Please, is it true that for settlement visa accommodation requirement:

Where:
A is the net income (after deduction of income tax and National Insurance contributions);

B is housing costs (i.e. what needs to be spent on accommodation); and

C is the amount of Income Support an equivalent British family of that size can receive.

A – B ≥ C
A minus B is greater than or equal to C.

Please does the above apply for settlement visa?

Nope, not at the same time. They might call sponsor, if certain clarifications are required........

Good evening all, please this newbie needs some help with reagrds to PBS dependent application for myself and child. We had previously applied as a family and my husband's visa was granted but I was refused, which meant automatic refusal for my child too (we made an avoidable mistake).

So, our plan is to reapply, but we have had to start a fresh with the maintenance funds, so our 90days is still counting. However, reading through this thread, @nomad26 stated that he got a letter from his employers which basically says they'll take care of his partners maintenance.

My husband's employer is an A-rated sponsor, so for sure if he requests for the maintenance letter, it should cover for the applicant(s) right? Does it help to explore this route?

Also, with regards to tenancy agreement (part of the documents required) I hope dates on the document won't be an issue, for instance if my husband moves into a property a few days or weeks to our application (cos you never know with these people).

And lastly, I'd appreciate tips on other supporting documents we can add when application, just so we don't have issues again.

Cc @lexusgs430 @justwise @nomad26 and anyone else who can advice on this.

Many thanks in advance.

Why was the first application refused?

The answer to your first question is yes he should explore the option and for the second question.. it doesn't matter as long as you have your tendency agreement and a letter from the landlord/landlady will also help

But they requested a video interview with the Eco and applicant (I'm the applicant) next two weeks. And they sent my spouse a mail saying he'll be called at that same time

Why are applicants requesting a video interview?

@justwise thank you.

We had informed his employers that we wanted maintenance ticked for all 3 of us, however, when the CoS was received (over a month after), it seemed to only cover for him. Although, in the note section of the document, it said maintenance was ticked (for the migrant, which was questionable) and in the section where they were meant to actually tick affirmative, it was N. This didn't look good.

So we raised this with them and they said the note part would suffice, that if it was for the principal applicant alone, it would have said "migrant only".

Sadly, we had not prepared funds for 90days for all 3 of us as we had been assured before that the CoS would cover. We were also running out of time because he had to resume his job (because they had already moved it forward a couple of times before).

Like I said, it was all avoidable as we would have simply not trusted them 100% and set out own maintenance funds aside.

I hope someone learns from this.

I think that is the issue here, so its better to go with the 90days fund rather than depending on there since they appeared not to be straightforward with it

In my CoS, Y was ticked for maintenance and my employer also provided a signed letter for my husband's application.
What was the reason stated for your application refusal?

@Lexusgs430, Decision for the couple i told you about was overturned after three weeks and visa was picked up three days ago. Thank you so much for the advice.

Lexusgs430:

While this is ongoing, also file an appeal (so you don't lose that window)......

Also state in the formal letter, that you have lodged an appeal, against the original decision.....

NB: I would have expected them to either put a phone call through or email, requesting missing documents...... But who am I to be expecting .......

I am happy for you and them..... Extend our greetings to them.....

They should also come pay prophet's offering......
Re: UK Spouse Visa/Appeal Process-part2 by Nobody: 12:33am On Dec 23, 2018
@justwise yes, that's the plan. Thank you.

@nomad26 in the maintenance part of my husband's CoS, N was ticked, however in the space for sponsors note, they stated that "maintenance is ticked for this migrant" and this isn't what we expected as we had informed them we wanted them to tick Y to cover the family.

In the end, my husband got his Visa (as it was clear maintenance covered him) and mine and my child's one was refused, seeing as the CoS didn't cover for us all.

We will now go through the bank statement route when we reapply.

Best to send the letter and exercise a bit of patience, saving them over £2300........

When patience wears thin, the latter option can be considered. But I am so over confident that upon reconsideration, the initial decision would be overturned....

Lawyers too got bills to pay, so they would never say no to any paying client.......

Don't worry, once you pay prophet's tithe in Naira, we would convert it to pounds sterling............ wink
