Hello everyone,
HELP! HELP!! HELP!!!
I need an advice on an F1 visa issue and will really appreciate if I can get a way forward out of this. I know this house is full of gurus and highly blessed. Kindly help a sister in a jam.
My story goes thus:
Sometimes in 2016, my pregnant sister and her husband with their son applied for a US tourist visa and were granted. During the interview, the consular asked whether my sister will visit the doctor and she replied negative. My sister spent 5 months in the US and returned with the child. Their visa expired and the husband is the busy type and has no time for the renewal. Fast forward to this year, the husband was granted admission for a graduate study in the USA and was even offered a little scholarship by the school. The husband applied for F1 visa and was refused. During the interview, the consular stated that the husband travelled with his wife without their child to the USA two years ago and gave birth there after having misinformed the then consular that they will not visit the doctor. She asked where the wife is and the husband answered that she is at home with her business. She also asked how much was paid and the husband answered. The consular also asked for the receipt but the husband answered that when the wife is coming to renew her visa, she will bring it along. My sister's husband doesn't want to miss this scholarship so he wants to apply again before the school resumes late this month. What can he do to be granted the visa? Should he apply with his family again for F1 and F2 visa? Any suggestions from the gurus and VO's in the house?will really cherish one right now. Also, i believe it's the wife that wants to be punished by the VO, is it possible for the husband to be be approved the F1 while the wife is denied for the F2? Please kindly reply. All suggestions are welcome.

you can't if you have been denied within the last 6 months.

Actually you can. That 6months is mainly for b1/b2. F1 visa doesn't need 6months

Lol . This reminds on my first time making a sevis fee payment. The WU guy said it was a scam, even after showing him my documents and ID. I had to go to another WU outlet to make the payment.

I thought I'll chip in a few points to help guys who intend to pay their SEVIS fee through western union. You have to know the name of the recipient that you're paying it to to make for a successful transfer. The irony however, is that western union doesn't have SEVIS listed as a recipient on their system. So if you tell a western union agent who is not familiar with SEVIS that you want to pay your SEVIS fee, he won't be able to find SEVIS on the system. On the western union system, the recipient for SEVIS fee is saved as "US Bank DHS". So if you go to pay your SEVIS fee using western union, the recipient should be "US Bank DHS". Hope this helps folks who want to use western union to pay their SEVIS fee.

There is a process to paying the SEVIS fee in itself. The applicant or whoever wants to pay has to go on the fmjfee site and put in his or payment information viz-a-viz first and last name, school's sevis number, date of birth ... and then a receipt/ page would be generated. This will carry the western union account information to be paid to... This is to be printed out and taken to the western union shop for the payment. The agent will need sender's ID and that account information and it will be instantly processed.

Sorry to be harsh but it all this that makes it difficult for others... if she knew she was pregnant why did she lie during the visa time . Almost everybody know the embassy keeps record so the next visit your history can be flagged up . It a technology age so there is no point lying at any time.

To be honest nobody has the answer to bold above.... the mistake has been made and it really up to the VO at the time of interview . The best he can do is show all the evidence that the hospital was paid and hope for the best

A case of false misrepresentation. I hope you didn't use any public assistance? A way similar to naijatisumi's case, only that he hasn't seen the outcome of his F2 application. Talk to NIV on naiaraland. However, naijatisumi case could be 50/50 if he addresses his previous denials, his wife still on status and they didn't use public assistance during her maternity care.

Please, can you give more details about the emboldened? What type of public assistance can an international student get when they have health insurance? As an international student, you're mandated to have health insurance which is usually used for health related issues. However, it's possible to circumvent the system and illegally apply for and use public assistance in some states. It's easier in some states, e.g. Arizon, than others. If a person on a non-immigrant visa is found to have illegally used such services reserved for citizens, it will hinder any future immigration purposes.

