The truth is, choosing Faleke would have been more problematic because he did not participate in the primaries, PDP would have gotten the seat back post election through the court...

Yahaya was a safer bet for APC under these circumstances, but that does not mean that APC is out of the woods yet. Yahaya is just the best hand they can play in this situation.

Now, if you go by the Electoral Act, there was no provision for the replacement of a candidate once polls have opened. The Act never anticipated the need for that, In fact the Act clearly stated that once polls are opened, you can no replace candidates...so that is where Faleke will have a case...Yes Faleke cannot inherit the vote already cast, but his case will be to fault INEC for allowing for the replacement of candidates after polls have been open and not because APC did not chose or that he have a claim to the votes already cast.

With that, the best that can happen is that, the court will cancel the elections and order a new one...I believe this will be PDP's argument also, but Faleke will help them to make it.
