Please note that your passport and documentation could still take some time
to reach you whilst being sent back from the decision making centre and
whilst other administrative formalities are completed. The visa application
centre will be in contact with you regarding the collection or delivery.

It just means they r a bit slow/behind on updating the system sometimes. So whereas the decision has actually been made they havent updated it on the TLS contact system. Thats how i know mine has been assesed.Still waiting for the official email from sheffield confirming this and another one for the collection. Hang in there, good luck to us both x

I'm not sure about that but going for both at the same time makes no sense really. AR takes between a week to 4weeks while appeal take average of 6months(if it goes to tribunal).

So why not send in AR then get the decision before considering your next move?

Thanks for your response but I have only 28days from yesterday to send an appeal. I also wanted to know if I can make the AR if the ECO did not give me the right to it. I read some where that the ECO needs to give you the right to an AR.

Both has to be stamped, the Nigeria one when she entered Nigeria and the British one when exiting.

All this time you are deliberating which path to go. A solicitor is not required for any process.
Appeal in my summation is your best route. Simply get together all missing documents from original application and put together a very tight appeal.

By default, assuming dual nationality is in play. The entry passport gets stamped has the receiving documents and it's also gets stamped at departure, to prove exit.
If a visa was stamped on the British passport, the same principles above applies.
From my limited knowledge of entry and exit documentations.

She is a dual citizen and carrying both passports so the issue of visa is out of it.

My spouse has dual citizenship. When she travel last to the UK, only her Nigerian passport was stamped when leaving Nigeria. When entering the UK, her British Passport was only inspected and no stamp. When leaving the UK, there was immigration control. On arrival in Nigeria, only her Nigerian passport was stamp. So her British passport has never been stamped even though she has used it to enter the UK twice. In the past, there use to be border control when leaving the UK, not anymore, as all I get whenever I visit the UK is entry stamps, unlike Schengen countries which have entry and exit stamps. I think the absence of immigration control, is to encourage those that have overstayed their visa to leave without encountering immigration.

The applicant cover letter may not have been essential with regards to your application , but it was to ours. And infact it was exceptionally important and we wouldn't have had our application processed in 3 days without that, as there are concerns that needed explaining about the applicant.

All what we do here as per stating docs provided and what and how we did ours should only act as guidance . Every applicant should tackle thier application in a way that best suits their situation.

That is why I said its not essential, it is down to the individual's choice if they do or not.

I followed the supporting documents guide, which is what everyone should be using as a guide, this mentions nothing about supporting letters, therefore not mandatory smiley just a personal choice, so for family and friends I did not supply them.

when the applicant hands in their documents at biometrics, they are given a check list with what they need when collecting the passport back.

Tmr is officially the end of our 12 week application period and we're yet to get a response. I'm frustrated and very tempted to request for an update of our application first thing tomorrow.

Send them a message, it will not have any impact on the decision smiley I sent them a few throughout ours asking various questions

Hi dear the rule says you must have made 18600[b](this is true but is calculated via an average of the prior 6 months smiley )[/b] in the last year so if spouse makes less than that ,but can still meet up the financial requirement through other means like overtime .then what you need is 12 months slip all must be stamped or on company letterhead also introduction letter from company or contract and you need p60 to show that as well you will qualify under category B of full time employment

Hi please note Cat B is: for Less than 6 months with current employer or variable income so if @obabola123 was in the same employer more than 6 months then Category A is the correct one to apply under, variable income is multiple employers smiley

Where the person is in salaried employment – they must have been paid throughout the period of 6 months prior to the date of application at a level of gross annual salary which equals or exceeds the level relied upon in the application. Therefore the figure used towards the requirement will be the lowest level of annual salary received during the 6 month period.

Where the person is in non-salaried employment – the level of gross annual employment income relied upon in the application will be the annual equivalent of the person’s average gross monthly income from non-salaried employment in the 6 months prior to the date of application (where that employment was held throughout that period).

To calculate this annualised average for non-salaried employment in Category A the following calculation should be used:
(Total gross income from employment held throughout the 6 month period, divided by 6) multiplied by 12 = Income from non-salaried employment that can be counted towards the financial requirement.

Overtime, commission-based pay and bonuses (which can include tips and gratuities paid via a tronc scheme registered with HMRC) will be counted as income from employment where they have been received in the 6 or 12 months prior to the date of application as applicable. Sometimes the person will receive the same amount of income from overtime each month; sometimes overtime payments will vary, with different amounts (if any) each month. All overtime in salaried employment will be calculated based on the approach to income from non-salaried employment. This will be an annualised 6-month average for the overtime which will be added to the level of the gross annual salary.

so to calculate this you can do the 6 months pay x 2 divide by 12 to get monthly average

my base salary was only £16000 but with overnight allowance and overtime I earned over £10000 in the last 6 months, i done a calculation in my contents page, see below, hope this helps (June was below monthly minimum of £1550 but made up in other months)

1. my sponsor earn £16,231 per annum without extra shift but with extra shift money all she receive over 7 month now is about £1650 per month. How can we explain this that we meet the financial requirement because on her contract it show that she earn £16,231 and she has additional top up money on extra shift.
Just that the extra shift is not shown on the contract but it was mention. But her pay Gross pay shown on her pay slip £18,585.00 so we are down with £15.

What dates does this include? I ask because if there is another payslip due before the end of the tax year this will then increase the total Gross smiley

" What can we do all she earn now is £18,585,80 per annum with extra shift shown on her gross pay slip, so we are £15 down" i need advice please because am done with my application just to make the payment now.

2. How much is the Immigration health surcharge? because I can see here is 450.00 (USD)
this is correct, IHS, and Visa fee are always in Dollars (Priority is in Pounds)

3. Please can anyone explain how i can print out my Facebook chat because i can only printed 3 month backward and we started our Facebook chat over a year now. you need to show evidence of communication from the start of the relationship during and recent, you can screenshot, and paste into a word doc or check out the how to guide on how to download them, see attached smiley

They were in the process of informing you that a decision had been made smiley (our decision was made 27th Jan but decision made email rec 2nd Feb) Depends when the admin dept send the email smiley

The Nigerian immigration will stamp your British passport it there is a Nigerian visa on it, meaning that you entered Nigeria as a British Citizen eventhough you are also Nigerian. They will not stamp your Nigerian passport. My spouse British passport was collected in Nigeria. When she showed it to the Nigerian immigration, they requested for her Nigerian passport as there was no visa on the British passport. They told her that she is leaving the country as a Nigerian. That if she want to leave as a British Citizen, she must have a visa on her British passport.
