Fast forward 2019, My circumstances have greatly changed, married for five years now and i have a son who is a U.S citizen. My wife who is a doctor is about to apply for her TIER2 visa to work in the UK and i and my son are her dependents. please i would like to know if we can go ahead and apply for her TIer2 as a family, I would like to know if past refusal under 320 7(a) would not jeopardise the application. i am just worried and i need clarity to alleviate my concerns. Hello, It will really depend on the year u were born... if u were born after the citizen by birth was cancelled then u simply apply for a tourist visa...no long story just put a copy of ur birth certificate just to pove that you were actually born in the Uk because it will b stated in ur Nigerian passport...You really have no claim to the UK if u were born after 1986 or so...

Good afternoon. My uncle is in South Africa studying, he has some qualifications. He is thinking of getting UK tier 2 visa which will enable him to work. I just need the best way he can about is application because he applied to some companies, but they are requesting him to pay certain fee inorder to reconstruct his CV.

Let me speak to the separate part of your issue that I'm aware of, i.e. how 320 (7A) works:

About 320 (7A) - once you get that, I'm afraid you're virtually banned. The "may" in the "future applications may be denied under 320 (7B)" refers only to serious compassionate grounds for a visa grant. Such grounds are usually grave health conditions or the refugee/asylum scenarios, etc.

However, assuming the reason for your denial under 320 (7A) was overstaying, you just may have a chance. If it was for the use of false documents/making false statements, you need to conclusively show that you were unaware of this to slip out of a 320(7B) ban, which you should have addressed at the time.

Visa issues can also cut across categories - in other words, if you had trouble with a visitor's visa application, it can affect a student's visa application, for instance. I know someone who overstayed for a long while, returned, was denied visitor's visas twice thereafter, and a student's visa (for a master's) twice as well (came from a wealthy family and was fully funded and all that) until she gave up and went elsewhere. This however was before Theresa May brought in the new Immigration Rules in 2011. Things are apt to be even tighter now.

The new rules only make reference to visitor's visas being automatically refused in the event of any deception or fraud with previous applications of any category, but I think its only reasonable to assume that the reverse would also be the case.

Will this affect your wife's Tier 2 application with respect to you as a dependent? I can't say conclusively, not having come across someone who has your specific problem before, but I don't think that you can expect much leniency, if at all in today's hysterical immigration climate in the UK (read up about the Immigration Bill that was passed last night to give you a better idea of what these people are thinking).

As long as you declare previous refusal you will be find in that aspect.

Yes you can apply for 2yrs but whether you will be issued or not its up to the ECO and documents you submitted.

I need some advice if possible.

I'm British, my wife Nigerian. She's with me here on a settlement visa all fine.

We applied for a visitor visa for her mum to come and visit and we were refused on the grounds that we hadn't proved that she would leave the UK once her visa has expired.

We stated the dates she would be visiting from and to, proved that I would be sponsoring her financially in full, proved she would be staying with us.

She is retired and relies on money from her sons and daughters and what little pension she gets.

1. Yes you can apply in March no problem.

2. I'm not sure about this but you can check Nigeria immigration website about child passport to know if you can get her a passport or her visa will be attached to your wifes

Sir I had paid for the conference £180 for students member and I also got an invitation letter from them. The registrar of my school had also given me a letter of introduction.

Sir I intend to use my supervisors statement of account, although am paying for my flight and accommodation but just that I don't have the money in bulk rather it's coming in piece meal from my poultry business. Do I have to submit my own personal account statement too? Or just my supervisor own?

Also I had traveled to UAE in 2014 and was also fortunate to get US visit visa in 2015 but I was returned at the point of entry and landed a five year ban. ( No criminal offence o). Sir, but this passport had expired and I already got a new one. Should I tell them of my US visit in my form? Should I go with the former passport.

Even a day old child, you can get passport for him/her according to immigration officer whom I call when am about to get for 2 months old child.
