please i need an expert advice urgently, i was denied in 2013 under 320 7(a) which is a category of visa refusal when deception was used, Its a long story. I ddn't get a ban thankfully, but what was written on the letter is that any future application MAY be denied under 320(7b) which is the Ban for 10years. Fast forward 2019, My circumstances have greatly changed, married for five years now and i have a son who is a U.S citizen. My wife who is a doctor is about to apply for her TIER2 visa to work in the UK and i and my son are her dependents. please i would like to know if we can go ahead and apply for her TIer2 as a family, I would like to know if past refusal under 320 7(a) would not jeopardise the application. i am just worried and i need clarity to alleviate my concerns. Thank you all in advance !!

Hello, It will really depend on the year u were born... if u were born after the citizen by birth was cancelled then u simply apply for a tourist visa...no long story just put a copy of ur birth certificate just to pove that you were actually born in the Uk because it will b stated in ur Nigerian passport...You really have no claim to the UK if u were born after 1986 or so...

Sugarkay:
pls I ve a question to ask n will appreciate if help can be given, I have a Nigerian passport with place of birth which is UK ,( I can prove may place of birth if need be ) which is true, pls which visa is best to apply for. thank you

Let me speak to the separate part of your issue that I'm aware of, i.e. how 320 (7A) works:

About 320 (7A) - once you get that, I'm afraid you're virtually banned. The "may" in the "future applications may be denied under 320 (7B)" refers only to serious compassionate grounds for a visa grant. Such grounds are usually grave health conditions or the refugee/asylum scenarios, etc.

However, assuming the reason for your denial under 320 (7A) was overstaying, you just may have a chance. If it was for the use of false documents/making false statements, you need to conclusively show that you were unaware of this to slip out of a 320(7B) ban, which you should have addressed at the time.

Visa issues can also cut across categories - in other words, if you had trouble with a visitor's visa application, it can affect a student's visa application, for instance. I know someone who overstayed for a long while, returned, was denied visitor's visas twice thereafter, and a student's visa (for a master's) twice as well (came from a wealthy family and was fully funded and all that) until she gave up and went elsewhere. This however was before Theresa May brought in the new Immigration Rules in 2011. Things are apt to be even tighter now.

The new rules only make reference to visitor's visas being automatically refused in the event of any deception or fraud with previous applications of any category, but I think its only reasonable to assume that the reverse would also be the case.

Will this affect your wife's Tier 2 application with respect to you as a dependent? I can't say conclusively, not having come across someone who has your specific problem before, but I don't think that you can expect much leniency, if at all in today's hysterical immigration climate in the UK (read up about the Immigration Bill that was passed last night to give you a better idea of what these people are thinking).

Best of luck to you.

Dear justwise, good evening and thank you for the wonderful thing you’re doing here. Please I have a question. I had applied for the UK visit visa with my wife in October 2018 and we were giving 6 months visas each as first timers. We travelled to the UK in November and came back to Nigeria after 15 days. First question is, can I reapply in March before the expiration of the visa which is 25th April? because I plan to travel in May. Secondly, my wife has just put to birth our first child and she is 3 weeks old now, do I need to get a passport for her and apply for her visa too when I’m putting a new application for me and my wife?
Thank you in advance

Hello. @justwise and others.
Please i have a question to ask. I want to apply for a renewal for my visa that will expire around april. I want to apply for a 2 year visa this time around. However in the past i had been denied a visa three times. But on the third time, i appealed through the organization that organized the convention i intended on attending and they overturned the decision and gave me a visa.
So i wish to ask would the past denials pose affect my chances of getting the visa? And can i get a 2 years visa if i apply as a tourist
now? Also I have a student visa for south africa as I plan on starting my phd research next month. Please what are my chances and any advice for me?

As long as you declare previous refusal you will be find in that aspect.

Yes you can apply for 2yrs but whether you will be issued or not its up to the ECO and documents you submitted.

Hi All,

I need some advice if possible.

I'm British, my wife Nigerian. She's with me here on a settlement visa all fine.

We applied for a visitor visa for her mum to come and visit and we were refused on the grounds that we hadn't proved that she would leave the UK once her visa has expired.

We stated the dates she would be visiting from and to, proved that I would be sponsoring her financially in full, proved she would be staying with us.

She is retired and relies on money from her sons and daughters and what little pension she gets.

Cheers

Was that bit stated in her application?

1. Yes you can apply in March no problem.

2. I'm not sure about this but you can check Nigeria immigration website about child passport to know if you can get her a passport or her visa will be attached to your wifes

Good evening sir, please I need your candid advice.
I intend to attend a conference organised by British Society of Animal Science which will be held at Edinburgh Scotland. Although am a postgraduate member of the society. Sir I had paid for the conference £180 for students member and I also got an invitation letter from them. The registrar of my school had also given me a letter of introduction.

Sir I intend to use my supervisors statement of account, although am paying for my flight and accommodation but just that I don't have the money in bulk rather it's coming in piece meal from my poultry business. Do I have to submit my own personal account statement too? Or just my supervisor own?

Also I had traveled to UAE in 2014 and was also fortunate to get US visit visa in 2015 but I was returned at the point of entry and landed a five year ban. ( No criminal offence o). Sir, but this passport had expired and I already got a new one. Should I tell them of my US visit in my form? Should I go with the former passport.

Your candid advice sir @justwise

Yes

Then you need to explain every unverifiable lodgement that’s significant to your account balance. You should backup each of your explanation with supporting documentation (where possible).

That will not help your application by any chance, you have to proof that you are financially capable of sponsoring yourself fro the trip.

wow thank you so much, i got in touch with an immigration lawyer and he made me realize that am not off the hook, and wants to make a request to the home office regarding reports on the issue, In fact am no longer interested, because i understand that all of this might result in waste of time and money until the period of timing is over, Thanks a lot and please if you can kindly relay this case to anyone who can give somewhat a varying opinion over this issue, maybe i might stand a chance with my wife's TIER 2 Application as a dependent Kindly Oblige me. Am really grateful for your thoughts is quite expository, God bless you.
