Everyone can have access to your account provided he has your phone number or ATM card linked to your account. That's not Hacking, that's stealing. He exploited the vulnerabilities which everyone knows to steal from you.

Even if Sim card is used in another phone, you still need password to access a bank account for any transaction except maybe self recharge. I wont be surprised if the guy alleges in court that the police wrote the statement and forced him to sign it.
