Now they ask women or family applicants if you intend to give birth or see a doctor or if it purely for visit and I think that response is recorded somewhere and can be revisited at renewal or POE. That I have heard often that the record is and can be pulled out . So i think your comment is based on not understanding the process now at the US embassy in Nigeria for women who go return with a baby. If you understand it trust me your comment will be different .

Lawyer maybe you are adjusting status or something but lawyer for visiting b1b2 .... even the lawyer won't answer you . Visiting visa is at a VO discretion .



From the statement she was pregnant when she applied, probably even visible. ...from the second visit I gathered that the question was asked explicitly the first time .. although it doesn't say purposely lie so I give that to you. It wasn't hinted

That's the whole point of all my comments. There's no proof that they lied. The whole judge, jury and executioner responses so far is a little overreaction. In fact, as a defense, they could say if they were really up to tricks, they wouldn't go back to Nigeria. They'd remain here illegally and keep abusing their visa terms.

Saying to visit a lawyer now is for legal advise and how to go about things not for lawyer to follow them to the interview in Nigeria because like you said, it's not allowed for b1/b2 and all that. VOs and IOs are trained and excellent at their jobs but I promise you they aren't gods. They make mistakes too and they don't know everything. Many IO's decisions have been overturned after a Lawyer challenged their decision.

Finally, laws/rules are written in a technical way. You'll see things like "applicant who at the time of the interview, knowingly and deliberately tells the interviewer something untrue" or something along those lies. Can anybody here prove that the above happened? I can't. Unless they are inadmissible, for things like visa overstay, misrepresentation and the likes, their case is not that bad.

Just a quick reminder, OP never said his sister was asked whether she was pregnant or not which would have been an issue if she lied about being pregnant. Let's assume the pregnancy was obvious and they told VO they wouldn't be visiting a doctor here, nobody here can say with authority when the decision to visit a doctor in the US and have their baby here was made by the couple. It could be anytime.

If the law says they should inform authorities of change of plans, then you're right. They should have (again, everything has a defense). The law says people should inform immigration, dmv, etc. Of address change within 10 days of moving. Many people don't even do that.

Thanks for the healthy exchange of opinions. I hope OP is learning from back and forth dialogue and the right decision is made.

First Interview: June 30th 2018 - Denied
I was interviewed by one young white lady that never sits down in Abuja

Here is my transcript

VO: Your passport and i-20 ( She can't even greet like I'm her mate)

VO: **Starts typing** what's your intent?
ME: Pardon

I was interviewed by one white guy in Abuja

ME: 5000usd yearly exclusive of living expenses.

I plan to work for maximum of 5 years in this position while setting a stage to running my own IT company where I'd be dealing with creation of new generation secure and dependable enterprise systems to power most businesses in Nigeria while offering employment opportunities to Nigerians who wants to make a career in the field. I believe my program would help me achieve this goal.
VO: **waits for a long while while typing** What proof do you have that your living expenses would be taken care of?
ME: I have my sponsors personal and business statement of account.
VO: Give me his personal statement of account.
ME: I passed it
VO: I will be approving your visa. ( Passes two white papers). Paper contains how you will get back your passport and what you need to know before travel. But I'd hold on to your statement to run a thorough check. If found fraudulent, you will be deported even if you are in the states. Should I proceed with it?

Went out dumbfounded and unable to contain the possibility of getting my visa despite my Canadian ban. But God made it happen anyway.

Visa approved on the 4th of august 2018 after first denial, really grateful to God and everyone that has contributed on this thread.

For my first interview, I honestly wasn’t as prepared as I thought, I actually felt like it was going to be very easy to get.

Worst thing after the denial was when I tried to book an appointment and it just seemed impossible. The frustration was not here at all! Imagine the number of times I called them and they kept saying the same thing. My account was even frozen multiple times due to constant checking but thank God that’s all history now.

First interview transcript on the 23rd of may, 2018
VO- Why are you going to the US .
Me : I'm going for my masters in Industrial Engineering at texas A&M - Kingsville

Me - Oh that wasn’t a problem for me at all.

I'm not sure you read his post before replying because you seems to be playing along with some sort of theory as if you are creating your own narrative.

One of the VOs here has written at length about this type of situation I even copied and attached it to this thread https://www.nairaland.com/4250945/give-birth-usa-cost-procedures.

This is a very common situation with many Nigerians traveling to US for child birth.

While I'm not a lawyer or expert in cases like this, I just wanna give you my 2 cents. This may be a very unpopular opinion but hey, it's just an advise, so feel free to ignore it.

The law is not a black or white thing. This is why for cases you're not sure of, the advise is primarily to consult a lawyer. You'd be surprised how easy it is to get through situations that look super complex to the ordinary eye.

That being said, IMO, there is absolutely NO beyond-reasonable-doubt proof that your sister or her husband lied to the VO during their first visa interview. It's not like they have proof of a conversation they had to support a preconceived plan to do the above. People change their minds all the time. People come here just to visit for a week, meet a girl with asss so fat, decide they're not going home again, marry the girl and apply for GC, say their plans changed after they got here. Oga mi Sir, they get their GC.

In your case, maybe your sister and her husband honestly had no intention of having their baby here or visit the doctor. Suppose I were in her shoes, and I woke up one day with blood coming out of me, you think I will risk my life and die because I told one VO that I won't be seeing Doctor? No sir, I will call 911 if needed and get the best treatment and that's not a crime.

This case is not as impossible as it looks, and also you didn't tell the whole story. If they paid all bills out of pocket or whatever the case is, tell them to take all relevant documents along on their next visit to the embassy. He also has to state clearly that "No Sir, we didn't misinform the previous VO. Things happened that way because..."

If the matter pass you, your sister abi her husband, consult immigration lawyer. Better one o, not 200 Naira lawyers under bridge in Ikeja. But if I were you, I'd handle this myself sha. It's not a big deal.

Sorry to be harsh but it all this that makes it difficult for others... if she knew she was pregnant why did she lie during the visa time . Almost everybody know the embassy keeps record so the next visit your history can be flagged up . It a technology age so there is no point lying at any time.

To be honest nobody has the answer to bold above.... the mistake has been made and it really up to the VO at the time of interview . The best he can do is show all the evidence that the hospital was paid and hope for the best

After two denials, finally got approved by Window 21 today. Thanks to everyone who took out time to respond to my enquiries. This is one of the finest communities on the internet.

My advice to anyone who has been denied in the past:

1. Never give up. Just think of each obstacle as a temporary setback.
2. My average GPA and extra year didn't stop me from getting a partial scholarship - took GRE and TOEFL though.
3. Pay close attention to your financial documentation
4. Don't try to be 'too' perfect. "Too many lies spoils the soup". Not having to lie would probably give you peace of mind to sound confident.
5. F1 interview is just a conversation really. Don't cram stuff. No VO wants to interview a 'robot'.
6. I think there are no rules to this thing, work hard towards what you want and just leave luck to heaven.

No... You don't need to pay another sevis fee as far as the one you paid is not up to 365days
