somehow:Which court. The court where he has appointed his own lawyer? The lawyer will simply look for a lie to cover up the act and the derail of justice will continue. You need a bigger lie to cover up the previous one. |

Racoon:Yes. The same judiciary is the number one obstacle to the fight of corruption in Nigeria. All you have to do is share 10% of your loot to buy/bribe the judge(s), and the rule of law will be promptly disregarded. |

Law is Law, No sentiment. What is sauce for the goose is sauce for the gander. Simple! "According to Section 11 of the Interpretation Act, Cap 123, Vol. 8, LFN, 2004, the President can suspend indefinitely but not remove without senate. And the President just exercised this *This was the law that Mike Ozekhome ,SAN deployed in his argument supporting the suspension of Justice Salami*

mcquin:did buhari pocket the judiciary like before? NO in case of sanusi, it was sanusi that said money was missing, and he was remove, but in onnogen case, onnogen is not accusing buhari for stealing, but is buhari that is telling onnogen of breaching the constitution for failing to declare his asset. in saner clime, onnogen should have honourably resign, this cant happen in advance country. after admitting of taking bribe from pdp. |

Who told you it didn't go through the proper channel? If CCT can't summon him, who then can? Chief judge as powerful as the president, yet it's the president that appoints chief judges. Bro your argument is weak. Rubbiish: |

What you posted is not complete, stop being clever by half, where is iii? just quote the page on the constitution and i will help you post it in clearer terms. CCT order was what the president carried out. the chief judge was asked to step aside pending when investigation is completed. you cant be the judge over your own case. If he remains the head while his case is being probed, he can influence the outcome as seen by his action of postponing the NJC meeting indefinitely, he was afraid they might have dealt with him via that medium. that alone is enough to cast negative clouds over his intentions. Question remains, why are we not discussing the allegations? why concentrate on his suspension? if he's pure, let him defend the allegations and his reinstation won't take long. ezkimow: |

somehow:Oya start explaining I'm not trying to be clever here, if what you have is different simply post it and explain it simple. Nobody exempted him from the allegations, we are only saying that there is a procedure to follow if they want to remove him, not doing so by hook or crook

EFCC Files Fraud Charges against CCT Chairman, Danladi Umar ……..https://www.thisdaylive.com/index.php/2018/02/03/efcc-files-fraud-charges-against-cct-chairman-danladi-umar/ This case is over a one year now. Why has Buhari not suspended the CCT Chairman? Because of Buhari's nepotism, of course. |

You still didn't post iii (or b2), check again or let me have the section you're quoting and i will post it here. “(ii) Chief Judge of a State, Grand Kadi of a Sharia Court of Appeal or President of a Customary Court of Appeal of a State, by the Governor acting on an address supported by two-thirds majority of the House of Assembly of the State, praying that he be so removed for his inability to discharge the functions of his office or appointment (whether arising from infirmity of mind or of body) or for misconduct or contravention of the Code of Conduct.” Moreover, while it did not say whether the CJN can also be removed on the order of a court – the CCT in this case, the interpretation act, chapter 192, seems to also empower the president to remove who he has appointed. Section 11 of the act states: “Where an enactment confers a power to appoint a person either to an office or to exercise any function, whether for a specified period or not, the power includes: a. power to appoint a person by name or to appoint the holder from time to time in a particular office, b. power to remove or suspend him, c. power to reappoint or reinstate him; to appoint a person to act in his place, either generally or in regard to specified functions.” The president doesn't have any fault here because he simply carried out CCT order. if any discrepancy is being smelt, let those not happy confront the CCT. He should step aside and let the probe go on without undue influence from him. ezkimow:There is no provision of the Constitution that speaks about the suspension of judicial officers, including the Chief Justice of Nigeria. S. 292 of the Constitution that is being bandied around speaks about the REMOVAL and not the suspension of judicial officers. |

Jesusloveyou:I want to believe you are literate enough to understand the separation of power principle. The law does not provide for any disciplinary measure against the Judiciary by the Executive. The NJC is charged with that function. The President cannot play a supervisory role on the legislature or Judiciary, they have equal powers, only that the Executive embodies the State. Buhari therefore has no business meddling in Judiciary's affairs. Whether Onnoghen chose to resign or not isn't a constitutional issue, he is not bound to after all Osibanjo was fingered in a corruption case, but did not resign. What is of constitutional concern is, "is there a procedure for removing the CJ if there is a case of misconduct against him? Was that procedure observed? Take it from there. |
