Nice question. But, was the 1999 constitution used then? This issue only served as an eye opener that it needs amendment. I would have been glad if I could get the 1960 constitution. Besides, before the full amalgamation of 1914 of the southern and northern protectorate, The south and the northern were being regarded as the Southern and Northern protectorates of Nigeria.

The root for the name “Nigeria” lies within the river Niger. It is interesting that the honour of naming our massive country was given to a woman. Her name was Flora Shaw. This country`s name was coined in the late 19th century. According to historical sources, this happened in 1897.

kahal29:
Jada History

Atiku Abubakar is from Jada town in Adamawa State of Nigeria. However, Jada used to be in Ganye Local Government Area in Adamawa. Ganye is regarded as the mother of the whole Chamba tribe.

This area was never part of Nigeria legally until the February 1961 plebiscite where the people of the then Northern Cameroon voted to join Nigeria.

The area had been entrusted to Britain by a League of Nations mandate in 1919 and later as Trust Territory by the United Nations in 1946, according to an article published on Myculturebase.

A plebiscite was held in British Cameroons to determine whether the people preferred to stay in Cameroon or align with Nigeria. While Northern Cameroon preferred a union with Nigeria, Southern Cameroon chose alignment with the mother country. On June 1, 1961, Northern Cameroon became part of Nigeria, and on October 1, 1961, the southern territory dissolved into Cameroon.

Ganye, which incorporates Atiku’s birthplace of Jada was the headquarters of British Cameroons, but following the plebiscite, joined Nigeria.

Though Mr Kanu is correct about the historical origin of Atiku’s Jada, it is, however, instructive to note that when Mr Abubakar was on November 25, 1946 born to a Fulani trader and farmer Garba Abubakar, Jada village and other parts of Chamba land in the then Northern Cameroon were still known as British Cameroons.

With the defeat of Germany in World War I, Kamerun became a League of Nations mandate territory and was split into French Cameroons and British Cameroons in 1919.

While France integrated the economy of their part of Cameroon with that of France, the British administered theirs from neighbouring Nigeria, making Atiku’s Jada a British franchise.

Aside from these historical twists, the fact, however, remains that the PDP presidential candidate is legally a Nigerian as Jada became a full Nigerian territory after the plebiscite 59 years ago.

For the brainless IPOB miscreants here, who have been going about doing copy and paste from God knows where about APC's reply to Atiku Petition.

Let me school you a bit here:

1. Atiku is a Citizen of Nigeria.

2. Nobody is contesting his Citizenship and that of his Jada People of Adamawa.

3. What are the ways one can become a citizen of Nigeria?
a) BY BIRTH
B) BY REGISTRATION
C) BY REFERENDUM
D) BY NATURALIZATION

4) Out of above methods, it is only a person who becomes a CITIZEN By BIRTH Is Qualified To Contest for the Office Of The President.

5. Can Atiku and His Jada Cameroon vote and be voted for? Yes because they are Citizens of Nigeria by Referendum.

6) Can they ( Atiku and Jada Brothers) contest and be voted for up to the post of the Vice Presidency? YES because the Constitution paved way for them?

7. The question is: Did Atiku fulfill the Constitutional requirements to contest for the post of the president?

8 . The Answer is what the APC wants the Appeal court to determine, because one of the requirements is that you MUST A Citizen By BIRTH To Qualify.

9. That you are citizen of Nigeria by other means such as Referendum, Naturalization, Registration etc can only take you the office of the Vice President and not that of the President according to the 1999 Constitution we operate.

What is hard here to understand?

Your logic hold no water, first it was Atiku is a Cameroonian, now your narrative has changed oh he is indeed a Nigerian but can't hold public office, are you such a confused and disturbed individual for real?

Both Atiku,Buhari and some present day Cameroonians were all born in the colony and protectorate Nigeria(1914-1954)until it was divided in 1954 into present day Nigeria and some parts of present day Cameroon and so therefore carry same status of place of birth.

