Since death came calling and snatched away the obviously pedestrian, but quite popular gubernatorial candidate of the All Progressives Congress (APC), in the now still-born Kogi Governorship elections, there has been a floodgate of legal opinions, cross-currents of analysis and an assortment of disagreements. Countless opinions have been rendered here and there of how the current debacle, is one that the Nigerian Constitution never envisaged, to the extent that the Latin word “Lacuna”, has since become nearly everyone’s friend in the last three days. Funny enough, the comedy side of the entire episode, has been quite as outstanding and remarkable as the flurry of legal debates. After all, how else do you explain the fact that shortly after the debates began, different aspects of comic reliefs also simultaneously entered the fray, with overnight rumours quickly been manufactured in their tons, to perhaps create a temporal comfort for the bereaved people of Kogi, with those rumours suggesting that Mr.Audu may have after-all evaded the incarceration of death, except that before such rumours could even gather the requisite time to assume a life of their own, the people were quickly, just the same way they were deceived, brought to the realization that they must again have been sold a dummy.http://www.lawyard.ng/660-2/ |

Lawyers and Scholars in the house, What is Malafideism ? The author used that word in the writeup? Is it a legal term? Its new to me and I can't seem find the meaning even through google. Back to the write-up, I concur with the arguments peddled by the lawyer. The law cannot definitely be a source of confusion, only human beings would confuse each other. Ofcourse, this is Nigeria where every single item is twisted, severed and politicized all for selfish purposes. The author asks God to forbid a constitution that envisages all situations. Well, I believe the law must be explicitly clear and not leave anything to conjecture of humans. Left to some human beings, a lawless society is paradise. Whatever happens at the end of the day will constitute a landmark of jurisprudential relevance in the matters concerning electoral cases in Nigeria. It infact opens up a fresh aspect in the legal world which will be of interest to scholars and researchers. |

The most sensible thing for APC is to present Faleke as the candidate to complete the remaining election and he becomes the next governor of Kogi state. Given that INEC does not have the extant powers to cancel the 240, 827 votes already returned for the APC, the suggestion therefore that INEC must conduct a fresh election is entirely anachronistic and absurd.Nurse Methusela and PDP need to take this to their baby lawyers. Their expectation or clamoring for cancellation is absurd and an attempt to steal what belongs to another. |

The AGF and the SAN say na dem no pass, they will orchestrate a CONSTITUTIONAL CRISIS and before you know it, they will be begging the SUPREME COURT to apply the DOCTRINE of NECESSITY. We might be seeing a Governor win election but will not be sworn in. Faleke is the true candidate. |

Faleke was not voted, he was selected. He is only a recognized entity after swearing in by virtue of the provisions of the constitution of Nigeria |

People don tire for Audu abi na Audi talk jor First I am not a supporter of any party. My opinion in the whole matter is the since the man died even before election was concluded (still yet to conclude) he is yet to be a winner. Votes can not be credited to a dead man. I bet 80% of the vote was for the man although its party that inec recognize voters are concerned about candidate. If I VOTE FOR SOMEBODY AND THE PERSON DIES IT IS FRAUD TO USE MY VOTE TO BRING IN ANOTHER PERSON. I SHOULD MAKE MY NEXT CHOICE since my choice is not available. since apc is claiming people voted party they should not be scared for a fresh election |

In summary, he is saying APC shouldn't conduct any fresh primaries, INEC shouldn't cancel the polls and that Faleke should replace Audu in the supplementary poll. That's also my take. That's the reasonable thing to do. |

It is only a Law Court that can make a Pronouncement on this absurd situation. Any other opinions are personal . INEC should have gone to the court for directions instead of the AGF . |
