Dear Sir,
My spouse filed I-130 for me. My spouse has been passed away. After that i got approval letter from USCIS next they reopened my file and reviewing from last 9 months. Is this normal thing? How much time i need to wait to get an update from the service? Please advice me in this regard.

Good day to you ma my name is Adam a US Citizen. I petitioned for my wife and she is on AP and was given a contact sheet but my concern at the moment is the address my wife gave on the contact sheet is different because the address given on the sheet is different from the address in our form so I will like to know if that won't mess the the case and also will the Investigators still need to go the address given before? Because am so worried She moved away in August with the other tenants because the Landlord told them he needed a new set of tenants after renovation. 
Please I will like to know what to expect.

Dear Sir,

Thank you for your kind care. I am an Egyptian medical graduate. I have applied for a B1/B2 visa in order to travel as a tourist to the US and I have been granted it. But due to family issues (the loss of my grandmother), I could not travel and simply canceled my plans. I have always wanted to take part in a research training in the field of biomedical studies. So I started contacting faculty members of universities all over the US asking them for a non-paid volunteer research scholar position. I kept receiving emails stating the lack of research spots. Based upon an advice from a friend, I decided to apply for diversity visa so as to increase my chances of landing a volunteer research position in the chance of winning the lottery. So I simply filled the online application for the lottery visa. Few days after that, I received an email from a professor willing to accept me as a research scholar and I simply followed the procedure to get my J1 visa. My J1 visa interview is 2 days from now but I am afraid that I would be rejected because I applied for the DV visa. I have got no intention of immigration. And given the fact that I received a B1/B2 visa and did not have any intention of violating immigration laws, I will be granted the J1 visa? What should I say if I am asked about the DV? What are my chances now. Is there anything I can do it prove my intention? Please advise.

she has been rejected thrice, based on irregularities ranging from: known/unknown pple in the US and then other reasons best known to them, but the 3 refusals were referred to section 214(b)

Now rubicon wants to give it a try again, actually she has applied, filled and submitted the form, interview is stimes in dec BUT, she made a mistake in this submitted form, she has clicked no to knowing anyone in the US, where in her 3 previous applications she had clicked yes to knowing a family member, cousin and ofcourse her brother.

pls whats the best advice as she has to chnge that no to a yes befor her interveiw, all ur advice and suggestions are welcome like asap, thank you, i appreciate thesame support i was given here to be as well accorded to her.

Great news for families who will be shielded from deportation, but do you anticipate the millions of new applications for deferred-action status in 2015 will clog the system, leading to even longer application times for those of us who seek to lawfully immigrate?

Dear VisaOfficer,

I married a Nigerian of dual nationality (a US citizen by birth) some weeks ago after a committed relationship of about 3 years. She has been in Nigeria for about 2 of those 3 years - she travelled back and forth at a time, shortly after we began dating. She says she'll like us to return to her country sometime ASAP, preferably next year, but has no idea about the process we need to follow - since I will need a visa. Meanwhile I have a passport that is valid but I have never used.

I tried searching online but it seems our case is special because all the articles (IR1 or CR1) that I found are indicating that the sponsor-spouse needs to be living in the US and must have a permanent address there, and apply from there (in the US). My wife does not have any current permanent residence in the US - we intend to get that when we relocate.

(A) Does this mean she needs to first of all travel on her own to the US, rent a place, file the papers, then return to Nigeria while we wait for results? It sounds like a cumbersome plan. We really hope there is another way to process this remotely from Nigeria, so that we can plan ahead.

(B) I am also currently applying to study in the U.S. for Fall 2015 (which is also next year, thus coincides with my wife's plans). I don't know if applying for this immigrant visa will have any impact on the student visa that I will be applying for, if I (hopefully) get admitted for my graduate studies.

(i) Please what process do you think we should follow, so that we can set plans into motion?
(ii) Approximately how long do you estimate the processing could take, so that we can decide what to do? Especially considering (B) above, I wouldn't want either plan (immigration / school) to jeopardize the other one. I just might choose to postpone one or the other.