How come Atiku is now conveniently a Cameroonian while Buhari is a Nigerian when they were all born in the same country as there was no such entity as Cameroon until 1954.

I hope I have made myself clear in the most elementary way for u to comprehend and if u still don't understand your case is indeed irredeemable.

Is it that the igbo nation is made up of confused people or what? the Nnamdi Kanu's igbo people are supporting Atiku, whereas their leader Nnamdi Kanu is saying Atiku is not a Nigerian. So is it that some igbos are behind Kanu while some are behind Atiku? This shows that there will not be a single iota of unity in their so-called IPOB nation if at all they eventually achieve it, they will still have to contend with their own self-made civil war in their Biafra nation.

I like the way APC is dealing with Atiku/PDP petition challenging it's victory @ the poll

They have not even started defending their victory

They only shake the table of his eligibility to even contest not to talk of him challenging it's victory

Now the table seems to be scattering

I pity Atiku & pdp am sure they never expected this from apc & it's lawyers

What a tragedy that even this illiterate does not understand the constitutional requirement of presidential eligibility by virtue of birth.

Has Atiku denied that he was not born in Cameroon and held a Cameroonian birth certificate for the first 15years of his life and sang the Cameroonian anthem in school?

Has anyone said Atiku is not a Nigerian now, by virtue of the 1961 assimilation of his region of Cameroon into Nigeria?

But did the constitution not state that to be eligible for Nigerian Presidency, the candidate must have been born by Nigerians and born within Nigeria?

Atiku is a Nigerian, but not Nigerian enough according to the constitution, to be able to qualify for the Nigerian Presidency.

The moment the constitution specifically gave the requirement needed to be President, it automatically also spoke about the position of the VP.

I am sure even you know the difference between the words PRESIDENT and VICE PRESIDENT.

To be president in Nigeria you MUST BE A CITIZEN BY BIRTH.

IF You are a VP and was not a citizen by birth this means if the President dies you can only be an ACTING PRESIDENT for a stipulated time until a new election is done. YOU ARE NOT A PRESIDENT OFFICIALLY BUT ACTING.

Atiku, all this long epistle PDP is writing cannot help you to win this case in court. The constitution is the highest law in Nigeria. The tribunal cannot change the law,the highest they can do is to interprete it.
Nnamdi Kanu was the person that first made this discovery about your citizenship via a plebiscite. To win this case, you have to do as NNAMDI KANU has instructed you:
Section 131(D) of the Nigerian constitution states that for a person to qualify for election of presidency he/she must have also been educated up to at least School Certificate level or its equivalent.
What Atiku's legal team needs to do is to subpoena the waec chairman to testify under oath about buhari's original waec certificate or risk prison terms. Even if he lies, and produce a fake certificate, you have the force of law to perform a carbon dating analysis on the certificate to ascertain the exact year it was printed.

With respect to your allegation that Atiku was not born in Nigeria, you have no case submission; there is no issue especially since it is confirmed that his state and place of birth is under the territory of Nigeria. Besides you have not quoted expressly the article of the 1999 constitution that purportedly disqualifies Atiku.

If the desire for a better Nigeria, that would have been more auspicious given the administration of Atiku rather than the incompetent and toxic president of Nigeria (PMB), is interpretred by you as loving illegality. Then so be it.

Mind you, you and FG are still to convict Atiku on your persistent allegation of theft. We are not all fools, you see!

- How does a sane govt use its own hands to divide its Nation. How do you look the elderly Adamawa, Taraba, Yobe in the eyes and call them non - citizens?

Different country with different constitution. You can google about Wyclef Jean, a very popular musician. He was born on October 17, 1969, in the small town of Croix-des-Bouquets, just outside of Port-au-Prince, Haiti.

In 2010, Jean announced he’d be running for president of Haiti in that year’s election. However, his candidacy was refused as he hadn’t been a resident in Haiti for the five prior years.

Despite being born in Haiti, his candidacy was denied.
