A federal high court in Abuja has granted leave to the Peoples Democratic Party (PDP) to file a motion for an order of mandamus compelling Aminu Tambuwal, speaker of the federal house of representatives to declare his seat vacant.

Mike Ahamba, counsel to PDP and a senior advocate of Nigeria, had filed an ex parte application urging the court to compel Tambuwal to declare his seat as speaker and that of his constituency vacant.

Ahmed Ramat Mohammed, a justice of the federal high court in Abuja, granted the PDP leave to file a motion for an order mandating Tambuwal to declare his seat in the house vacant.

He also dismissed the application of Tambuwal’s constituency seeking to join the suit against the PDP.

Tambuwal had filed a suit against the PDP over its attempts to remove him as speaker after his defection from the party to APC.

On November 20, the police attempted to stop him from entering the national assembly complex, firing canisters of tear gas at him.

Following the commotion that ensued, David Mark, senate president and chairman of the national assembly, shut down the parliament.

Tambuwal had convened a special session of the house to deliberate on the request of President Goodluck Jonathan for an extension of the state of emergency in Yobe, Adamawa and Borno states.

However, the lawmakers rejected the president’s request for an extension of the Emergency Rule in the three of the Northeastern States.

Tambu-gone( sorry Tambuwwal) is just bidding time. He knows his position as Speaker and member of the House has become history but he's craftily playing on the intelligence of the judiciary and Nigerians. If he's allowed to have his way, a dangerous precedence would have been set in our democracy. Anyway, whether the news is true or not, all fingers crossed but he MUST not be allowed to desecrate that exalted Speaker's office..

Don't know the reason for the happiness of some PDP supporters here. To serve a notice simply mean the pdp should go and inform tambuwal to come and defend himself and not an ORDER to vacate the seat.

Had this fooolish man tambuwal, resigned his position while defecting to apc, at the same time he announced his defection announce his resignation, giving Nigerians reasons for leaving his party even with his position, asking Nigerian to give apc a chance, tell us all the corruption and embezzlement going on in pdp, this man would have been the hero, this would be plus to his new party. But no typical of Nigeria politician, he wants to eat his gworo and still hold on to it.

Whether the ruling is challenged in an inferior or ultra-superior court, Tambuwwal has set a bad record of being the first sitting Speaker( no.4 citizen) driving himself to the National Assembly without official security and paraphernalia of office and ridiculing himself by behaving like a common thug. What does that portray to you? Shame! He has been confined to where he truly belongs; Association of Polithugs Confraternity. It isn't good for his political résumé.

An order of mandamus is a writ of summon which command an individual or entity to carry out an instruction or action.

The judge gave an order to the PDP to summon tambuwal to come defend why he should still remain speaker since he has defected.

It is not an EvICTiON or disqualification order from being a member of the house not to talk of him stepping down as speaker.
