Hello Nairalanders,

I was discussing with a friend yesterday about Canada express entry and she said that its possible to enter into the pool ( express entry) while your study application is still ongoing. I beg to differ.

Is it proper or advisable to do that?

goingforward.

One of the pre conditions for study visa is to prove to the satisfaction of VO that the foreign national would leave the country after study. Officer may feel like you are jumping the wait time for PR processing and are only getting visa for entering the country earlier and won't finish your course. Having said that, you can write a compelling letter with your study visa application that you want to advance your career and would be in much better situation in terms of employability after finishing your studies.

Your existing PR app won't be impacted by any of this . Good luck .

It is possible but a friend here had an issue. His study visa was refused and one of the issues upon receipt of Case Notes was that he had multiple EE applications which presupposes that he does not intend to stay in Canada temporarily!

I hope this helps

Emmm, the bold actually wouldn't be the main reason for that refusal since the law allows dual intent. Apparently, the applicant was not able to convince the Visa officer that he/she would meet the requirement of a temporary visa(Study permit) while having a PR application simultaneously. The problem most applicants would have is convincing the VO and meeting the separate requirements of each category of residency hence it is advisable to proceed with one.

From a nairalander experience: He was very well established in Nigeria. Had a functional company, business and investments worth millions and, immediate family was in Nigeria. He wanted to upgrade himself academically and also relocate his family members to Canada. Well, He applied for his SP and without a decision, he also applied for PR for himself and dependants. His SP visa was approved and visa issued, PR application approved too later on. However, on request of his passport, the SP visa was cancelled and the PR visa issued as expected.

Note: He was well established in Nigeria which i believe the officer was convinced he would return to the investments he had in Nigeria and he also met other requirements of a study permit hence it was approved even before considering the PR application as they are reviewed separately. So the problem is majority of folks applying do not have strong evidence to meet both requirements at the same time.

Best advise for people would be to apply for the one they can substantiate well enough and are able to meet the requirements.

Regards.

Thanks @austinpee4 for your response.

I think its better to wait for one to pull through before applying for the other. But in this case can same applicant who applied for Study permit after the Study TRV has been received and whilst now studying also apply for PR or would it be the spouse that can that can only do so?

If the study applicant can apply for PR in this case the visa officer will then cancel the study permit and issue PR right?

All the people whose eligibility of review has begun already have a very good chance of hearing from the VO before resumption and very definitely before deadline for registration closes. My concern is for those whose review of eligibility has still not started yet. But then in some cases, review of eligibility has been known to have been started and ended with a decision all within 24hrs. So all hope is not lost for many fall resuming applicants that have filed months ago and still not experienced any shift in their online status.

I will advice people apply for study permit and if that fails repeatedly, go for the express route. Not the other way around, applying for the express route before the study permit. Why? Because if you applied for the express route first and failed and then proceed to study permit, your failed express application can still be used against you as demonstrating an intent to immigrate in the past. I won’t advice people to maintain both a study permit application and express application at the same time. You never know which VO you are going to meet. All your explanation may fall on deaf ears. At least two people here were denied who had dual intent. Better to be safe than sorry. Apply for study permit first and if all attempts proves abortive, proceed to Express Route. In that order.

Having said that, to answer your question, after you are in Canada, not a problem at all to apply for the express route. If you are successful, the express permanent residency status will supersede the study permit. In other words, the permanent residency by default overrides the study permit.

If you have already deferred to January, then just chill out. Not withstanding, no your attempt to inquire is not a sign of desperation. Average processing time is past and it is reasonable to inquire the status of your application of you would like to.

Yeah, i think it is better to go one step at a time being that it will be a mountainous task convincing and convincing but then, if an idividual feels he/she can match up the requirements, there is absolutely nothing wrong applying for both at the same time. The law allows for it and they are reviewed separately.

An applicant who has received his or her study permit and now studying can absolutely apply for PR provided they meet the requirements.
Understandably, there are two classes or route for an inland international student applying for PR.

