Babalegba, you mean you have been cheating your tenant with a month rent!!!

So if he pay March 17, the next rent will be due Feb 16, the following year will be due jan 15, another dec 14, another Nov 13 and so on

Aba!!! Babalegba
I believe you guys are trolling the thread. Afew of my tenants are teachers and one is an accountant. It took me less than five minutes to explain it also to the policeman among them who holds a WASC certificate so supposedly erudite nairalanders should not be this confused

Your landlord is correct, April to March = 12 months
April to April =13months

I can't believe we have someone like you on nairaland, after you will be calling Buhari illiterate when you are even worse... what a shame... And you even have the guts to say someone else doesn't know maths... Lol... ignorance is indeed bleak..

It expires 17th March 2020. That's what meant

If you paid in April, your rent expires in March. Please pay up ASAP.

You don't know anything.

April 17, 2019 – March 17, 2020 is 335 days

April 17 2019- April 17 2020 is 365 days which makes one year.

Unfortunately folks like you are those that shout "lawyers are liars" around town. He made his input you've refused to see any logic in it, do any extra research about it, placed a call or two to any other lawyer. You just started attacking the man and the Nigerian Legal System.
No one is a encyclopedia of knowledge but that you pay your rent or live in a Lagos or where ever for that matter does not give you the temerity to attack a person who is licenced to practice law anywhere in Nigeria.
Besides that jargon you put in bracket above cannot be interpreted in the eyes of the law. It is nonsense.
Please sir, what does the law say concerning one year rent? Does the law see 1 year as 11months?

You be confirmed ogobo for counting April 18th 2019 to April 31st 2019 as 1 month,is that how u were taught in primary school..

He only used 13 days in April 2019 and will use the remaining 17 days in April 2020..

13 days 2019 + 17 days 2020 = 30 days which comprises of 1 full April month..

Oversabi. It's called "Quit Notice" for a reason, you're entitled to that 6 months to quit the apartment. No tenant will pay a dime when quitting an apartment after being issued a court order quit notice.

Like I said, you are ignorant.

The notice to quit does not and has never meant you won't pay rent during the notice period. Go and ask a good lawyer if one of such is unfortunate to know you.

It's like giving your employer notice of resignation and you are saying the employer would not pay you for the period of notice.

Your rent expires 17/03/2020 and he is correct and there is more to this. That’s exactly 12month

How did u do ur calculation?

correct calculation is

17/05=1 month
17/06=2 months
17/07= 3months
17/08 = 4 months
17/09= 5 months
17/10 =6months
17/11 =7 months
17/12 =8 months
17/01 = 9 months
17/ 02 = 10 months
17 /03 = 11 months
17 / 04 = 12 months

The computation is faulty. It has to be a clear calender month. So it starts counting from 1st of May, 2019 and will end on 30th of April. Tenancy cannot start mid-month. It's the law.
Re: My Landlord Wants To Evict Me Before My Rent Expires by like1: 12:53pm On Apr 02, 2020
It's possible to make such agreement if the tenants/landlords agree but most agreements are not that way. Most yearly agreements are on a 12 months basis even the first year, this is one of the reasons landlords of new homes prefer to start renting from first of January.

Don't use that I am a lawyer here. Do you know how many people who are lawyers (SAN) in this country. It's not a good basis, be logical and state facts clearly.

In the case of this young man it is clear that the agreement was on a yearly basis starting from the first year rather there is a misunderstanding of counting between both parties.

Alvin007:

I don't know how best to explain this to you. I'm a Lawyer..and I've tried to let you know why the Tenancy agreements are made 11months for first rent payments...after which subsequent rents will be calculated as 12 full months...
How should I explain again biko? I give up.

My Landlord Is Intimidating Me And Wants To Evict Me Before My Rent Expires

I paid my house rent for one full year on 18/04/2019. My rent is due to expire on 17/04/2020.

But my Landlord is insisting it expired on 17/03/2020. Which is Eleven months. I have tried explaining to him but he wants to lock me out unless I pay immediately.

Please how do I get redress.

You are very wrong. I face this exact problem with tenants sometimes because I rent a few flats out but once I show them a calendar and tell them to start counting they agree. By the way I'm disappointed at the numeracy skills of many Nigerians

It will be great charging you to court to teach you how the business calender works. You are cheating on your tenant and I wish I knew one of them to sue you for correction and not for penalty. You know you will never win in court. If you sure u will win, I can challenge you but the consequences of the final judgment will fall on you by repaying all illegal fee you have collected

Lawyer? I am shocked. What is your legal authority on Tenancy Agreements being made 11months for first rent payments? In a yearly Tenancy? Unless the parties agree to that, it will be pure fraud on the tenant. Please go and refresh your knowledge of Property Law and don't mislead the readers here.

I would have let you wallow in your buffoonery but read section 30 of the Lagos Tenancy Law that explicitly provides for the claim of Mesne Profits which is for the period from when the rent ends to the period the tenant packs out.

This is of course, if you can read.

But is it not clear what the problem is?

It is quite obvious that the problem is a counting problem and not on rental agreements.

But if you are not you can use the mediation center in the local government of the area you stay to discuss your right.
