Saraki and Lawan are right. Ohuabunwa is wrong.

Section 145 of the constitution does not require president to write to transmit power to the VP. That is automatic once he writes to go on leave.

"Where the President transmits to the President of the Senate and the Speaker of the House of Representatives, a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them in written declaration to the contrary, such functions shall be discharged by Vice-President as Acting President"

So you can see that wordings of the president's letter is irrelevant so long as he writes that he is on vacation.

By virtue of section 148(2b) also, the function of the president is to co-ordinate government. No need for emotions here.

145. Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them a written declaration to the contrary such functions shall be discharged by the Vice-President as Acting President.

From my interpretation, it is not up to the President to declare that Vice-President is Acting President; the Constitution makes it clear that
the Vice-President becomes Acting President as soon as the vacation letter is sent, up until the President sends another letter that he has resumed.

Much ado about nothing.

It is the constitution that legitimizes the issue of avoiding vacuum in the presidency not the president and it is triggered by letter to the senate to that effect. As soon as the absence of the president is conveyed the vice president becomes the acting president. The elected president has no control over this process and no manipulation of words in the letter required by the constitution will change it.

Where you have constitutional issue is when a president fails to officially convey his absence to the national assembly.

Complete delusion. I think you are too young to understand the complexities of governance and the power of words. If Osinbajo is coordinating, he is not acting on behalf of the president.

He should be refered to as "Acting President". Period. Abba Kyari can stop him from signing any important document by claiming that he is taking it to the president to sign in London. In fact he can ground everything to a halt. Lagos - London is only a 6 hour flight. This guy Abba Kyari could fly to London at any time with the excuse that the president asked for this and that file.

You guys should show some courage and fight this situation now. The longer it takes, the harder it becomes. The cabal are hell bent.

Let them know that if Osinbajo was not in his presidential ticket, there was no way the APC would have swept the western states, and by implication the presidency. And why didn't Buhari make it a north-north presidential ticket and see if Goodluck will not be president today?

All nice and dandy on paper. We know what the constitution says. But reality is totally different. The De facto acting president may be Buhari's chief of staff. It's very easy for them to frustrate Osinbajo. Unless Osinbajo and his backers are ready to kick azz.

I think those that wrote the letter delibrately avoided the word "acting presidennt" but since they referred to section 145(1) of Nigeria's constitution, i know that their is no issue here if the rule of law has to take it cause. God bless Nigeria.

The only language recognized by the Nigerian Constitution in this scenario is ACTING.
Buhari is free to even put it in Hausa or Ibibio language. That doesn't change nothing.

Co-ordinating or Acting President is irrelevant since the President has quoted the relevant section of the constitution; section 145(2) of 1999.let theVP settle down for business of governance and not to waste time on trivialities.