1. Applying through the FSW(Federal skill worker) program if they already had work experience prior to study, evaluate their highest academic qualification using the ECA, have all other requirements(lang, funds).
This will also mean the student would be applying for PR as though he/she is applying as others applying from outside Canada even though present in Canada.
@Osemigho did same and has his PR now.

2. Canadian Experience Class. This would require the student to have achieved a Canadian work experience and possibly a Canadian education. Your job in Canada will have to be in skill type/level A, B or O of atleast one year and of 30hours/week same as the FSW only that there is no required settlement funds required in this class.

Lastly, when you obtain your COPR(Confirmation of permanent residence), you only document and change status on various places you declared as student earlier before you became a PR. The officers will proceed on your change of status. Also, both the PR and SP visa are mainly issued to people outside Canada to enable them board an aircraft, clear immigration and be admitted into Canada. The visa foil on a passport is neither a study permit or a permanent resident card. These documents are only issued once in Canada but if the study permit visa was issued for multiple entry into Canada, they will be cancelled by the immigration Authorities when you go to change your status and collect your PR card. This is because you will not be needing a visa to travel in and out of Canada anymore. You will need just your PR card as you would have become a permanent resident.

Hope this brings clarity to you and others in need of this info.

Regards.

Yeah, i get. If he was able to meet and satisfy the officer, i doubt he/she would have mentioned the EE in the file note.

All the same, you gave a good advise.

Hey Guys,

I don't think it is necessary to delay your PR application based on subjective assumptions that both applications might be conflicting wrt fulfilling the requirements as a temporary resident. PR applications can be demanding and time consuming, and it is better to use opportunities like valid medicals once. This is especially when the benefits of studying as a PR is significant when compared to TR (access to more funding opportunities, you can work more hours, health insurance, etc). In addition, my understanding is that different departments handle PR and TR applications.

I had my study permit application and PR application submitted at the same time. Both came out favorably.

Different departments handle PR and TR of the same beauracracy. Information that could easily accessed by any of them at the tap of a button. I am glad you had both simultaneously running and it turned out favorable. All cases are not the same. It is a fact, not subjective proposition that one can be bounced for simply filing both applications at the same time. We have experienced at least two of those on this forum. It is better to err on the side of caution by pursuing both applications separately. Just my opinion.

Hi,

My sister in law just got admission to a Canadian university and wants to apply for study permit can someone please provide answers to my question below

1. Does she have to pay the school fees before applying for student visa

2. Can her sister who stays in Canada as a PR, write a letter stating she would be staying with her and take care of her expenses in Canada also with bank statement since she resides in the same city with the school. Her dad is the main sponsor and would be providing bank statement and documents of properties . We just want to use her sister to solidify the documentation

3. Which is better online or going through Vfs.

Thanks and God bless.

Is it possible for one to carry along his/her fee in Naira to Canada and probably get official rate at Canada bank when paying fees? because I'm thinking of carrying my fee along with me to Canada to avoid this killing exchange rate in Nigeria. Nigerian students in Canada please advice accordingly

]My advice is
1. Let her not pay school fee if the school didn't request for initial deposit (mostly the colleges in Canada will ask for small deposit) before getting his/her offer letter, reason is this. In my opinion, paying school fee before applying for visa triggers the VO suspicion instinct that you're not genuine student who will leave Canada and hence you need to prove beyond reasonable doubt to VO that you're a genuine student. About 90% of the Visa refusals on this forum paid part of their fees in advance but of all those who applied without initial fee payment up to 95% got visa approved. Note: in either way you must prove to VO that you're a genuine student.

Secondly, paying fee before Visa application does not add single benefit to your application but rather makes it more prone to complex scrutiny. Apart from that, in the event of been refuse Visa you may also lose huge part of your fee if requested for refund. Some schools refund 70% , 50% and others you may lose the whole money after one deferment

2.. Yes, but the Canada PR holder will emphasize that he or her is doing so in order to help the student achieved his/her dreams back home after studying in Canada.

3. Both routes have equal chances, however in recent time, the precisely last 3 months has shown more favour to paper route in terms of processing pace

I know some people will argue No1 but fact speaks for itself[/b]
