Section 68 of the Nigerian constitution. Take note of sub section 1g:

68. (1) A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if -

(a) he becomes a member of another legislative house.

(b) any other circumstances arise that, if he were not a member of the Senate or the House of Representatives, would cause him to be disqualified for election
as a member;

(c) he ceases to be a citizen of Nigeria;

(d) he becomes President, Vice-President, Governor, Deputy Governor or a Minister of the Government of the Federation or a Commissioner of the Government of a State or a Special Adviser.

(e) save as otherwise prescribed by this Constitution, he becomes a member of a commission or other body established by this Constitution or by any other law.

(f) without just cause he is absent from meetings of the House of which he is a member for a period amounting in the aggregate to more than one-third of the total number of days during which the House meets in any one year;

(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected; Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or

(h) the President of the Senate or, as the case may be, the Speaker of the House of Representatives receives a certificate under the hand of the Chairman of the Independent National Electoral Commission stating that the provisions of section 69 of this Constitution have been complied with in respect of the recall of that member.


So what does that tell you? Is it not what I tried explaining?

The part of constitution you are referring to talks about removal of a speaker or his deputy. I'm talking about membership of the house itself. If a speaker loses his right of remaining a member of the House, can he still remain a speaker? Nobody is arguing about the procedure of impeachment of a speaker here.

Tambuwal is a lawyer, yes. But he broke the constitution, simply because others have been doing it and getting away with it, so he felt he could also do it and get away with it. He may still get away with it finally, but his move was unconstitutional.

Had this fooolish man tambuwal, resigned his position while defecting to apc, at the same time he announced his defection announce his resignation, giving Nigerians reasons for leaving his party even with his position, asking Nigerian to give apc a chance, tell us all the corruption and embezzlement going on in pdp, this man would have been the hero, this would be plus to his new party. But no typical of Nigeria politician, he wants to eat his gworo and still hold on to it.

The fact that even his praise singers both on nairaland can't reason along this line surprises me

Now read the part in BOLD . What does it mean, who interprets it, is it applicable in this instance?
These questions I asked are the reasons why only the court can decide what the answers are and thus determine the faith of Tambuwal.

Yeah, d court will decide. But a judgement had earlier been made dat there is no division, factions or merger in PDP. APC was formed following a merger of parties, so if anybody decamped from APC, he was safe. Not so for PDP.

In essence, you agree that the court will decide.
The judgement you alluded to was some 3 months before the events in Sokoto state and therefore cannot hold as regards his defection some months later.

So in essence, until a competent court declares that there was no faction as of his time of defecting, he remains a member of HOR.
And until 2/3 majority of the members of the HOR vote him out, he remains the Speaker of the HOR.
