In Nigeria, the general test for tax deductibility of expenses by companies, is that any expense incurred in generating the profits of a company must satisfy all the four major conditions stated in the CITA(Companies Income Tax Act), usually referred to as the WREN test. In essence, the expense must be wholly, reasonably, exclusively and necessarily incurred during that period for the purpose of generating the profits of the business. The details of the conditions are specified below: Wholly – the entire expense amount must be incurred in generating the profits of the company. Reasonably – the expense must be reasonable in relation to the profit or loss for the period, comparative amounts of the expense in previous years, materiality of the amount of the expense, general business environment, industry practice and relevant regulatory approvals. Exclusively – the business alone must have obtained the benefit of incurring that expense. Any part of that expense relating to a benefit derived by some other persons will not be allowed as a deduction from the income of the business. Necessarily – the expense should be such that the company’s business profit cannot be derived without incurring that expense. A business owner's income will include salaries(if acting as say CEO),directors fees and dividends. Any other manipulation of expenses ,is fraudulent and criminal!. Atiku should be prosecuted for false declaration. |

Almost everyone is missing the point, Atiku is retired public servant and a pensioner so he's not supposed to pay income tax same reason buhari is not declaring his income tax because there's not to declare. The tax law exempt two sets of people from paying tax under 18 and over 60 years. In essence income tax is for the working class between 18 and 60. At 60 you are deemed a senior citizen and not expected to work again. Anyway does the secretary of military board still exists in Nigeria because I know all army records are kept their base in lokoja so it would take more than two hours to retrieve copies of Buhari credentials if they ever existed. One thing about government service is start they always for credentials in multiple copies so at least one copy can always be located unless of course it never existed. |

People who have no idea how a business structure works will not understand that there's a difference between company money and personal money. Company money is different from your money. Though your company might be worth billions, it's not your money. Your money is what the company gives you in salaries, bonuses, sponsorship, travel expenses, et AL. |

frugal:You too lack understanding of how business works. Yes there is difference between company money and personal money. Also there is difference between company expenses and personal expenses.So any personal expenses included in company expenses,is fraudulent and criminal if not removed for tax purpose. If Your company gives you bonuses,salaries,travel expenses(not related to business transactions) ,et al,you must disclose it as part of your personal income for tax purpose. It is criminal for personal expenses(e.g political expenses,personal travels,feeding,purchase and maintenance of private jets,etc) to be included as part of company expenses.All these should be added back as part of the personal benefits/income of the business owner. All personal benefits of a business owner,derived from his business must be disclosed and taxed. Only business related expenses are allowed by the tax law. |