Really? With the way the US is structured, is it even possible to apply and get something you are not qualified for? Like, will the hospital not be aware that you are not from the US? For immigration things in the future, the only way they can trace what benefits you got would be through your SSN. Without an SSN, they cannot trace it. And, if you had an SSN, the hospital would know that you are not from the US, and thus, not qualified for those benefits. So, again, how can you circumvent the system in a country like the US?

You've asked a lot of questions which will take forever to answer and some which I truthfully do not even have the answer to. However, it's possible. People come on even b1/b2 visas and somehow get and use public assistance. If it wasn't being done, they wouldn't be checking for it.

Just a piece of advice...America is nice, but you would have to face challenging situations once in a while that would stretch you. At the same time, they grow you. Sometimes you see people disappear from this thread after been active for a while..many times dealing with their personal issues. After a while, some come back and some don't. The good thing is, as long as you thread situations the legal way, it would be worth it!

Pls guys...I really need your opinion on this my mock transcript
VO; Hello,good morning
Me; Good morning,thank you
Vo;passport and I20?
(Passed)
Vo; what is your intent?
Me; Am going to st.cloud state uni for my undergraduate degree in computer engineering
Vo; Why U.S and not your country?
Me; Sir,the tertiary education in the U.S is top notch and regarded very high in every part of the world. I need the best possible education for my undergraduate degrees
Vo; how did you hear about the school?
Me; I saw it on the internet when I was looking up for good schools with small class size,it came up in the list and after my evaluation,I chose the sch and few other schs as well
Vo; So.....why the course?
Me; My fascination with this course has led me to realize that there is general lack of knowledge about the potentials of computer technology, and due to lack of solid implementation of computer skills,we experience technological failure all the time. So with this course,I will be equipped adequately with the knowledge required to improve efficiency in computer technology here in my country. This creative course will also give me brighter opportunities to work or partner with good companies like glo, mtn, etc
Vo; Tell me about the course?
Me; computer engineering is a branch of engineering that integrates several fields of computer science and electronic engineering required to develop computer hardwares and softwares. It is also a branch of engr that deals with almost every of our day-to-day engagements: the smartphones we use, elevators, computers, space travel, etc
Vo; Did u take any standardized test?
Me; yes....SAT,1030
Vo: who is your sponsor?
Me: my uncle?
Vo: what does he do?
Me: He is a professional lawyer who owns a law firm. Beside that,he has acres of land in 2 different location that he leases out to commercial farmers and mini mall....they all generate him heavy income
Vo: hmmmm......why your uncle and not your parents?
Me: He is trying to pay back my parents for training him in college and making him who he is today. This also coincides with the fact that am his favorite nephew(smiles)
Vo: What is your plan after graduation?
Me: After my graduation,I will come back to my country, apply for job, hopefully i will get one easily because their is a very high demand for computer
engrs. Our skill is really needed for the growth of the nation. Maybe i will also go to part-time lecturing

Interview on AUG 8, Visa Delayed

Vo: Good Morning
Me: Good morning

Vo: Tell me about your program and why you choose to study it
Me: (NB: my I-20 isn’t stating my exact course of study so I explain to her)

Vo: okay, tell me about your preferred course of study
Me: Information Assurance & Security involves protecting information and information systems from unauthorized use, access, disruption, destruction and modification in order to provide integrity, availability….she cuts in

Vo: Why did you choose to study it?
Me: I have an undergraduate degree in computer science and during my finals, I worked on a project on credit card fraud detection using hidden markov model. Ever since, I’ve been interested in tackling online fraud activities and however, my late dad and uncle who is my sponsor both had a fintech company, the fintech company is an online payment gateway company which is in line in operation with my current place of work, the company has been down for a while. So getting this degree would let me gain more technical knowledge and improve my practical skills needed in relaunching this start up alongside my uncle when I get back to Nigeria which is the primary reason why my uncle is sponsoring me. And however, the Nigerian Bureau of Statistics report shows that over $54bn worth of electronic payments were made in the second quarter of 2017 of which a large percentage were reported to be fraudulent. With the growth of SMEs in Nigeria and Africa at large, there is need for Information Assurance Specialist in tackling this setback.

