It’s like the COs in the embassy have been changed. The questions being asked at the embassy from what I can see here look a lot more technical/harder than what I experienced on my own interview day.

Simple advice guys, ask a lot of questions before your interview date(that’s why LegitBachelor in his wisdom created this group so that those who have gone through the process can advise/assist in any way those who are yet to), prepare well (carry every evidence you have concerning the interview process. There is nothing worse than being asked for evidence and you answer by saying it isn’t in your possession. It will put you off straight), be confident and pray.

Dear Gurus here, please advice my cousin who is a K1 beneficiary. His petitioner/fiance has been contacted by NVC that her beneficiary's (fiancee's)document has been sent to Lagos embassy, we tracked it online (on US embassy website) and the message reads, ''Your case is in transit to the consular section''. Can he go ahead and pay the visa fees, complete his DS 160 and schedule his interview? 2) His Naija passport is expiring in 4 months, can he go ahead and schedule the interview with this passport while he arranges to renew the passport before the actual interview (he's considering doing this so that he doesn't have to wait till he renews his passport which will definitely eat into his waiting time and make him loose available dates). Urgent advice please.... and he's also scared of them rejecting his DS 160 when they see that the passport he used to complete it has less than 6 months validity...

1. I dont recommend scheduling an interview until contacted by the Embassy. Its a risk many people take but could backfire if the risk fails. What I would rather advice is to continue tracking the casefile until its confirmed to be in the Embassy. Also an email should be sent to the Embassy by the couples confirming this by providing their full details (full names, dates of birth, emails, case number, receipt number, passport number, etc), they will respond within a week. If they say they can go ahead and schedule, then they can.

2. I recommend he renew his passport asap. It won't take long, 2 weeks at most. I think he will be denied if he uses a different passport during the visa interview. I also think a passport should have a 6 months validity at the time of the interview.

There is nothing weird about it, only cr1/ir1 gets their interview dates. K1 applicants schedule interview themselves after paying the visa fee. Check that link for more info

You are good to go. Go ahead and schedule your interview as adviced by Drenimarcus.

You should also send an email to the US Embassy requesting the K1 Packet along with other directions. You should provide details such as you and your fiance email, case number, date of birth, passport number, phone number, etc. They will reply on a weeks time with this generic mail below:

The U.S. Consulate General in Lagos is ready to begin final processing of your approved K1 visa petition. Kindly visit any branch of Guaranty Trust Bank PLC in Nigeria IMMEDIATELY to pay the K1 visa processing fee of $265; and after that, follow the instructions for fiancé/fiancée visa applicants attached to this email. K1 Visas arrive at post with only a four month validity. You must attempt to secure an interview date that falls before the expiration of your approved Form I-129F petition, since the validity of your approved petition may not be extended.

As required by law, we have also attached a copy of the USCIS pamphlet "Information on the Legal Rights Available to Immigrant Victims of Domestic Violence in the United States and Facts about Immigrating on a Marriage-Based Visa." The pamphlet is sent to all applicants in this visa category.

You'll be denied if you mention it during your interview. You can't be married and yet seek to get fiance visa at the same time, they will deny you and advice you go the spousal visa route.

Can I still go to high court for traditional wedding divorce paper because it seems the embassy recognise.just high court?

Divorce paper for traditional wedding is gottem from Customary Courts. Divorce paper for others is from a competent High Court. Ask a lawyer for confirmation.

This is what I think:

If the traditional wedding was done without going to the Registry (be it Federal, State or LGA) or Customary Courts to register it officially then the proper way of divorce is to return the brideprice to the bride's parents in the presence of witnesses. Also divorce papers is then gotten from the Customary Courts.

If the traditional wedding is registered at the Registry then I think the High Courts should come into play here....I'm not too sure.

I recommend a special thread be created where this question is asked. The thread should be created in the Romance section and the moderators and supermoderators can help in pushing it to the frontpage. The question in the thread should be well structured so the mods will see it as FrontPage worthy. I believe we will get good answers there as there are some sound lawyers here om nairaland. Can you create it?

The requirement is to meet at least once within two years prior to filing the petition by the USC fiance(e).

The time together can hold anywhere but it's important to document with pictures and receipts of places visited together. Flight tickets and boarding passes is also good evidence.

Be careful with having a formal introduction though as that may be considered as being married which will disqualify the applicant from getting the K1 visa.
Thanks for this thread. I and my fiancee who is an American citizen have been dating since 2015, she visited me in Nigeria in Jan 2017 and we have pictures together which was taken during her visit. She intends to file a petition for me in June. I want to know if we will encounter any problem due to the fact that the pictures we have together are a few months above 2yrs? She would have visited in Dec 2018 but she was in her finals in school and needed to concentrate.
