Hello everyone

Please, i did an assistant, I did my skills assessment with Engineers Australia but I got banned for 12 months, for plagiarism, I did write every thing myself and used an online software to check for plagiarism, still was a negative outcome with it. please, any suggestions on what step to take, please. Can I still redo the assessment after the 12-month ban. Please, your humble suggestions will be appreciated.

Thanks a lot

@sikiy3, if indeed u wrote d career episodes yourself, them no suppose ban u. and when they threatened you with a ban, y u no rebuff them or challenge them to prove that indeed it was plagiarized. abi u no pay money for this thing? cos i know d money no b small money. when ur ban is over, u can re-do. d question just seems somehow overall. other more experienced folks will comment on the matter.

You guys are doing amazing things by pointing people in the right direction on this forum. I really appreciate your effort.

Just to say this that DIBP website is not the final authority when it comes to Australia migration. As a matter of fact, registered agents don't refer to it. Legislative Acts, regulations, instruments and policies are the final authorities of which public don't have access to.

As per the issue in contention whether "Petroleum Engineer and other occupations" have been added to MLTSSL or not.
Just to clarify this authoritatively, It has NOT been added to MLTSSL available to those who want to apply through GSM path. If you are applying for any GSM (General Skilled Migration e.g 189,489 visa etc )occupations, you can only nominate occupation which in this legislative instrument:

https://www.legislation.gov.au/Details/F2017L00850

With respect to the occupation MLTSSL list that DIBP refers to on their website that includes "Petroleum Engineer", you can only use that if you are being sponsored for 186 (Employer nominated visa) or 457 (4years-MLTSSL or 2years-STSOL ).

https://www.border.gov.au/Trav/Work/Work/Skills-assessment-and-assessing-authorities/skilled-occupations-lists/combined-stsol-mltssl

Don't make the mistake of assessing your occupation as a Petroleum Engineer hoping to be invited for any GSM visa; It is a waste of money. I would advise you should consider other options that will lead to PR.

If you wrote everything yourself, why did you have to check your work for plagiarism? or were you trying to see if you plagiarised yourself?

My suggestion is next time write your episides yourself.

You did an assistant??

Well, there are more things that are not clear than there are that are grin

1. You did write all the episodes yourself, but got a ban for plagiarism (I am not understanding )
2. Why must you use a plagiarism tool to check your own unique work?

I believe there is more to the story.
Normally, case officers will contact you if any slight form of plagiarism is detected. He would require you to explain yourself and possibly rewrite the episodes. This is a necessary formality.

When I discovered this is your first post since 2011, then I knew something is off. If you have actually read the guidelines and followed advice on here, I believe you would not have fallen into this pit.
Checking your unique work on plagiarism software is as good as shooting yourself in the foot.

It seems you have taken this in good faith. Wait till the end of the ban, then come here for good guidance.

The deed has already been done; so brace yourself and plan your next move.
Caveat to others yet to cross this hurdle; endeavor to have people you trust professionally and grammar wise to check your write up for you.
Plagiarism checkers majorly look for copyrights/ similarities in your work and existing writs or published work, and it also saves your work on its dBASE.
You shall overcome if you remain dedicated.

My brother I understand your argument,
I have studied in Australia and use of plagiarism tool is common each time you want to submit an assignment. Anyway, I used one from google site and not the main Turnitin. it was when all this happened that a friend told me about posts on Naira land. Then I saw advice from people here. If I had read all these posts earlier I would not have come to study at the first time. As I just finished my undergraduate and left for Australia a week after passing out from camp.
The mistake is done already, I believe there is a way out. That's why I decided to share pls

@Sikiy3,

I don't know anything about the ban but if you are sure that you wrote it yourself, I think you should appeal the decision. You can support with whatever evidence you have to substantiate your claim.
Re: General Guide To Australian Permanent Resident Visa Through Skilled Migration. by bellong: 2:40am On Jul 17, 2017
@ALL,

I want to apologise for the misinformation earlier posted about the 12 additional occupations. My understanding initially was that they are for 186 and 457 as bolanle053 opined. However, after talking with a migration agent friend who said they are available for 189 and that though not in the legislative instrument but was sent as a supplementary to a list available only to MARA registered agents. It was why I had a change of decision.

After reading NNB2012's post, I have gone back to re-read the instructions on DIBP's website. The mix up is that the combined eligible list of occupations is for all classes of visa using the MLTSSL, 189, 186, 457, 489. There is a further instruction that separated the lists for the subclasses which also includes the legislative instrument for each.

I am sorry about the mix up and the false hope given to some. I will take it up with my migration agent friend who misled me.

cc: bolanle053, Cottyekundayo, heshgirl

Meanwhile, @NNB2012, I beg to disagree that DIBP'S website is not an authority for up to date information. It is actually up to date with no misleading information. DIBP is a government agency that has a duty to provide the public with timely, correct and accurate information. The website is one of the avenue they do this and anything short of correct information is subjecting the agency to legal suit which I believe they can't afford.
In addition, legislative instrument, rules and regulations are available to members of the public which is why they are also provided on their website.

Nevertheless, thanks for pointing out the error on time.

Regards.

Thanks Bellong for acknowledging this.

Migration law is really complex in Australia because it is dynamic. It changes from time to time. Any Migration agent that is not conversant with the changes will always mislead people.

Well, you are right to disagree that the DIBP website is not the final authority. Kindly confirm this with your Migration agent's friend. He will categorically tell you that it is not, when it comes to Australian Migration practice. A good Migration agent would NOT even refer to it. All that is required to lodge a decision ready application is found in the documents previously mentioned which require subscription to access. I am not saying that you can't lodge a valid visa through the DIBP. Alot of people have done that successfully,including myself but then there is more to it.

@NNBB2012,

Thanks sir for the correction. I know what you are talking about.

It is not the legislative instrument which is available to members of the public but what is called "lexis Nexis" which is only available to MARA registered agents at subscription of $800/annum.

Sure bellong, I agree with you.

Personally, I don't use that at the moment but rather I use "LEGENDcom" which also gives you access to what the public don't have access to.

Like I said earlier, the DIBP website is sufficient for anybody to lodge visa application but not the final authority for any Migration agent. As matter of fact, Migration agent would not even refer to it when writing a letter of submission to the department on behalf of any client.

So if one want to go through the engineering technologist path....
Which one does one with 70 points stand a better chance with? 189 or 190 (nsw)
Considering 190 gives additional 5

You cannot claim any point for experience. It's less than the three years minimum, and that's even before assessment. So points from experience is gone.

You're right, VETASSESS requires a minimum 1 year experience closely related to your nominated occupation. And it's good you have at least a year and six months. VETASSESS will remove one year and you'll be left with 6 months following a positive assessment. You'll need to package your cv to reflect your role as a farm manager in relation to your nominated occupation. You can as well draft a payslip and get it printed on the farm's letter head and get it stamped by the farm owner or new manager based on your relationship with them.

I dunno much about it, but they have a thread on Nairaland too, although the pages are extremely long. Nevertheless, I am very sure you'll be favoured, therefore, give no room for guilt, self pity& depression especially if you're sure you didn't plagiarize your works. Another thing that I'm not sure of is if you have a skill you can assess with TRA or vetasses....
