6) Can they ( Atiku and Jada Brothers) contest and be voted for up to the post of the Vice Presidency? YES because the Constitution paved way for them?

7. The question is: Did Atiku fulfill the Constitutional requirements to contest for the post of the president?

8 . The Answer is what the APC wants the Appeal court to determine, because one of the requirements is that you MUST A Citizen By BIRTH To Qualify.

9. That you are citizen of Nigeria by other means such as Referendum, Naturalization, Registration etc can only take you the office of the Vice President and not that of the President according to the 1999 Constitution we operate.

Awolowo, Azikiwe and Balewa were all born in territories that were not originally other countries however Jada was originally part of another country called Cameroon before referendum merged it with Nigeria in 1961.

The moment the constitution specifically gave the requirement needed to be President, it automatically also spoke about the position of the VP.

I am sure even you know the difference between the words PRESIDENT and VICE PRESIDENT.

To be president in Nigeria you MUST BE A CITIZEN BY BIRTH.

IF You are a VP and was not a citizen by birth this means if the President dies you can only be an ACTING PRESIDENT for a stipulated time until a new election is done. YOU ARE NOT A PRESIDENT OFFICIALLY BUT ACTING.

Anyone that does not understand this bricklayer explanation must have a problem.

But again, what can i say, his followers will never accept. some will even tell you he was born in Lagos.

The constitution is very clear about this. This is the most clear case i have seen in recent times.

Clearly, PDP goofed big time by fielding Atiku!

To be President, the constitution says you must be NIGERIAN BY BIRTH.

Atiku himself has goofed on this.

There is no way a law court will go against the letters of the constitution. the paper did not say you must be a Nigerian (Atiku qualifies in that case) but it says you must be a Nigerian by birth.

End of discussion.

End of ambition.

Barack Obama was born in Honolulu, Hawaii not Kenya. Though he's a Kenyan by parental origin but he is a US citizen by birth. So I'm beginning to see sense in what APC is saying. PDP never saw it coming or paradventure never understood the constitution properly. Let's see how it gonna pan out!

Stop sounding silly, the Constitution after the independent as amended has duely taken care of Zik and other nationalists Electoral position. Atiku / Appendage participation in election needs constitutional amendment to accommodate the Plebiscite

Chapter VI, Part I, Section 131 of the constitution states that a person may be qualified for election of the office of the President if:

They are a citizen of Nigeria by birth;
They have attained the age of thirty five years;
They are a member of a political party and is sponsored by that political party;
They have been educated up to at least School Certificate level or its equivalent.

What a tragedy that even this illiterate does not understand the constitutional requirement of presidential eligibility by virtue of birth.

Has Atiku denied that he was not born in Cameroon and held a Cameroonian birth certificate for the first 15years of his life and sang the Cameroonian anthem in school?

Has anyone said Atiku is not a Nigerian now, by virtue of the 1961 assimilation of his region of Cameroon into Nigeria?

But did the constitution not state that to be eligible for Nigerian Presidency, the candidate must have been born by Nigerians and born within Nigeria?

Atiku is a Nigerian, but not Nigerian enough according to the constitution, to be able to qualify for the Nigerian Presidency.

IMO this is INEC's mistake. It's INEC's job to verify the eligibility of candidates before allowing them contest.