Vo: How did you hear about the school?
Me: When I was doing my final year project on CREDIT CARD FRAUD DETECTION USING HIDDEN MARKOV MODEL, I sourced journals and publications written by Dr Joseph Elarde who later introduced me to Dr Jiang Li, both being associate professors at the department of computer science at APSU. Their contributions were so immense that ever since I had always wanted to be under their tutelage.

Vo: how many schools did you apply to?
Me: 2, AUSTIN PEAY STATE UNIVERSITY & MIDDLE TENNESSEE STATE UNIVERSITY. (both schools are in the same state, TENNESSEE)

Vo: What are the similarities between the two school?
Me: (I wasn’t expecting this question…….i think she asked this because I chose the same course for both schools) I can’t really remember what I said but I know I said something about both their curriculum fitting my career goals.

Vo: Why did you choose APSU over MTSU?
Me: When I was doing my final year project on CREDIT CARD FRAUD DETECTION USING HIDDEN MARKOV MODEL, I sourced journals and publication written by Dr Joseph Elarde who later introduced me to Dr Jiang Li, both being professors at the department of computer science at APSU. Their contributions were so immense that ever since I had always wanted to be under their tutelage. More so, my application at MTSU was still being processed at the time APSU gave me admission.

Vo: Why didn’t you wait for the admission at MTSU?
Me: The resumption date for APSU was getting close and I didn’t want to miss out on it.

Vo: Do you have a relative in Tennessee?
Me: Yes, my brother (and my mum, I didn’t mention this but I filled it in my DS-160 form, my brother is a US CITIZEN while my mum is a LEGAL PERMANENT RESIDENT)

Vo: Why did you choose two schools in the same state?
Me: (I think this was where the problem started, I wasn’t expecting this question) i said jargons but I know I said or mentioned it was a coincidence. (she tilted her ear like she didn’t hear what I said)

Vo: Are you married
Me: NO

Vo: Do you have kids?
Me: NO

Vo: Sorry you do not qualify for………………………….you know the rest
Me: I just waked away

I want to defer my admission at APSU to spring semester and start applying for the visa again. Am I to pay another SEVIS fee? Or do I just request for another i-20 and pay for the visa fee?
My brother said he wants me over there this year.
My brother has been in the US since 2008, he entered through the visa lottery scheme.
He graduated from MTSU in 2014, I think this was the point I missed out in the interview.

As I’m preparing for the next interview what are the points I need to pitch, indeed your candid advice. Thanks.

I believe that if you don't have health insurance, the hospital will mandate you to pay your medical bills, or does the hospital now pay foreigners' medical bills?

Yes the hospital will ask you to pay your medical bills but in some counties, the bill can be shared if you don't make enough money. In NM when you don't make enough and can't pay your medical bill, there is a program they run to pay outstanding medical bills for citizen and non-citizen. Davidlan used to be an old member here. In 2012 when I have a medical bill to pay and was advised in the hospital to use this program, this is the message I wrote to him. I had medical insurance before and after this hospital visit but not at the time of visit. Also, I've heard of a kind of medicaid program for pregnant women that foreign students can use but can't remember the program precisely.

Hello, this is imperiouxx from Nairaland. I have a question I should have asked before now from you. My medical insurance expired in June 2 and I went to a general hospital here in New Mexico in June 16 because I was having pain in my right side that I can't breath in properly, did x-ray and confirm nothing, I was given an injection because I was told it's just muscle strain. When the bill came it was $907. I called to setup payment plan and was told $50 is the only minimum I can pay per month. I went with my guardian to the hospital to tell them I can be paying $25. We met the lady in charge of account and she gave me a form to fill and submit today Friday 24. She said that the form will make the county pay some part of my bill and I pay the remaining. The program will last 6 months. My fear is Nigeria-US embassy when I go for my renewal before my PhD. Do you think I should submit this form or just pay on my own to avoid debate at the embassy when in Nigeria? Thanks

Thanks.
