Thanks o. I had started to think of all the possible things that could go wrong with medicals. it will surely end in praise.

Hello Onyeenyeh,

The matter reach to worry. We are in the same boat. I submitted on the 29th of July and I never pass medical too. When I saw your post, I went to check my account and I saw that the Background Check changed to Not Applicable. I decided to check up things online and I discovered that we are in stage NA1.

Call the center you did your medicals from... Its possible they have not even transmitted the result to CIC or it was sent late.

I doubt if she has to submit... I did my masters St the University of Aberdeen and I only sent my transcript. I advise she go to Wes website so she can know what document she's required to send.

There should be o.

From your post, I deduce you are not interested in a divorce proceeding so the other way around is getting the spouse to go for medical and PCC.
Hopefully this works and spouse is Unaccompanying. That way, a window for reconcilation remains should the relationship improve in the future and you wish to sponsor the person coming over

For the unaccompanying spouse, you will need to have POF cover the spouse and have them take the CIC recommended passport photo.

Ask a legal practitioner about the separation agreement i.e if the Nigerian courts grants this. Highly unlikely

As for an affidavit proving you have been separated for xyz years, dont bother yourself. CIC will not accept it. I have it on good record from a fellow Nigerian who still got an ADR requesting for the divorce proof after using an affidavit.

Canadian visa forum is also helpful with info of this sort.
Good luck

Thanks bro. You really covered alot because i was thinking of that affidavit.

I didnt want to open a divorce proceeding yet because i foresee the individual coming to her senses in the future and i wanted to take her back when that happens.

But guess i have to take the divorce route. Only the time it would take might be an issue.

Secondly, would evidence of an ongoing divorce proceeding serve?

There's an option for legally separated, you might want to talk to lawyers and see if that would work, esp since you've been separated for a while. a friend is exploring that option but not finalised yet . on the other hand the unaccompany without spouse option if you can talk her into a day of medicals and pcc.

Peculiar case here.

About to join the pool. Married but separated for 2years now. No court processes started but marriage broken down irretrievably.

Have good crs scores both as a single and married individual not traveling with spouse.

But the problem is the aspect of compulsory medical for spouse even if not traveling with spouse.

Kindly advice on the best way to go about it.
think you should fast track your divorce documents or better still apply as a single/never married. IMO

Personal preference TBH. Each LOE may be scanned together with the specific docs they address and uploaded together in the assigned placeholder or you have one general LOE that addresses everything that needs to be addressed and uploaded in the additional documents placeholder.

Thanks a lot.

wrong move. I think legally separated is the best option he can explore; or just talk/beg her cos divorce sef she might not sign.

Please tweet at CIC for the question above.

I have heard of someone whose FSW application was with CIC and her divorce proceedings was ongoing so this leads me to believe it is possible. However, I don't have ALL the particulars of this case and this is information I was given. You will need to research further yourself, speak to people going through such and possibly a lawyer with experience in divorce cases

Nairaland is very big bro. Maybe someone will inbox you and give you information on what they are going through or what they know. Divorce/separation is a very sensitive issue so not many will wish to speak openly
