Good day all,
I just received a Refusal Mail and 3 years ban from Australian Embassy.
I called them on Friday morning and was told my application will be finalized this week.

I callled them today to remind them of my start date. I was told it has been finalized and sent to migration officer for assent. The case officer that actually handled my application is Valdinah.
The Devil wants me to turn to evil and believe there is no God. There is God my dear.

Action taken already!..
-Called the Operational Bank manager of the Bank, he was expecting good news from me but hearing this he was shocked.
He told me that the Branch nor their head office in Lagos received any such mail from the embassy for confirmation from the bank and how come they reached conclusion of such.
The letter to my sponsor that I submitted was also cleared by their legal department in Lagos.
He has assured me of their support in any way the bank can help.

I spoke to a lawyer, we have agreed, he will write to the Embassy and copy the Bank as well, mandating the Embassy to carry out their personal investigation from the bank. Also that if the embassy did not want to give me visa that they should overturn the ban because at no point did my sponsor( Father ) submitted any bank statement that is not genuine.

Tomorrow, I will be heading to the lawyers office as today normallly is their Court proceedings for cases in court.
I will welcome any input and advice on the way forward.
Some persons that knows me outside this platform knows what i am saying. You may choose to believe or you may choose not to believe either.

My concern is that 3 years Ban, it will tarnish my record because of their inefficiency, laziness, carefree attitude and poor judgement to verify documents. My mum has been praying, prayer of death to any persons or officials involved in this unfair decision. I can't blame the old woman because she has been part of the process and seeing this one questions if truely God still exists, yes their is God, today, now and forever more.

I doubt these guys really verify documents from what has happened to me.

For those still waiting, be hopeful and believe in God.
People's faith and destiny are different!....
I will follow up with the lawyer and the Bank as regards to the letter they will be writing to the embassy.

Sorry To hear this Albion, you are one guy that always makes sense on this thread pls which yeye bank caused you this problem with their incompetence

Just make sure you find positives in any negativity. Keep your head up and don’t let that deter your dreams. So far I’ve known you to be of a strong person and you’ll come out stronger. Whatever follow up you want to take just know it will Favor you as you have the upper hand here.
The fault may as well be from someone at the bank headoffice failing to verify the mail from DIBP if any was sent.

oh dear albion, angry angry i still cannot comprehend their reason, because you took extra steps to clear their doubts when they asked for a new SOA. This is so heartbreaking my man, this is really testy, i urge you to be strong and take courage, do not fear or be dismayed. Gods matchless grace will order your steps through this.

And said that in my current position now in my working places am the assistant mag and said after my study that am coming back to still maintain the position which i told them.

Sorry about your refusal is sad to hear that you where not just refused but ban....Australia has been really strict with their visa and everything...even those who are permanent resident is being strip off from being permanent resident and sending them home.

You can go ahead with whatever you want to do but my own advise is not to go and waste more money in court and everything...doing that is like suing Australia Immigration which is not just once person but the country immigration which i doubt they would be a head way when you start that.

The country has the right to refuse any visa and allow whoever they wants to come into the country. I am very sure one of your documents somewhere is faulty or maybe you must have stated an information and they found out what you stated is not what happen or what you have.

How about we start by sponsor his bank or how much he has or something.
your certificates your working references
your SOP what did you state
does your age tally with what you provided and so on? is the maths correct.

check your documents properly something somewhere is wrong.

What was the reason why you where refused? because usually they do stated the reason....is it the bank statement or you just assuming?

Diamond Bank Plc. But the issue now is not the bank in question. I want to see if I can convinced the bank to write to the embassy in a separate letter asking them whom authorized to them that the statement of account issued to their customer is non genuine. I think by then, they will have to tell the bank who confirmed to them that the statement of account is non genuine.

Thank you very much. They have the right to refuse my visa yes, but the right to ban me for 3 years for something that I know that is not true, my dear I disagree with you on this.

Even after sending the letter that the bank issued to my sponsor stating that the statement of account is genuine and emanated from the bank and still not satisfied with it. The CO have pre- determined decision already , the bank will write to them and ask them who confirmed to them that the account is not genuine. N/B : We are talking about my Fathers statement of account not someone else.
My dear, my documents was correct and verifiable by any institution. Is it my Degree result, My license as a registered Nurse, my license as registered Midwife, Certificate of seminars attended or my SOP that I took my time to write. At did not mention in any place on my paper how much my Dad earns except his statement of account that I submitted.

My employment letter is verifiable from my employer, so which document or documents are you referring?.... I am a very thorough person and have held post in Organization not just my professional body.
Their decision was bent solely that the statement of account is not genuine.

