Hello the great VO. Thanks for your help answering peoples question.
My uncle recently had issues with his wife and they are now divorced legally at a High Court ( their marriage has been about 5 years old now with 2 kids bestowed unto them)
All efforts were put in place to avert the divorce, but it didn't work
Now, my uncle decides to remarry his new girlfriend he met sometimes ago he visited the US about 18 months ago. His new girlfriend is a US citizen.
Can he legally remarry the US citizen as his new wife ?
Secondly, must his new girl friend come to Nigeria for the marriage, OR, can he visit her and do the marriage in the US ? (My uncle has a valid visit visa )
Lastly, after their marriage, is it possible for my uncle to relocate to the US and start a job there in the US ? My uncle is a Pharmacist.

After she was filed with f2b, during the wait period, she was married and divorced legitimately. Unknowing the law we did not inform these happenings to the USCIS. Later when she applied for a business visa, she told the officer about her divorce. Her business visa was denied for some other reason and after a couple of years she got a letter from USCIS stating that she has to submit documents to NVC for scheduling f2b visa interview. The divorce decree was mandatory in the Immigrant visa application. She was worried on how she could get it without being able to trace her ex partner(whose traces were lost) . Hence,She submitted the application after we as a family wrongly guided her to say in the application as Unmarried girl . We ignorantly thought that being a divorced girl she is eligible for the visa and its not ethically wrong to write as unmarried when she was divorced many years back. We did not know the legal implications behind the F2b since we never consulted any attorney regarding that. Some of my friends said, after a divorce she becomes eligible for the F2b. In the F2b interview, she was pressed hard with the controversies existing in her F2b application in comparison with her previous BV application. After a little drill, she told the consular officer the truth and apologized stating that she never knew that she must disclose the divorce , with respect to the F2b. Obviously, she was denied the visa after a strong rebuke.
After a year , we received a letter from USCIS saying that her F2b petition was automatically revoked. Until now she did not get a 6c1 ineligibility,, ie, not mentioned in the revocation letter. The question is , now she is getting her F4 visa interview in coming year. Will she be ineligible for the Visa. If so when will she be informed about it (ie., 6c1 or any other misrepresentation accusation) .

Because she explained the truth during the course of the interview she was probably not made ineligible under 6C1. This falls under the "timely retraction" clause.
When she applies for the F4 visa class they will take another look at ineligibilities. Even if she is ineligible under 6C1, she will be able to apply for a waiver and will be given instructions on how to do so at the interview.

Thanks a lot respected Visa officer, LagosNIV, for your reply . We are worried about 6c1, as she was censured during her previous interview before she was denied the visa.

The Petition Revocation notice which we received, just quoted that , her petition was revoked under the section 8.C.F.R 205.1(a)(3)(i)(I). It did not say about any ineligibility . In one of the posts in this forum, the Visa officer mentioned that, the consular officers don't write "p6c1" on the immigrant's application. They just do a recommendation to USCIS and USCIS decides p6c1 or not. If that being the case, we should have got 'P6c1' ineligibility on the revocation notice, is it. ?.

Some online community friends say that the embassy might have decided about her ineligibility by now.

Also, kindly suggest me on how to find the status of my sister's history. Should we contact the embassy to know about our case, which is, what status does our case holds in their system . Please give an advice.

My US Citizen Mother filed a petition I130 for me, I am her unmarried son older than 21. I was unlawfully present in USA longer than a year, creating a 10 year bar. (however I was granted voluntary department by the immigration judge). I left USA on Nov 18 2008.

My i130 has been approved and around June 2015 I paid the Immigrant Visa and Affidavit of Support. My question is, what will it happen if I go to the interview before the 10 year penalty has been reached? Is my visa petition going to be denied? Will I have to create another i130 application and wait another 7 years for another visa to be available? Could my I130 application be placed on hold until I reach the 10 year penalty (Nov 19 2018)? Is there any case in which an immigrant visa is approved despite the fact the 10 years are not over yet?

What other options do I have available?

If you are still under the 10-year ban when your interview comes up, you will be interviewed and given the appropriate paperwork to file for a waiver. If your waiver is approved, the visa can be approved before the 10 year limit. Even if the waiver is never approved, you simply have to wait for the ban to expire. Your immigrant petition won't be revoked unless you no longer fill the criteria for that visa class.

There are many different parts to this question...

Can he get married? Yes. If he is divorced, he can get married...
The girlfriend can come here for the marriage and then apply for a CR-1 visa, or they can apply for a K-1 fiancé visa and plan to get married in the U.S. Travelling on a B1/B2 to the U.S. to get married and stay in the U.S. is a misuse of that visa class and can lead to challenges down the road.
If you follow one of the legal paths outlined above, then yes, he can relocate. Working as a pharmacist, however, is unlikely due to licensing requirements in the U.S. but that is all dependent on the state's licensing requirements where they live.

