,instead preferring to humilate me....this got me really really angry..nd i decided to pay back.... After the court heard us they gave me one month extra ,declined his request for my to pay for his lawyer but accepted i pay his over stay,but he must hv me the balance immidiately..DT was how i lost another 50k.... But ,nay, I was determimed to get my pond of flesh....unfortunately for him, he once called me a thief in the public in our compound meeting..nd repeated such wen i was begging him... Now I reported him to the shrine to take and oath that i stole his.money, he called a lawyer ,the lawyers all washed their hands off it....i demanded a 1million naira damage for his accusations, he has been calling me crazily ,hi wife ,family ,all have been begging me, but i still refused..... I HV already taken an oath to die if I stole or he dies if he he made false allegations on me... Either of us will not see next week Wednesday, my mind is very strong that its not me...i beliv he is running around for thr funds..he has already begged for 500k nd i refused...this is.my time to shine... In fact, I want him dead.....my laff comes last... |

Jodesky: I just laughed I think someone once said his landlord started removing the roofing sheets when he refused obeying the notice to quit. Landlord claims he's renovating during rainy season Some tenants can be stubborn unnecessarily. Landlord gives you 6 months to quit and you are hoping for a free 3 more months in his house Lawyers must eat. So you'll pay them They will be giving you hope. 3 Likes |