I did not apply to DIBP to start romancing them with frivolous document.
Here is a screen shot of their statement.
Please someone should help me to clean the 2 places were my sponsors name appear, urgently please!..

You may have to contact your school and brief them about what happened before DIBP mandates them to refund your fees. Inform them about your plan to petition or appeal your ban and visa refusal and maybe request for deferment to July intake if available for your course. I have taken that into consideration!.
On my way to the lawyer's office for legal advice and write up by the laywer as well.

The bank will also right as well and I have 4 correspondence the letter will be copied to as well.

I have been reading your post regarding the refusals and very few people here have asked you a very important question.. what is the difference between the first bank statement you submitted and the second one they requested?

Please forget about legal action you are taking about because you will be wasting your money and time.

Embassies do verify bank statement with bank head quarters and not the local one, so be honest with yourself and examine what happened to those bank statements

JustWise i did asked the same questions but it looks like i am the only one is telling him not to take legal actions...i told him to verify all what he submitted but out of anger the conversation was turning into something else .. we all have been in the same position i was ban 5years from US before i decide to apply Australia i did not waste my time taking legal rather from the embassy i went straight to complete my Australia application and within a months i was issued visa..but if he wants to i mean he should first check within first before i look out.

Good morning @ Justwise, happy new year first of all. This is the first time you actually responded to my post.
On the question you asked, I want to thank you for taking out your time to ask this wonderful question.

Answers: My sponsor did not print any new statement of account. On the 18th of January, 2018. The DIBP wrote to me requesting for my Canadian student refusal letter and 3 months Statement of account.
My sponsor printed the statement of account 5 days after because this mail came on the last day of the week. I also got my refusal letter notorized it with the statement of account and uploaded it. N/B I was given 7 days to do that.

On the 3rd of February, 2018, which is our Friday by time zone and Saturday by their own time zone, I got a mail with the heading Natural Justice to comment on the statement of account of my sponsor seen as non genuine, I was given 14 days to respond to that. I responded to the mail on the 6th of February, 2018 with the letter from my sponsors bank affirming to the statement of account they issued to their customer. The bank sent the letter first to the legal department in Lagos for approval before it was now released to my sponsor.

I and my sponsor spent the whole day in the Bank waiting for the approval of the legal department after they typed the letter. In the letter, the bank stated they have re-attached the same statement of account issued to their customer previously for them to confirm.
This account in question is my fathers account and no such of ill malpractice was done on it.
I also did an affidavit of fact in the high court.
So dear, there is no shady deals of what so ever you might think or conceived in the mind.
With all these, the case officer bent on saying that is non genuine.

If my sponsor is guilty of such we won't be wasting our time pursing this. But I can't fold my hands and someone will sit in his or her office and raised a frivolous allegation on my reputation and I will keep mute.

As I am typing to you, am in my laywers office were he is drafting out the items with all the letters and correspondence.
The laywer will also write mandating the bank to explain what happened and all letter will be copied to the embassy.
You have every right to believe what you feel is right for you.

A clear conscience fears no accusation.
I have 2 or 3 persons on the platform that I worked closely and we all applied together. They know me and my family very well and they have been part of my journey in this application, we share ideas together and all that. For the sake of identity and rights I preserved their right not to disclose their identity here.

I will have to get to the root of this and know what really happened. But from my sponsors side nothing happened, the bank have more explanation to do on this.
That's all I can on this issue henceforth.
But remember, Case officers are human beings and their are Spiritual and Physical dominion in this life.
Experience is the best teacher. Some of us have not encountered, experienced or come across some things in life and you ask your self, "why me" of course, it will happen to a human being not a ghost. Thanks once again and God bless you!.

Depends on what they are requesting from you...Natural Justice means one or more information provided does not match or needs more clarification. This is where you stand to change your visa approval to either approved or denied...what you state or documents you send again means alot

When you receive a NJ letter, it is always a serious matter. It means that the visa officer has reason to believe that certain facts in your visa application are misleading or fraudulent.

Why you get such letter?

Any person who decides any matter without hearing both sides, though that person may have rightly decided, has not done justice. Any person whose rights, interests or legitimate expectations will be affected by a decision or finding is entitled to an adequate opportunity of being heard. In order to properly present their case, the person is entitled to know the grounds on which that decision or finding is to be taken.

You need to be very careful while replying such letter.Your case case may be rejected if you can not provide a satisfactory response to the visa officers queries.If your visa application is refused because you or any of the members of your family unit provide bogus documents or information that[color=#990000][/color] is false or misleading in a material particular, you might be prevented from being granted a visa for three years.

Please check your documents proper.