Honestly, it shouldn't really be your concern whether she is P6C1 or 6C1. If she is ineligible, she is ineligible. If she is ineligible, you would have been told she was ineligible. And even if she is, you can apply for a waiver.

As has been mentioned several times, I do not comment on specific cases. You need to email the Consulate and wait for a response. We receive thousands of e-mails every day. We will respond to your email in the order it was received.

Greetings my VO. Pls I want to ask u this question. If my B1B2 visa expires on March 30, 2016, when is the maximum time I can travel to the US ? In other words, with my visit visa expiring on the 30th of March, 2016, can I still use the same visa to travel and depart Nigeria on the 25th of March, 2016, ( 5 days before the visa expires ), and if yes, on my arrival at the POE, will I still likely be given 6 months at the POE ?
Secondly, can someone visits the US twice in the space of 3 months apart, and spending like 10 days each on each visit ?

Please LagosNIV, i need an advise from you. I want to apply for a visiting visa to U.S. to attend my childhood birthday ceremony in April together with my wife. I am an Engineer working in a company and my wife is a matron in a teaching hospital. Pls what are the documents i will provide and the steps to take not to be denied. I only travelled out once in 2009 to south africa. Thanks.

My wife is a US legal permanent resident and wants to file for her citizenship but she will like to know if she's on the right track.

1. She got into the US after her father filed foe the whole family in April 2010, but during her first year (2010-2011) she mostly travel back to Nigeria bcus of her undergraduate program though during every break she goes back to the US.

2. In 2012 she was not in the US from July 2012-June 2013 because of her compulsory service in Nigeria called Nigeria Youth Service Corps.

3. She returned back to the US in June 2013 and had been around working, paying tax and other duties since then.

My question is this, can she go ahead to file for her citizenship considering she got in April 2010 and it's now 2016. This makes it 6years in general and it's in accordance to the required duration of years (5years) for a LPR to file for citizenship. Please note that all other require are met.

I mistakenly filled an application for 11 people, 10 serving as dependent on the group option. I then filled the 11 receipts on a dropbox form and a pdf file was created. I later realized dropbox was for under 14 years who had travelled previously to the USA.
I now want to rectify it by submitting the application at the appropriate channel but the receipt shows it has been utilized, I sent mail to the personal feedback on the application portal but no word yet. I was told to pay another fee (about 350k) which is absurd as the receipt has not been utilized because I have not submitted the application.
Pls what can I do or who to call to unblock the receipt?

Naturalization is handled by another agency - I honestly don't know much about this process. USCIS should be able to assist with this.

Your police certificate will be valid for 1 year. You won't need another one unless the previous certificate has expired.

I am glad to have come across this platform. My Husband had his interview this morning jan21.2015 at Lagos and he was placed on AP. We are so worried and down. The CO according to my Husband laid emphasis on our communication. My husnand and i are the greatest stalker on earth. The CO requested for my husband Facebook. We have been apart for months now and we just need an insight on when the AP gets processed. It is too much a bad news for us to handle at this point. Please help us on advice and how much evidence they may need we have it all.

I don't know what the question is. If you have done a traditional marriage, you are already married under Nigerian law. That is what we have to go by. You can get the court documents and reapply as a CR-1.

I would advise him to tell the truth, but that's what I always advise. That fact that he previously lied has already damaged his credibility and greatly increases the chances that his visa for his genuine purpose will be revoked.

Yes. Tell the truth. The sooner you start telling the truth the sooner we can move forward.

I believe my previous answer was very clear. If you believe you know the answer then there is no need to ask the question.
If I answer your question with specific information, it is because that is what we accept at the Consulate.

If additional information was requested, you should provide that as soon as possible. Otherwise there is nothing you can do about administrative processing. This is an administrative procedure that we have to complete on our end and we have simply advised you to inform you that there may be some delays.

Dear V.o .. my Visa was approved.. And I checked the CEAC, It has being issued ... I was told to wait for 10 working days .. which I have .. I tried the dhl collection centre. their num was not going through & I emailed them they were sending Random answers .. please will I receive an Email when my passport is ready?? .. or will I go to the DHL office to Ask of it .. and meanwhile I don't reside in Lagos . It will be very sad for me to Go down there and be Disappointed

Good morning Sir, after my interview, l was not given an orange paper which states "Original and civil documents", is it neccessary for me to have? I didnt know until a friend of mine who had his interview after mine told he he was given.Please Sir, how do l obtain mine Sir?

Contact the Consulate or track the status of your application online. That is the best information I can give you.
