The Senate needs a subpoena to summon staff of the Presidency. The Executive branch is not under the Executive.
Please if you are not sure don't post. The man is not a minister or MDA staff, he is a personal staff of the President. They can only invite and he can refuse. His appointment did not pass through any screening in the Senate

Ministers who have been summoned to explain things to the Senate, under which arm of government do they function? The legislature ba?

There are extant powers as states by the constitution and there's good old fashioned influence. So if President Buhari asks Sagay to appear before the house and apologise he will not go?

The impasse at the NASS is now a matter of international debate, especially when clear attempts to blackmail the Senate has been established......

At this rate, the Senate could ask for their 3 djinee wishes and Buhari will supply it. The only reason the man is still president is because the house has chosen to stand by him, come what may till 2019.

The President - with the help of some of its support staff - has committed clear impeachable offences, if at this stage they want to unite against him, it will be too bad.

Dont be surprised, after you talk finish, you hear for news say Sagay showed up.

Shebi they summoned Babchir, he dey form say "I no dey come". The same Babachir has now written back to ask for a new appearance date. Is he a legislator or a member of the National assembly?

The reality is that no matter what you opined as the truth as it regard the three tiers of government, some pseudo educated Nigerians will never agree to it even when the truth and evidence are before them. How on earth will a bloody perpetual selected ingrates refuse to honour the NASS? And here we are, some people see it as a worthy action. I wonder how many people have really gone to read Nigeria constitution and each tier of government functions Or at least, read about the The three tiers in Democratic government written in reference to advanced democracy. PMB has committed offences worth testing his popularity amongst the Senate. And if they do, it will be termed as suicidal or enemies of progress. Yet, Executive have been reckless in following the procedure of lay down laws of land. Even if some judges were corrupt, was the method used correct? I am happy despite the inconsistency of the NASS, PMB, hasn't been able to cower them. If not, it would have been free and uncoordinated spending and abuse of power. It is just a sorry case..

with your support and great trust in the impeccable person as you "have said" in the person of proffessor sagay you should not honour the invitation of an arm of government who its to check mate the excesses of other arm of government. In as much as I dislike the Members of NASS, You can't write out the fact that they are an institution that should he respected. with the present trend if a national issue arises and they are to act in the interest of Nigerians with what its going on do u think the people in question who is summoned will honour it. Buhari is the president today, who will be the president tomorrow. will his surbodinates respect the NASS then? So as to depen democracy

He can be summoned or invited because there is a provision for that in the constitution with specific conditions. However, the constitution did not grant them the powers to summon everyone except it had to do with running of the assemblies or creating laws or the person works for govt institution etc. Even with that the summoning had conditions attached to them...So they should follow the laws rather than allow their ego to dictate.

I am in total support of what you said, In as much as most of us don't like or support what the NASS is doing it doesn't call for a repulsive issult from every member of the executive arm of government. And buhari knows nothing about politics, He is too rigid and stiff to handle democracy, Y not he take a cue from 48 laws of power, three kingdom to see how great rulers woo there enemies very close to them and totally crush them. he feels that th NASS will dance to all his tune because his name is Buhari, he better settle with them if not he will be remembered as the worst thing that happened to Nigeria. my candid thought thou

He started another journey which many thought will redeem the damage he allowed IBB to cause in 1984 but alas, after three trials and eventual victory, GMB is yet to redeem himself two years into his victory!!!! Another disaster looming, MESU is his name. He will make IBB terror a child's play.








Neither IBB nor MESU is too strong to cut just that the man with the cutlass is too weak to cut!!! We don't need safety from MESU because he's not strong and we can deal with him but we need safety from PMB before we enter another trap caused by lackadaisical and weak attitude of a supposedly strong leader!!!

(2) A summons or warrant issued under this section may be served or executed by any member of the Nigeria Police Force or by any person authorised in that behalf by the President of the Senate or the Speaker of the House of Representatives, as the case may require

Bros I sometimes wonder if the types of Itse Sagay really had a university degree. Senate committees have functions under legislative, oversight and investigative hearings. In addition, Senate committees have power to summon anybody before them depending on the issue at hand. Is the so-called Itse Sagay not an ordinary citizen of Nigeria?

(ii) disbursing or administering moneys appropriated or to be appropriated by the National Assembly.

(2) The powers conferred on the National Assembly under the provisions of this section are exercisable only for the purpose of enabling it to -

(a) make laws with respect to any matter within its legislative competence and correct any defects in existing laws; and

(b) expose corruption, inefficiency or waste in the execution or administration of laws within its legislative competence and in the disbursement or administration of funds appropriated by it
.


This section 88 does not negate the section 89. The bolded explains entire section suggesting that this section comes into play during legislative hearing. Section 89 is primarily for oversight and investigative hearing which empowers the senate committee to summon any Nigerian.

Everyone has freedom of speech.
Any speech that could cause a riot or violence can be cautioned. The police and all the endless security agencies we have is enough to spot any form of violence. Everything must be done according to the law.

The NASS need not engage Prof. Sagay because it is a responsible organ of the government. This doesn't show any sign of weakness but strength. The unprofessional Prof. Sagay is the one who need to be more weary. After all, NASS, has a serving Professor of great repute.

Stop playing with words my friend.They can summon him period.Subpoena or bench warrant are all to the same end result of having him appear before them.
Did they tell you that he was invited to answer questions pertaining to the running of the glorified committee he is heading Or did the loudmouth tell you that he spoke on behalf of the so-called PAC So as far as he is a Nigerian, the parliament of the people can make him appear before them ; whether you call it summon, bench warrant or subpoena is just pure splitting of hairs
