The governor lost the local government to autonomy, they are about to lose their little influence over commissioners of police in their various states because a bill just passed 3rd read the house of rep, now they have lost the state judiciary and legislature to the autonomous drive of this administration. I'm impressed. Just take the power to conduct LGs election from them and put it under INEC so that the LGs can be fully autonomous. senatordave1:. The autonomy of State Houses of Assembly and Judiciary of the state is not fully in the 1999 constitution. The constitution must be repealed to accommodate this autonomy that cannot be set aside by any future President. |

senatordave1:. Your opinion is true.The focus now is State HA and Judiciary. Some state executives do what they like on this matter.That is why giving autonomy to the SHA and Judiciary must be a constitutional matter like that of the federal government. This provision must be incorporated into the 1999 constitution and be spelt out in full terms for future references I agree with you that the SC will have a final say in this matter. |

Pope22:it simply means an institution being independent enough to carry out some things without queries or questions adding financial to it,legislative and judiciary arms in each states will directly be getting funds from the federation account without interference from the state governor. so the clerks of the house will be the accounting officer henceforth where the funds will go to directly. |

The financial autonomy is already in the Constitution as amended and signed in 2018. The executive order is not a law but the exercise of the power given to the president in section 5 of the Constitution to give effect or force to the implimentation of what is already in the Constitution |

senatordave1:I am peer-reviewing 121(3) of 1999 Constitution (as amended). We must congratulate Saraki/Dogara-led-National Assembly in 2018. In the words of Karibi-Whyte, J.S.C, (SC 4/1996; 28/5/99) vide in Attorney General of the Federation Vs. Guardian Newspapers Ltd:“A notable feature of the amended Constitution… is the distribution of the exercise of government functions among the three principal and separate departments of the Legislature, the Executive and the Judiciary. The Constitution also prescribed scope and limits for each department and that within its jurisdiction, the exercise of power is supreme. Accordingly, implicit in the power so vested, the one was not to interfere in the exercise of power of the other, except to the extent to which the Constitution confers such power of interference. This is the hallowed principle of the separation of powers first formulated by Montesquieu and now nearly perfected in the Constitution .… As a general rule therefore, except otherwise expressly provided or incidental to powers conferred, the legislature cannot exercise either executive or judiciary power; the judiciary cannot exercise either executive or legislative power……” I regret to say that this is not the case with our democracy which is anything but far from the idea of a limited Government. As long as one branch of Government possesses the power to act in the absence of explicit legislative authorization, so long we will continue to endure a dysfunctional democracy.
