What The Law Says About Converting Money Erroneously Sent To You by ChiefJusticeFuc(op): 7:16pm On Feb 19, 2025
In Nigeria, it is a criminal offense to convert money mistakenly sent to your account for personal use.

Under Section 20 of the Cybercrimes (Prohibition, Prevention, etc.) Act, 2015, it is unlawful to retain electronic funds mistakenly transferred to you. The law states that if someone fails to return money mistakenly credited to their account, they may face legal consequences, including prosecution.

Additionally, under Section 83 of the Penal Code (applicable in Northern Nigeria) and Section 23 of the Criminal Code (applicable in Southern Nigeria), dishonestly converting someone else's money to personal use, even if received mistakenly, can amount to criminal misappropriation or stealing.

If you receive an unintended transfer, the best action is to notify your bank or the sender immediately and return the funds to avoid legal trouble.

Thanks for this. I hope people will learn from this instead of claiming that it's not their fault. Acquisition for personal use of anything that doesn't belong to you is stealing by conversion.

How about receivers bank simply reversing the said funds instead of telling you to get a court order first and advising you to pray that the receiver sends back your money. Nigerian institutions are structured to frustrate you at every turn

Because the banks can not just be reversing transactions on customers request.

This will facilitate more fraud

Unfortunately, this is Nigeria where the law support the perpetrator.