Kindly let me know if there is any other information that I can provide to enhance clarity on our issue.

Congratulations!

Technically the petitioner should reside in the U.S. What people often do in your situation is use a close relative's mailing address so that the petition can be processed, then explain to the Consular officer that the petitioner and beneficiary will be relocating to the U.S. together. You might want to include a letter of explanation with the petition, if that's the route you choose.

Right now it's taking around eight months (I believe) from the time a spousal petition is filed to the date of the interview. The more complete the application is at the beginning, the less likely it is to get stuck at the National Visa Center.

Hi VO, I'd like to inquire on filling out the form I-134 correctly for I-129F petition. My fiancé just started on a new job this month. On #7 on the I-134, for "I derive an annual income of:", we've read that the amount we should put there is the amount on line 22 from his Form 1040 for 2013. But the figure written there was from his past job. We're confused in filling out the said form, should we write his current salary from his new job or the one on his 2013 1040? Thank you.

I'd go for the current salary, with a letter from the new employer to back it up.

Unless you have another relative in the U.S. who can file for you, I'm afraid this is your only option. If your father becomes a citizen, your priority date and wait time will remain approximately the same, although your visa category will change from F2B to F1 (unmarried child of U.S. citizen).

I'm sorry to hear of your loss. I'm not sure what USCIS is doing; did you inform them? Maybe they're updating their records?

These are basically questions for my non-immigrant visa colleagues at https://www.nairaland.com/1792662/u.s-non-immigrant-visas-listening ... but I wouldn't worry. We tend to view DV applications not so much as "intent to immigrate" as "why not try, it's free, what the heck." Just tell the truth. I think your B1/B2 visa history will also be very helpful to you. Your husband is free to apply, but it will be difficult for him to overcome the presumption that he's an intending immigrant. It's not impossible, but it's difficult.

Medical paperwork is valid for a maximum of six months, so if your fiance's paperwork has expired, another report will be needed.

No such law has yet been passed. At this time, U.S. citizens may continue to file on behalf of their siblings.

We'd accept them either way, but it's in your best interest to list them as income. Here's why. If your income is insufficient and you're using your assets to meet the minimum income requirement, the cash value of your assets must equal at least five times the difference between your household income and the poverty threshold for your household size.

Assets may supplement income if the immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and converted to cash within one year without undue harm to the sponsor or his or her family members. You may not include an automobile unless you show that you own at least one working automobile that you have not included.

Any type of asset can be used if it is readily convertible to cash within a year. Liquid assets, such as savings deposits, stocks, bonds, and certificates of deposit will be viewed most favorably because they would be most accessible for the support of sponsored immigrants. Other assets, such as property, may also be acceptable if they can be sold within a year.

I'm going to answer this in public as a service to other people with pending cases. Your brother did not appear for his DNA appointment in 2011; in fact, we have not heard from anyone in your family in more than three years. Because more than two years have passed without any action by the petitioner or beneficiary, the case has been closed and returned to USCIS for their disposal. If your father would like to have the case reinstated, he should contact USCIS directly and ask if it is possible. Otherwise, he will need to file a new petition.

It is extremely important that families stay in contact with either USCIS or with the post handling their cases. If more than a year passes with no contact, the case will go into "Termination 1" status; if more than two years pass, the case will be closed. (This does not apply to cases in administrative processing, but it does apply to all other cases without exception.)

Hello VO; Thank you for your reply, My brother couldn't appear for his DNA test cause no one contacted he for the test which we were all waiting for.. I have every mailed sent to the embassy regrading this case LGS2007763015 documented in my file. I never got no responsed from no one not a phone call or letter sent out, In 2012 January I and my siblings made a trip to your head office in VI and your workers wouldn't grant us access to speak to any officer, A letter from my lawyer was sent out to the embassy yet no reply. My father is late now and am the only one following this up, please who do I need to talk to? or Can I have my council men from California involve in this..Thanks Lilian
